AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING
THE LAND USE MAP OF THE PORT TOWNSEND COMPREHENSIVE
PLAN AND REZONING LOTS 3 - 7, BLOCK 50, FOWLER'S PARK
ADDITION TO THE CTTY OF PORT TOWNSEND FROM R-II TO R-I AND
REZONING THE CITY OF PORT TOWNSEND PROPERTY REFERRED
TO AS ELMIItA PARK FROM R-II to P/OS.
WHEREAS, the Port Townsend Comprehensive Plan was adopted to provide
guidance for the community on accommodating growth and redevelopment in a manner that
respected the natural and built environment and enhanced the community; and
WHEREAS, the 2006 Comprehensive Plan Docket include a proposal to rezone a
portion of R-II zoning running along a shoreline bluff between Hendricks Street west to the
City limits including Block 50 of Fowlers Park Addition; and
WHEREAS, the intent of the proposed downzone from R-II to R-I was to improve
consistency between the zoning and the recently updated Shoreline Master Program; and
WHEREAS, on February 15, 2007, Planning Commission held anopen-record
hearing on the 2006 Comprehensive Plan Docket; and
WHEREAS, Planning Commission's recommendation was forwarded to City
Council which held anopen-record public hearing on the proposal on April 16, 2007; and
WHEREAS, on May 21, 2007, Council identified a number of concerns regarding
the subject proposal based on information identified at the April 16, 2007 hearing and
remanded the subject proposal to the Planning Commission for further consideration and
recommendation; and
WHEREAS, on June 28, 2007, Planning Commission reviewed the concerns
identified by Council and moved to re-notice and re-open the hearing on the subject proposal
to consider a revised recommendation from Staff and applicant addressing concerns raised by
the Council; and
WHEREAS, on August 9, 2007, Planning Commission reopened the hearing; and
WHEREAS, the Planning Commission after review of the record, consideration of
testimony and discussion voted to forward a revised recommendation to the City Council;
and
WHEREAS, the City Council held a public hearing on October 15, 2007 to consider
the Planning Commissions revised recommendation on the matter; and

WHEREAS, The Council, after review of the record, consideration of public
testimony and discussion approved the proposed rezone by a vote of 5 in favor and 0
opposed,
NOW, THEREFORE, the City Council of the City of Port Townsend ordains as
follows:
SECTION 1. Adoption of Amendment to the Land Use Map of the Port Townsend
Comprehensive Plan and Corollary Amendment to the Official Zoning Map of the City of
Port Townsend. Pursuant to the City's authority under Chapters 35A.63 and 36.70A RCW,
and concurrent with the adoption of this ordinance, the City Council hereby adopts an
amended Official Comprehensive Plan Land Use and Zoning Map for the City of Port
Townsend, to reflect redesignation/rezoning of the properties as indicated on the attached
Exhibit A from R-II to R-I and from R-II to P/05.
SECTION 2. Severabilitv. ff any sentence, clause or phrase of this ordinance should be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section,
sentence, clause or phrase or work of this ordinance.
SECTION 3. Effective Date. This Ordinance shall take effect immediately after passage if
adopted by a majority plus one of the City Council. Otherwise this ordinance shall take effect
and be in force five days after the date of its publication in the manner provided by law.
Publication of this ordinance shall be by summazy thereof consisting of the title.
Adopted by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this fifteenth day of October, 2007.
