AN ORDINANCE VACATING THAT PORTION OF JEFFERSON
STREET LYING BETWEEN WALKER STREET AND CASS STREET
WITHIN THE CITY OF PORT TOWNSEND; ESTABLISHING
CONDITIONS TO THE STREET VACATION; AND ESTABLISH-
ING AN EFFECTIVE DATE
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR
SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS:
.Sec. ti0_n 1_. That that portion of Jefferson Street, lying be-
tween Walker Street and Cass Street, within the City of Port Town-
sent, be and the same is hereby vacated.
Section 2. That the street vacation aforementioned is condi-
tioned, however, on the following:
a. The City of Port Townsend, for itself, its successors and
assigns, reserves a 12-foot wide utility easement for the existing
sewer and water lines located in that portion of Jefferson Street
vacated herein.
b. The City of Port Townsend, for itself, its successors and
assigns, and Jefferson County, a municipal corporation, retains all
existing easements located within Jefferson Street for electric,
telephone and television cable utilities.
c. That Jefferson County execute a restrictive covenant, in
form and substance acceptable to the City, providing for no less
than a 22-foot right-of-way to remain open and accessible for pur-
poses of a driveway for two-way vehicular traffic and traffic cir-
culation running through or near the vacated portion of Jefferson
Street from Cass Street to Walker Street, which restrictive cov-
enant shall provide that it may be amended from time to time by
agreement of Jefferson County and the City Council for the City of
Port Townsend.
d. A final street improvement plan addressing storm drainage,
retention of parking spaces, police services and pedestrian circu-
lation and safety shall first be submitted to and approved by the
City Public Works Director.
e. Ail fees and compensation pursuant to Chapter 12 of the
Port Townsend Municipal Code must first be paid by the street vaca-
tion applicant to the City Treasurer for the City of Port Townsend.
Section 3. That each of the aforementioned conditions shall
first 'b'e' sa~i'sfied, and upon satisfaction of the same, this ordin-

ance may be published and a certified copy of this ordinance shall
then be recorded by the City Clerk with the Jefferson County Auditor,
at which time this ordinance shall be effective.
Section 4. That the street vacation provided for herein shall
be cancelled and become automatically null and void one year from
the date of this ordinance if said fees and compensation have not
been paid by the applicant and received by the City Treasurer.
Section 5. This ordinance shall take effect upon its passage,
approval and publication in the form and manner provided by law,
and after it has been recorded with the Jefferson County Auditor
pursuant to Section 3 of this ordinance.
Read for the first, second and third times, passed by the City
Council for the City of Port Townsend, and signed by the Mayor of
