Ordinance No. 2943
AN ORDINANCE OF THE CITY OF PORT TOWNSEND REPEALING PORT
TOWNSEND MUNICIPAL CODE, SECTIONS 8.04.270 ON POTENTIALLY
DANGEROUS DOGS AND .272 ON FAILURE TO CONTROL A DOG DECLARED
POTENTIALLY DANGEROUS, AND ADOPTING BY REFERENCE PORTIONS OF
RCW 16.08.070 THROUGH RCW 16.08.100 CONCERNING DANGEROUS DOGS
WHEREAS, because the City contracts with Jefferson County for animal control
services, the Council deems it appropriate, in order to avoid redundant processes (one for
"City dogs" and one for "County dogs"), that County animal control officer declarations
and determinations concerning dangerous dogs be processed under County processes
(including those provisions of the Revised Code of Washington that govern the County's
determinations in this regard).
NOW, THEREFORE, the City Council of the City of Port Townsend ordains
as follows:
SECTION 1. Repeal and Amendment. Section 8.04.270 on Potentially
Dangerous Dogs and Section 8.04.272 on Failure to Control a Dog Declared
Potentially Dangerous are hereby repealed, and a new Section 8.04.271 is adopted and
shall read as follows:
Section 8.04.271 - Dangerous Dogs
There are hereby adopted for the City RCW 16.08.070 through RCW 16.08.100
concerning Dangerous Dogs, as now or later amended, which are hereby incorporated
by reference and constitute a part of the City's animal control regulations codified in
Chapter 8.04 of the Port Townsend Municipal Code, except and in addition as follows:
(1) RCW 16.08.080(1) is amended to read as follows: The City department providing
animal control service, and/or another public entity providing such service in the City
pursuant to City contract, is authorized to declare a dog a potentially dangerous dog or
dangerous dog as defined in RCW 16.08.070, and must serve notice upon the dog
owner in person or by regular and certified mail, return receipt requested.
(2) "Authority" means the "City department providing animal control service, and/or
another public entity providing such service in the City pursuant to City contract."
(3) "Local jurisdiction" means the "City department providing animal control service,
and/or another public entity providing such service in the City pursuant to City
contract. "

(4) For purposes of RCW 16.08.070 through RCW 16.08.100 concerning Dangerous
Dogs, all functions and authority for actions authorized by said sections are under the
control and authority of the City department providing animal control service, and/or
another public entity providing such service in the City pursuant to City contract.
The City Clerk shall keep copies of RCW 16.08.070 through RCW 16.08.100
concerning Dangerous Dogs available to the public for inspection and copying.
SECTION 2. Severability. If any provision of this ordinance or its
application to any person or circumstance is held invalid, the remainder of the
ordinance, or the application of the provision to other persons or circumstances, is not
affected .
This ordinance shall take effect and be in force five days after the date of its
publication in the manner provided by law.
Adopted by the City Council of the City of Port Townsend, Washington, at a
regular meeting thereof, held this fifth day of March, 2007.
