AN ORDINANCE VACATING A PORTION OF 16TH AND 17TH STREETS
BETWEEN THOMAS AND MCPHERSON, AND A PORTION OF MCPHERSON
BETWEEN DISCOVERY ROAD AND 17TH, IN THE EISENBEIS ADDITION TO
PORT TOWNSEND; ESTABLISHING CONDITIONS TO THE STREET

WHEREAS, the City Council for the City of Port Townsend has considered a Street
Vacation in connection with the City Development Services Department's approval of Great
Western Short Subdivision LUP05-015, which approval was subject to certain conditions
including Council approval of this street vacation,. and following due notice has held a public
hearing upon the application on July 18, 2005 and August 22, 2005; and
WHEREAS, the vacation request involves a portion of 16th and 17th streets between
Thomas and McPherson, and a portion of McPherson between Discovery Road and 17th, in the
Eisenbies Addition to Port Townsend; and
WHEREAS, the vacation request was modified to also involve a portion of the west one-
half of McPherson St. north of the proposed new Lane contained within the Subdivision (mid-
block of Block L, Eisenbeis Addition to the City of Port Townsend), and 17th Street adjacent to
Block L, which To"me Point Owners Association (as abutting owner of this portion of
McPherson) has agreed to convey for inclusion into the Subdivision, and which the City
Development Services Department has approved for incorporation into the Subdivision.

WHEREAS, the street vacation is part of a proposed short-plat and reconfiguration of
"Block L" of Eisenbeis Addition, where certain platted streets would be vacated in return for
dedication of new streets to serve the newly configured lots in the Block; and
WHEREAS, the Development Services Department has approved the short plat and new
road configuration, subject to Council approval of the street vacation; and
WHEREAS, the City Council for the reasons stated in the decision of the Development
Services Department finds that the proposed street vacation is in the public interest and welfare,
subject to fmal plat approval; failure to obtain final plat approval shall negate the approval of the
Council to conditionally approve this street vacation.
NOW, THEREFORE, the City Council of the City ofPort Townsend ordains as
follows:
Section 1.
Subject to the conditions in Section 2 of this Ordinance, the following right-of-
way is hereby vacated (map attached for illustration as Exhibit A):
Right ofWav Portion No. 1. A portion of 16th between Thomas and McPherson, the south one-
half of 17th Streets, and a portion of McPherson between Discovery Road and 17th, in the
Eisenbies Addition to City of Port Townsend, Records of Jefferson County, Washington.
Right of Way Portion No.2. That portion of McPherson Street, 66 feet wide, as shown on the
Supplementary Platt of the Eisenbeis Addition to the City of Port Townsend, as per plat recorded
in Volume 2 of Plats, Page 24, records of Jefferson County, described as follows:
Beginning at the intersection of the center lines of 17th Street, 66 feet wide, and said McPherson
Street, 66 feet wide;
Thence along the centerline of said McPherson Street South 00053 '07" West 124.91 feet;
Thence South 67029'30" West 35.96 feet to the Westerly right of way line oflast said street;
Thence along said Westerly line North 00053'07" East 139.16 feet to an intersection with said
center line of 17th Street;
Thence along last said center line South 89006'53" East 33.00 feet to the Point of Beginning.
Situate in Jefferson County, State of Washington
Section 2.
Vacation of the aforementioned rights-of-way is conditioned on the following:
This vacation is subject to [mal plat approval of the Great Western Short
Subdivision LUP05-015; failure to obtain final plat approval shall negate the
approval of the City Council to conditionally approve this street vacation.
Petitioners shall adhere to all conditions of the approval of Great Western Short
Subdivision LUP05-015. The petitioner shall pay for all fees associated with
recording this Ordinance and related documents. The City Manager is

authorized to record this Ordinance concurrently with the final plat approval of
the Great Western Short Subdivision LUP05-015.
Section 3.
This ordinance shall take effect upon its passage, approval and publication in
the form and manner provided by law, and after it has been recorded with the
Jefferson County Auditor by the City pursuant to Section 2 of this ordinance.
Adopted by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this 22 day of August, 2005.
