AN ORDINANCE PERTAINING TO ZONING, ESTABLISHING A NEW
SECTION IN CHAPTER 17.08 OF THE PORT TOWNSEND MUNICIPAL
CODE DEFINING "TRANSIENT ACCOMMODATION"; AMENDING
SECTIONS IN CHAPTER 17.08 OF THE PORT TOWNSEND MUNICIPAL
CODE TO FURTHER DEFINE TRANSIENT-TYPE USES AS "TRANSIENT
ACCOMMODATION"; AND ESTABLISHING AN EFFECTIVE DATE
WHEREAS, due public notice and public hearing have been held by the Planning
Commission and by the City Council of the City of Port Townsend pursuant to Title 17 of the
Port Townsend Municipal Code, now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DO ORDAIN AS
FOLLOWS:
Section 1. There is here and hereby added to Chapter 17,08, Definitions, of the Port
Townsend Municipal Code a new section to read as follows:
"17.08.498 Transient accommodation. "Transient accommodation" means a
building, structure or facility, or any part thereof, such as a bed and breakfast
inn, inn, hotel, motel, motor hotel, tourist home, condominium or similar facility,
primarily designed for and offering one or more lodging units to travelers and
transient guests for periods of no more than 29 days in any calendar year.
Portions of calendar days shall be counted as full days. A transient
accommodation does not include an accommodation which a person occupies or
has a right to occupy as his or her domicile or permanent residence. It shall be
presumed that occupancy of real property for a period Of 30 consecutive days or
more constitutes a rental or lease of real property for residential, rather than
transient, accommodation purposes."
Section 2_. Section 17.08.043 of the Port TOwnsend Municipal Code is here and hereby
amended to read as follows:
:,17.08.043 Bed and breakfast inn. "Bed and breakfast inn" means a building
with a central kitchen which provides the primary residence for the owner or
operator and which offers guest rooms for travelers and transient guests for
compensation. Food service may be offered exclusively to people registered to
use the inn for dodging or special events. Accessory buildings which were
lawfully established prior to June 1, 1989, may be considered part of a bed and
breakfast inn. A bed and breakfast inn is a transient accommodation and shall
conform to Section 17.08.498, Transient accommodation, of this Title.',
Section 9. Section 17.08.240 of the Port Townsend Municipal code is here and hereby
mended to read as follows:
"17.08.240 Hotel, "Hotel means any building or portion thereof containing five
or more rooms which share a common entry to the building that are rented or
hired out to be occupied for sleeping purposes for compensation. A central
kitchen and dining room and accessory shops and services catering to the general
pubic may be provided. Not included are institutions housing persons under legal
restraint or requiring medical attention or care. A hotel is a transient
accommodation itn(t shall c~onf0rm to Section 17,08,498, Tr0asienl
accommodation, of this Title."
Section 4, Section 17.08.320 of the Port Townsend Municipal Code is here and hereby
amended to read as follows:
"17.08,~20 Motel, "Motel" means a building or buildings, detached or in
connected units or designed as a single structure, the units of which are used as
individual sleeping or dwelling units, having their own private toilet facilities, and
are designed primarily for the accommodations of transient automobile travelers.
Accommodations for trailers are not included. This term includes tourist court,
motor lodge, auto court, cabin court, motor inn and similar names. A motel is
a transient, accommodation and shall conform to Section 17.08.498, Transient
accommodation, of this Title,"
Section 5. Section 17.08.325 of the Port Townsend Municipal Code is here and hereby
amended to read as follows:
"17.08.325 Motor hotel. "Motor hotel" means a specialized hotel designed and
operated to provide hotel services and accommodations to the motoring public and
where the sleeping accommodations normally do not exceed one week's duration.
A motor hotel is a transient accommodation and shall conform to Section
17.08,498. Transient accommodation, of this Title."
Section 6, Section 17.08.485 of the Port Townsend Municipal Code is here and hereby
amended to read as follows:
"17.08.485 Tourist home "Tourist home" means a building which provides the
primary residence for the owners and which offers not more than two guest
rooms for hire to transient guests for sleeping purposes only. A tourist home or
a portion thereof may be located in an accessory building which was lawfully
established prior to June 1, 1989. A tourist home is a transient accommodation
and shall conform to Section 17.08.498. Transient accommod_a_tion, of this Title."
Section 7, Severability. If any term or provision of this Ordinance or any part hereof
is held to be invalid or unenforceable, the remainder of this Ordinance or such term or provision
not affected by such holding shall continue in full force and effect to the extent permitted by
law.
Section 8, Effective Date. This Ordinance shall become effective upon its passage,
approval and publication in the form and manner provided by law.
Read for the first, second and third times, passed by the City Council for the City of Port
