Ordinance No. 2924
AN ORDINANCE AMENDING TABLE 17.22.020 OF THE PORT
TOWNSEND MUNCIPAL CODE PERMITTING BOAT SALES, REPAIR,
MAINTENANCE AND STORAGE IN THE C-II AND C-III ZONES OF
BLOCKS 4 and 93 OF THE ORIGINAL TOWNSITE OF PORT
TOWNSEND
WHEREAS, on June 5, 2006 the City Council directed the Planning Commission to
consider a zoning code text amendment to Table 17.20.030 ofthe Port Townsend Municipal
Code to allow boat building, repair, maintenance and storage as a permitted use in the C-1I
(General Commercial) zoned Fleet Marine property and in the C-IIl (Historic Commercial) zoned
Northwest Maritime Center (NWMC) property adjacent to Point Hudson; and
WHEREAS, Shannon-Elder Yachts, LLC, with the permission and acquiescence of the
property owners of Fleet Marine and the NWMC, requested this text amendment to assure that
they have the opportunity to continue the existing business at Fleet Marine and have the
opportunity to expand the business and facility into the future; and
WHEREAS, amending the zoning code use table for the NWMC site makes the zoning
code consistent with the draft Shoreline Master Program currently pending adoption by the State;
and
WHEREAS, the Port Townsend Comprehensive Plan and current and Draft Shoreline
Master Program encourage the support of small-scale marine trades businesses particularly in the
Point Hudson area; and
WHEREAS, the Fleet Marine property has for many years been a marine trades-centered
business; and
WHEREAS, the current and future use ofthe Fleet Marine property as a boat building,
repair, maintenance and storage business, and the intended use of the NWMC property as a
potential boat building and marine educational facility, have strong community, City and Port
support; and
WHEREAS, the City desires to facilitate uses into the future that provide local
employment opportunities for skilled marine trades workers; and
WHEREAS, the City further desires to make potentially non-conforming uses which are
desired uses at their locations permitted uses, rather than a nonconforming use where they have
no ability to expand, change or intensify; and
WHEREAS, on June 22, 2006, the Planning Commission held a public hearing on the
draft amendment concerning the proposed amendment to the C-1I and C-IIl zoned Blocks 4 and
93 of the Original Townsite, situated contiguous with the M-II(B) zoning district, (Point Hudson)
Marine Related Uses; and
WHEREAS, any concern that such use could be incompatible with other areas of Port
Townsend zoned C-1I or C-IlI can be alleviated by limiting the applicability of the text

amendment to Blocks 4 and 93 ofthe Original Townsite of Port Townsend where such use is
appropriate and suitable given the proximity to Point Hudson Marina; and
WHEREAS, the Planning Commission, after consideration of testimony received and a
review of the record, determined that the proposed use in the C-Il and C-IIl zoning districts in
conjunction with a limitation allowing such use only on Blocks 4 and 93 of the Original
Townsite situated immediately contiguous to the M-II(B) zoning district would be in the public
interest; and
WHEREAS, the Planning Commission, by a vote of 6 in favor and 0 opposed,
recommended approval of the proposed amendments,
NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
SECTION I: Table 17.22.020 of the Port Townsend Municipal Code shall be amended as
follows:

SECTION 2: Severability.
In the event anyone or more of the provisions of this ordinance shall for any reason be held to be
invalid, such invalidity shall not affect or invalidate any other provision of this ordinance, but
this ordinance shall be construed and enforced as if such invalid provision had not been
contained therein; PROVIDED, that any provision which shall for any reason
be held by reason of its extent to be invalid shall be deemed to be in effect to the extent permitted
bylaw.
SECTION 3: Effective Date
This Ordinance shall become effective five (5) days after its passage and publication.
Adopted by the City Council of the City of Port T ownsend, Washington, at a regular
meeting thereof, held this seventeenth day of July 2006.
