HomeMy WebLinkAbout2291 Vacating a Portion of Landes, Oxford and Kuhn Streets in Moore Place Addition ORDINANCE NO. 2291 ': AN ORDINANCE VACATING THOSE PORTI~Q~S OF- OXFORD AND KUH~ STREETS LYING a, 5 AND 6 OF THE MO0~ PLACE ADDITION TO THE CITY OF PORT TOne, SEND, EXCEPT THE SOUTHERLY PORTION OF ~NDES STreET ABUTTING LOT 6 OF BLOCK 6 AND LOT 6 OF BLOCK 5; VACATING ALL IN- TERIOR LOT LINES OF BLOCKS 3, g, 5 A~ 6 OF THE MOORE PLACE ADDITION; VACATING THE [~ST LINES OF BLOCKS 3, ~ A)~ 5, AND THE EAST LINES OF BLOCKS ~, 5 AND 6 OF THE MOORE PLACE ADDI- TION; ESTAgLISHING CONDITIONS TO_THE__$Tg~% A~D BOUNDARY LINE VACATION; AI~ ESTABLISHING AN FECTIVE DATE ~EREAS, the Plannine Commission and the City Council for the City of Port To~cnsend hav~ considered Street Vacation Application 910i-10, and following due notice have held oub!ic hearings uoon the application, and I,~EREAS, the City Council for the City of Port Townsend adooted its Findings of Fact and Conclusions on Ju!v 2, 1991, as amehded on July 16, 1991, now, therefore, TH~CIT~_,.COUNCIL OF THE CITY OF PORT TO~SEND DOES ORDAIN AS FOLLOWS: Section 1. That all of those portions of Landes Street, Ox- ford Street and Kuhn Street, lying between Blocks 3, 4, 5 and 6 of the Moore Place Addition to the City of Port Townsend, except the Southerly portion of Landes Street abutting Lot 6 of Block 6 and Lot 6 of Block 5, be and the same are here and hereby vacated. Section 2. That all of the interior lot lines of Blocks 3, ~, 5 and 6 of the Moore Place Addition to the City of Port To,m- send be and the same are hereby vacated. Section 3. That the West boundary lines of Blocks 3, 4 and 5 and the East boundary lines of Blocks 4, 5 and 6 of the Moore Place Addition to the City of Port Townsend be and the same are hereby vacated. Section &. The City of Port Townsend, for itself, its suc- cessors and assiEns, hereby reserves a 25-foot easenent for utili- ties together with the right to construct, install, maintain and ORDINANCE - 1 - operate the same, within those portions of Landes, Oxford and Kuhn Streets vacated by this Ordinance, said easement being 12~ feet on either side of the centerline of each of said streets. Section 5. That the street and boundary line vacations afore- mentioned are conditioned, however, upon the following: A. That all fees and comoensation required for the street vacation pursuant to Chapter 12 of the Port To~send Municipal Code first be paid before this Ordinance shall become effective. Section 6. That the aforementioned conditions shall first be satisfied, and uoon satisfaction of the same. this Ordinance may be published and thereupon a certified copy of.this Ordinance shall then be recorded by the City Clerk with the Jefferson County Aud- itor, at which time this Ordinance shall be effective. Section 7. That the street and boundary line vacations mro- vided for herein shall be cancelled and become automatically null and void one year from the date of passage of this Ordinance by the City Council, if said fees and compensation have not been oaid by the applicant within that time as set forth in Section 5.A. cf n~is Ordinance. Section 8. This Ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferson County Auditor as hereinabove set forth.
