AN ORDINANCE CREATING A NEW CHAPTER 2.78 OF THE PORT
TOWNSEND MUNICIPAL CODE REQUIRING FILING OF PUBLIC
DISCLOSURE COMMISSION ELECTION AND CAMPAIGN FINANCING
DISCLOSURE REPORTS FOR ELECTED OFFICIALS AND CANDIDATES
FOR ELECTIVE OFFICE LOCALLY WITH THE JEFFERSON COUNTY
AUDITOR AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, RCW Chapter 42.17 provides for the disclosure of
election campaign financing information for any individual for an
office where the constituency for the office encompasses a whole
county and contains more than five thousand registered voters as of
the date of the most recent general election in the district, and
WHEREAS, the City of Port Townsend, Washington does not
qualify as a district containing more than five thousand registered
voters under RCW 42.17 and is therefore an exempt political
subdivision under the provisions of RCW 42.17.030, and
WHEREAS, the provisions of RCW 42.17.405(3) allow any exempt
political subdivision to petition the Public Disclosure Commission
to make the reporting provisions of RCW 42.17 applicable to the
political subdivision, and
WHEREAS, the City Council of the City of Port Townsend desires
the Public Disclosure Commission to review the campaign financing
of the candidates for elective office in the City of Port Townsend
and to have such reports available locally at the office of the
Jefferson County Auditor, and
WHEREAS, the City Council has petitioned the Public Disclosure
Commission to issue an order requiring filing of election campaign
financing reports by a Resolution of the City Council adopted
concurrently with this ordinance and the City Council wishes this
ordinance to become effective at such time as an order of the
Public Disclosure Commission becomes effective for election
campaigns in the City of Port Townsend, Now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DO ORDAIN AS
FOLLOWS:
Section 1. Summary. This ordinance establishes a new Chapter 2.78
of the Port Townsend Municipal Code which requires elected
officials and candidates for elective office in the City of Port
Townsend to file Public Disclosure Commission campaign financing
reports locally with the Jefferson County Auditor at the same time
such reports are required to be filed with the Public Disclosure
Commission. The ordinance is to become effective five days after
publication, which will occur only after the Public Disclosure
Commission has issued an order removing the exemption for filing
such campaign financing reports pursuant to a petition of the City
Council of the City of Port Townsend. The petition to the Public
Disclosure Commission has been made through a concurrent Resolution
of the City Council voted on at the same time as this ordinance.
Section 2. A new Chapter 2.78 of the Port Townsend Municipal Code
is hereby established to read as follows:

County Auditor. All elected officials and candidates for elective
office for positions within the City of Port Townsend and political
committees formed to support or oppose candidates and/or ballot
propositions in the City of Port Townsend.shall file all campaign
finance reports required by the state Public Disclosure Commission,
including personal financial reports, with the office of the
Jefferson County Auditor at the same time such reports are to be
filed with the state Public Disclosure Commission.
Section 3. This ordinance shall take effect after its passage
approval and publication as provided by law, however, publication
shall not occur until after the state Public Disclosure Commission
has issued an order requiring filing of campaign financing reports
in the City of Port Townsend pursuant to the petition of the City
of Port Townsend made by companion Resolution to this ordinance and
approved on the same date as this ordinance.

Public Disclosure Ordinance

This memo relates to the effective date and publication of the local Public Disclosure
Ordinance passed by the City Council on Monday night. The Ordinance provides that publication
is to be delayed until after the Public Disclosure Commission has acted on the petition of the
City Council contained in the companion Resolution. The Ordinance will then become effective
five days after publication as provided by law.
I have had Ann and Katherine coordinate sending of the Resolution and Ordinance to the
Public Disclosure Commission under a cover letter from John Clise. When John receives a
response back from the PDC indicating they have acted .on the City's petition we can then
publish the Ordinance and it will become effective. I have asked Katherine to let you and me
know when John has received a response back from the PDC. I have also written Mary Gaboury
to let her know what is happening.

The members of the Public Disclosure Commission met on Tuesday, May 26, 1992, and passed
motion taking note of the petition received from the Port Townsend City Council (~~
..... ~ This completes action required to bring Port Townsend elections under the Public
Disclosure Law for campaign finance reporting purposes. For now until action is initiated from
within Port Townsend to rescind the petition, all candidates for public office in Port Townsend and
the proponents and opponents of ballot issues within Port Townsend must comply with the
campaign finance reporting provisions of chapter 42.17 RCW.
We will appreciate any assistance you can offer in making the candidate and the issue supporters
and opponents aware of their reporting obligations.
