Variance granted. 8 OLD BUSINESS ORDIANCE NO 1782 I AN ORDINANCE GRANTING TO UNION OIL COMPANY OF CALIFORNIA, A CALIFORNIA CORPORATION, AND ITS ASSIGNS, THE RIGHT TO CONSTRUCT, MAINTAIN, OPERATE AND REMOVE PIPE LINES ACROSS A STREET IN THE CITY OF PORT TOWNSEND, WASHINGTON, AND GRANTING TO OF CALIFORNIA, A CALIFORNIA'CORPORATION, AND ITS ASSIGNS, THE RIGHT TO OPERATE, MAINTAIN AND REMOVE A WHARF IN SAID CITY OF PORT TOWNSEND, IN RENEWAL OF RIGHTS GRANTED IN O~DIANCE NO. 1299. SAID UNION OIL COMPANY I The above ordiance was read for the first time. It was moved by Councilmen Klenk/Cipriote the first reading be considered the second and the third be by title only.. Roll Call: 7 Motion carried~ Councilmen Camfield/Shaneyfelt moved that the ordiance be now adopted. Roll Call: 7 yes. Motion carried. Ordiance adppted. that yes. At this time Mayor pro-tem Judy called for audience participation. James DeLeo Inq- uired as to what the City intends to do regarding the Fort Warden State Park fire protection fee. He suggested said fee should be in an amount to equal the wages of one full time fireman. 8 NEW BUSINESS Cleark-Treasurer McCoy announced that the bid call is being let to provide the City with liability insurance for the coming year. He stated that said bids will be openèd on May 17, 1977. The issue of ~cating certain streets on which the Jr. Highschool is located was referred to the Street CÐmmittee. éiãJ:)JOURNMENI' There being no further business to come before the council at this time, Councilmen Shaneyfelt/Parker moved that the meeting be now adjourned. Motion carried. Clerk-Treasurer McCoy presented to the Council a bill from Crown Zellerbach for improvements made to the Transmission Line. Said improvements are to be paid as follows: 5/7 by Crown Zellerbach, 2/7 by the City. The best source from which to make payment was discussed. Although money is available in the Water operating fund, the Council felt they would rather not spend said money if this payment could be made from the Transmission L~né Replacement Fund. The City Attorney was directed to determine whether this payment can be made from said Transmission Line Fund and to draft an emergency ordinance appropriating the proper amount to the 1977 budget. 8 --1!- ~,7,j- a d MINUTES OF THE REGULAR SESSION OF MAY 3, 1977, CONTINUED COMMUNICATIONS 8 A letter from the State of Washington Dep~rtment of Retirement Systems was presented to the Council. The letter asked whether the City would be willing to contribute $7,628.57 toward the recovery ,of service time of Thomas Edgingto"n. Said payment would provide for a retirement income for Mr. Edgington. Council discussed the cost apd lac~ of available funds. Councilmen Judy/Wilson moved that this request be denied. 'Motioycarried.' Mayor Steve made the following proclamations: The week of Nay 15-21 was declared -/ Rhododendron Festival Week. The week of May 8-15 was declared Nursing Home Week. I COMMITTEE REPORTS I Councilman Ciprioti reported that the Street Committe met on Friday, April 29, to consider the various proposals for",surveý and installation of monuments iri the City. (Hearing to be set under New Business). " Councilman Judy reported to the Mayor that property ownership around City Lake is still under investigation. PUBLIC HEARING 8 The application of Cecil and Luneta Thelen for a streei vacation' of Landes from 57th to 58th was presented to the Council for nearing. Mayor Steve opened said hearing by asking for comments from'propónents of the vacation.' Mrs. Lucile James, the adjoining property owner to said street, asked what restrictions would be imposed on' her if this street vacation is granted. She was told that the City would retain utility easements but that 'she could fence, pave or build on the vacated street. There was no further comment from the audience. Mayor'Steve turned the hearing over to the Council for discussion. The Planning Commission recommended to approve said request anquŒËtwas read. Councilmen Judy/Parker moved that the vaca'tion of Landes between 57th & 58th be approved. Motion passed. Vacation granted. Shortly thereafter, Councilman Ciprioti entered and requested the follo~Ting addition to the minutes under Committee reports: Ciprioti/Judy moved that the Planning Commission consider for vacation that portion of 6th Street between Sherman and Hendricks. Motion passed. ' COMMUNICATIONS A letter from W.J. Daly, Attorney for P.U.D. No.1, noting that the city has made only one payment on the well it is supposedly purchasing from said P.U.D. And stating that unless payment are brought up to date within 30 days of May 17, the P.U.D. will take further action. 8 Mayor Steve directed the City Attorney to brief the Council on said :Lssue. Abraham gave a complete history of the issue and recommended that nothing be done until the pending litigation is settled. Council agreed. A letter from Summit Communication reporting the status of their prò:iect to install cable television in Port Townsend. COMMITTEE REPORTS
