Abraham stated that the ,City .is responsible. It was noted that the animal control officer cannot be everywhere at onc'e but that special attention would be given to the port area. ~ Paul Gahr asked why meters are not placed on all streets in the business district. Mayor Steve mentioned that he and the Police Chief had been discussing the installation of more meters. Chief Doubek noted that off street parking should be ,provided for business people befo:t'e the entire downtown area is metered. PUBLIC HEARINGS I Public Hearings were set as follows: 136 - Stroeder alley v~cation - May 3 138 - Thelen street vacation - May 3 l40 - Minish variance - April 19 It Kas moved by Councilmen Camfield/Ciprioti to approve the above Public Hearing dates. MAYOR~~ (D ~ r - R-o - f e. r.. 8 MINUTES OF THE REGULAR SESSION OF APRIL 19, 1977 The City Couneil of the City of Port Townsend met in regular session this 19th day of April 1977 at 7:30 p.m. in the Council Chambers of City Hall, Dale Judy, Mayor pro-tem presiding. ROLL CALL Officers and members present were as follows: City Attorney Abraham, City Clerk=Treas-. urer McCoy and Councilmen Cipriote, Judy, Camfield, Parker, Wilson, Shaneyfelt and Klenk. Mayor I Steve was absent. ,I MINUTES It was moved by Councilmen Klenk/Camfield that the minutes of the previous session be approved as writtenaand to dispense with reading them. Motion carried. BILLS AND CLAIMS The following bills and claims were presented for payment: Current Expense Fund Water/Sewer $178.67 30.00 [t was moved by Councilmen Klenk/Camfield ~hat the bills and claims be paid. Motion carried. COMMITTEE REPORTS 8 C6uncilman Parker reported that he had met with Mr. Belarud, Manager of Fort Warden State ~ark, regarding the contract for fire protection between the City and said park. He noted that fne year remains on the existing contract but that Fire Chief Jones will attemp to assess the bost to the City for providing Fire protection at Fort Warden. I Engineer French reported that the P.U.D. committee met with 1:he Port Commission Monday, April 11 at 7:30 p.m. to discuss the Kah Tai Lagoon proposal submitted by said Port Commission. II He also commented that the Port Commission is going to Formally adopt said proposal development 2lan. ~ Engineer French reported that bids have b~en received to undertake the street Monument ~rogram but that he would recomment said bids be reviewed by the StreE!t Committee. Councilmen ¡Camfield/Klenk moved that the bids be submitted to said Stre,et Commit1:ee. Motion passed. I Attorney Abraham presented material relative to short plats 1:0 the Council. Couneilmen Camfield/Klenk moved that said material be referred to the Planning Commission. Motion passed. ¡ Councilman Judy reported that in researching property ownerships at City Lake it now appears that the City owns all adjacient property. I I PUBLIC HEARINGS The first public hearing to come before the Councit was that of Mr & Mrs Alan Minish fo~ a variance to the side yard set back requirement of the zoning ordiance. Said variance request ~as for property at the following location: Eisenbeis Addition Blk. 77 Lot 1 commonly known as Ql55 Wilson Street. Planning commission recommendation to gran variëlnce was read. Letters ~rom James DeLeo and Terry De Leo in opposition were read. The hearing was opened to the audience for comment. 8 Mrs. Minish stated that they we~e not aware their garage was built up to the property ~ine and they certainly would not have built it had they realized it was not within the law. ~r. James DeLeo spoke in oppos1tion to the variance stating that he is lien holder on the propert~ ~nvolved and that he feels the Council would be setting a, precident by allowing this zero set- back. There were no other participants from the audience. The 'hearing was turned over to the Council for debate and d~cission. Discussion followed relating 'to when the property was surveyed and whether notification was given by Terry DeLeo that his, property was being encrouched upon. He stated he did not give notice. Councilman Camfield argued about the applicability of the zoning ordiance to buildings other than residential structure. After considerable discussion councilmen Shaneyfelt/Klenk that the variance be granted. Roll ca+l: Klenk, Jddy, Camfield, Shaneyfelt in favor. Ciprioti, Parker & Wilson Opposed. Variance granted. OLD BUSINESS ORDIANCE NO 1782 AN ORDINANCE GRANTING TO UNION OIL COMPANY OF CALIFORNIA, A CALIFORNIA CORPORATION, AND ITS ASSIGNS, THE RIGHT TO CONSTRUCT, MAINTAIN, OPERATE AND REMOVE PIPE LINES ACROSS A STREET IN THE CITY OF PORT TOWNSEND, WASHINGTON, AND GRANTING TO OF CALIFORNIA, A CALIFORNIA CORPORATION, AND ITS ASSIGNS, THE RIGHT TO OPERATE, MAINTAIN AND REMOVE A WHARF IN SAID CITY OF PORT TOWNSEND, IN RENEWAL OF RIGHTS GRANTED IN O~DIANCE NO. 1299. SAID UNION OIL COMPANY 'I The above ordiance was read for the first time. It was moved by Councilmen Klenk/Cipriote that the first reading be considered the second and the third be by title only.. Roll Call: 7 yes. Motion carried~ Councilmen Camfield/Shaneyfelt moved that the ordiance be now adopted. Roll Call: 7 yes. Motion carried. Ordiance adppted. At this time Mayor pro-tem Judy called for audience participation. James DeLeo Inq- uired as to what the City intends to do regarding the Fort Warden State Park fire protection fee. He suggested said fee should be in an amount to equal the wages of one full time fireman. NEW BUSINESS Cleark-Treasurer McCoy announced that the bid call is being let to provide the City with liability insurance for the coming year. He stated that said bids will be openëd on May 17, 1977. The issue of ~cating certain streets on which the Jr. Highschool is located was referred to the Street C&mmittee. aã¡;)JOURNMENI' There being no further business to come before the council at this time, Councilmen Shaneyfelt/Parker moved that the meeting be now adjourned. Motion carried. Clerk-Treasurer McCoy presented to the Council a bill from Crown Zellerbach for improvements made to the Transmission Line. Said improvements are to be paid as follows: 5/7 by Crown Zellerbach, 2/7 by the City. The best source from which to make payment was discussed. Although money is available in the Water operating fund, the Council felt they would rather not spend said money if this payment could be made from the Transmission L~né Replacement Fund. The City Attorney was directed to determine whether this payment can be made from said Transmission Line Fund and to draft an emergency ordinance appropriating the proper amount to the 1977 budget.
