MINUTES OF THE REGULAR SESSION OF OCTOBER 16,1973

The City Council of the City of Port Townsend, met in regular session this 16th day of Oetober, 1973, at
7:30 P.M. in the Council Chambers of City Hall, Mayor Joseph B. Steve presiding.
ROLL CALL
Officers and members present were as follows: Mayor Steve, City Attorney Abraham, City Clerk Pedersen,
City Engineer French, and Councilmen Scheyer, Ciprioti, Judy, Rosbach, Sahli and Hufford. Councilman Camfield
was absent.
MINUTES OF THE PREVIOUS SESSION
It was moved by Councilman Judy, seconded by Councilman Scheyer, that the reading of the minutes of the
previous se~sion be dispensed with. Motion carried.
. COMMUNICATIONS
A letter ~rom the Library Board, signed by O.F. Kilham, Chairman was read in which he in:~ormed the Council
that it would no longer be necessary to consider the possible purchase of the property adjacent to the library
since Alaska Telephone withdTew their offer as of October 9,1973.
A letter from Police Chief Doubek was read in which he recommended converting 89 incande~¡ent lights to
mercury vapor lights. He explained there would be no increase in energy consumption and the price increase
would be 95~ a month per light. The Mayor referred this suggestion to the Light Committe for study and
recommendation.
An application for a condition use permit was presented from Sarah C. Locke and G.M. and Helen Smith to
operate a group home for 10 retarded children and 4 adults on lots 8 and 9, Block 35, Dundee Place Addition.
It was moved by Councilman Hufford, seconded by Councilman Sahli, that the request be referred to the Planning
Commission for recommendation.
COMMITTEE REPORTS
The Mayor informed the council that the City Engineer as compiled information on the cost of sewer lines
installed since 1963 and has drafted an application for a refund of part of this cost. The Mayor stated that
he has forwarded this application to the Department of Eco~ogy, Water Quality Management Section for additional
Federal participation in accordance with Public Law 92-500 Federal Water Pollution Control Act of 1970. It is
hoped that they will reimburse the city the partial cost of installation of these sewer lines.,
Councilman Rosbach reported on the ~rogress of the Cherry Street Park. He stated the Street Department is
going to do some more leveling and put top soil as grass can be planted where the playground equipment will be.
He said an area 105 feet by 105 feet is being set aside for a double tennis court for future development. He
said he is ordering some playgroun\equipment for the park that will cost approximately $l,286..
The City Attorney mentioned that perhaps the group home presented earlier may fall under the provision of
convalescent and nursing homes and homes for the care of children or the aged which are permitted in R-lll, R-ll
and R-l zones. It was decided to continue the request through the Planning Commission.
Councilman Judy stated that the city has surplus property near the equipment storage barn and suggested it
be sold. Councilman Hufford moved that the City Attorney be authorized to pursue the matter to declare the
North one-half of Block 60 in the Pettygrove's 2nd Addition to the city as surplus property, to have it appraised,
and put it up for sale. The motion was seconded by Councilman Judy and passed.
PUBLIC HEARINGS
The Mayor opened the public hearing on the request for an alley vacation from John A. and Gladys L. Murray
and James I. and Lillian Blankenship for that portion of alley between Kuhn and Haines Street~i south of 19th St.
in the Eisenbeis Addition. A letter from the Planning Commission was read recommending the vacation reserving
the usual utility easements. The Street Superintendent asked if reserving the utility easements means that the
owner may not build on the easement. He stated that in a couple of instances people have built over sewer and
water lines. The Attorney stated that the owner may do so, but he would be ill-advised to do so since the city
could require the owner to move a building in order to repair or install water and sewer line~;. The Mayor
suggested that the city engineer inspect the building permits to make sure that any building over vacated streets
and alleys does not go over the easements. As there was no comment from the audiance the Mayor closed the
hearing. It was moved by Councilman Judy, seconded by Councilman Scheyer that the alley vacation be approved.
Motion carried.
The Mayor opened the public hearing on the request from James A, Michael D, and Carl J. DeLeo for the
vacation of that portion of the alley in Block 33, Railroad Addition between Sims Way and Jefferson Streets. A
letter from the Planning Commission was read in which,they recommended the vacation reserving the usual utility
easements be granted. There was no comment from the public and the Mayor closed the hearing. It was moved by
,Councilman Judy, seconded by Councilman Scheyer that the vacation be granted. Motion carried.
The request for a variance from David Hero, who had a public hearing scheduled for this meeting, was post-
poned by the Mayor until after the Planning Commission has discussed it..
ADJOURNMENT
As there was no further business to come before the council as this time, it was moved ~r Councilman
Rosbach, seconded by Councilman Sahli that the meeting do now adjourn. Motion carried.
