After considerable discussion of ways and means, the Clerk was Instructed to write a letter to the owner requesting again that the house be torn down. BID OPENING The mayor called for the bids to be opened on the fire truck. There was only one bid,~rom the L.N. Curtis Company, in the amount of $59, 230.50, plus sales tax. A motion to hold the bid award over until the next meet- ing was made by Councilman Hufford, seconded by Councilman Scheyer. motion carried. PUBLIC HEARINCS The mayor opened the public hearing on the Amell variance request. A representative of the Amell's re- quested that the hearing be postponed until mrs. Amell returned from California. The Planning Commission had not made a recommendation on the request, due to lack of information, and reque~ted that it be referred back to tt1em so they could consider it when the applicant was present. A motion by Councilman Huffo~d, seconded by Councilman Sahli, that the matter be referred back to the Planning Commission carried. The mayor announced that mr. and mrs. Julius A. Pedersen had withdrawn their rezone request and asked that the public hearing be cancelled. OLD BUSINESS Public hearing dates were set for October 16th for the Hero request for an artist's studio in a residential area and the murray-Blankenship alley vacation. NEW BUSINESS Councilman Hufford reported that there was a traffic hazard created on the corner of F and Rose by the large trees. Street Superintendent Hawley volunteered to look into the matter. COMMUNICATIONS A letter from Russell H. Oliver of 5728 Kuhn Street was read in which he complained about the condition of the roads, in the vicinity of his home, the dust problel!1 caus~d by the road condition, traffic problems and' the control of weeds. He asked that appr?priate action be taken' to correct these problems~ . acquisition A letter was read from the Library ~01rd asking the'council to give them a décision about.th~/property located next to the Library. Mayor $teve directed the request be discussed under old busine~;s. A'letter was read from Cotton Corporation requesting the continuation of their street lease under the same terms and conditions which expired Septermber 30th, 1973. The Council will continue their public hearing on this until after the Planning Commission has held theirs. " ; I A letter was read from the Planning Commission regarding the request from David Hero for a conditional use permit at 933 Tyler. They returned the application to the Council without recommendation for a conditional use permit, as it was felt this requires a rezone or a~ amendment to the ordinance. Hr. Minor, Chairman of the Planning Commission stated that it was his understanding that Mr. Hero would like an amendment to the zoning ordinance to allow commercial ceramics as a conditional use in R areas. It was moved by Councilman Hufford, seconded by Councilman Sahli that the request be returned to the Planning Commission in the form of an, amendment to the zoning ordinance. Motion carried. í ¡ ) ¡ ! BID AWARD The Mayor brought before the Council the bid recieved for a new fire truck which had been opened at the previous meeting from L. N Curtis in the amount of $59,230.50, plus sales tax. It was moved by Councilman Rosbach, seconded by Councilman Judy that this bid be accepted. Motion carried. i ( PUBLIC HEARING I 8 Mayor Steve opened the public hearing on the request from Jack T. and Carolyn E.Frost for a conditional use permit to sell antiques in their home. This request was read again. A letter was read from the Planning Commission in which they said they were returning the request without recommendat:Lon since they felt the ordinance was amended to include antiques as a conditional use and the request goes beyond that and covers items they would not recommend as applicable under the present zoning ordinance. ~hey also requested the City Council to define the term antique in the new zon~ng ordinance amendment.. Much d:Lscussion followed about the difficulties in defining what consitutes an antique and enforcement problems involved. Councilman Camfield suggested the council grant a condition use permit to Mr. Frost under the same provisions as set forth in the condi~ional use permit previously granted to the Johnson's. Councilman Camfield moved that the hearing be postponed for two weeks and that ~~. Frost define under what conditions be wished to operate. It was seconded by Councilman Hufford. Councilman Camfield later withdrew this motion when Mr. Frost said he would be willing to operate under the same conditional uses as granted the Johnsons to sell antiques in an R zone. Councilman Camfield then moved that the request be granted with the same conditional uses as granted the Johnsons. It was seconded by Councilman Sahli and passed. OLD BUSINESS It was moved by Councilman Sahli, seconded by Councilman Rosbach, that a public hearing date of October 16th be set for the alley vacation request from the DeLeo's. Motion carried. . The following ordinance was presented to the Council and read for the first time: ORDINANCE NO. 1689 AN ORDINANCE AUTHORIZING TKE MAYOR TO ENTER INTO THE PURCHASE OF REAL PROPERTY FOR AN ADDITION TO THE PUBLIC WORKS BUILDING PROPERTY OF THE CITY. 8 It was moved by Councilman Judy, seconded by Councilman Rosbach that the first reading be considered -the second and the third be by title only. Roll call was six yeas and the motion carried. Ordinance No. l689 was read again for the third time by title only. It was moved by Councilman Camfield, seconded by Councilman Ciprioti that the ordinance now be adopted. Roll call was six yeas and the ordinance was adopted. The following resolution was presented to the Council and read in full: I RESOLUTION NO. 73-5 A RESOLUTION AUTHORIZING THE TRANSFER OF THE SUM OF $150.00 FROM .({EPAIRS AND MAINTENANCE TO CAPITAL OUTLAY IN THE 1973 BUDGET OF THE FIRE DEPAHTMENT, AND AUTHORIZING THE PURCHASE OF A RADIO RECEIVER BY THE FIRE DEPARTME~T, AND FURTHER AUTHORIZING THE EXCHANGE OF SAID RADIO RECEIVER FOR THREE USED RADIO RECEIVERS OF THE POLICE DEPARTMENT. It was moved by Councilman Camfield, seconded by Councilman Judy that the resolution be adopted. Mòtion carried. Mayor Steve asked the City Council to approve the appointment of Jack Fuller as the Clerk-Treasurer of Port Townsend, effective January 1,1974. It was moved by Councilman Camfield se~onded by Councilman Sahli that t1r. Jack Fuller's appointment be approved by the council. Motion carried.
