The City Council of the City of Port Townsend met in regular session this 19th day of gecember 1972, at 7:30 p.
in the council chambers of the City Hall. Mayor Stevé presiqíng.
ROLL CALL
Officers and members present were as follows: Mayor Steve, City Attorney Abraham, City Clerk, Youngblood,
Councilmen, Judy, Camfield, Rosbach, Sahli, Hufford. Councilmen Scheyër, Hoglund, absent.
MINUTES OF THE STATUTORY BUDGET SESSION
I
It was moved by Councilman Camfield, seconded by Councilman Judy, that the minutes of the Statutory Budget
Session be dispensed with. Motion carried.
MINUTES OF THE LAST REGULAR SESSION
It was moved by Councilman Camfield, seconded by Councilman Judy, that the minutes of the last regular session
be dispensed with. Motion carried.
CO~~ITTEE REPORTS
I
Mayòr Steve said he would like a motion from the council about the street lights, he said that Puget Power would
like a letter authorizing them to remove the excess old type street lights. Councilman Sahli made a motion secondetl
by Councilman Hufford that the Pgget Power be authorized to remove the excess in between old street lights, providi~g
it did not leave an ar~ unlighted. Motion carried.
Mayor Steve said he would like to have'a decision tonight on some equipment, a Fire Truck and a Garbage Truck,
he mentioned it woÚld take around three months to acquire a disposal truck and maybe a year for a fire truck, he
said he would bring up again later in the meeting for action on the equipment.

Engineer French reported on the well at Hadlock, saying that the pump was working, water samples had been taken,
expected a report back from the State on Wedenesday, and on fhursday there would be a final review. He said that
Sunday moring at 8:00 ammo the water would be shut off to both Hadlock and the City and the 20" line would be cut out
and the 30" line would be installed, the line wonld be shut down around six hours.

Mayor Steve called upon Mr Daren Johnson, Chief Engineer for the Washington State Parks Recreation Commission
to speak before the council. Mr Johnson said he was responsible for -the development of the campground, restrooms
and etc at Fort Worden and that it was near the stage for advertising but found out that the state was at issue
with the city on using plastic pipe and askêd if the city would grant a waiver so that plastic pipe could be used.
Attorney Abraham said that the city could not grant a waiver to the state; if the council so desired they would
have to amend the ordinance. Water & Sewer Supt. Hawley spoke against using plastic pipe, Councilman Sahli spoke
in favor of plastic pipe. Ifter considerable discussion,.(,the council went along with the recommendation of Councilm~n;;
Judy that the Engineer and Sewer Supt. Hawley investigate:"areas where pIastre E presently in use and have a report
at the next regular session. It was brought up about the $75.00 hookup fee, no actioh was taken by the council on
the fee charge at this time.

OLD BUSINESS
The City Clerk brought upon the floor three emergency ordinance, that due to their nature had to be held over
until this regular session. The three Emergency ðrdinance were duly recorded in the minutes of the previous session.
ORDINANCE NO. 166)
It was moved by Councilman Camfield seconded by Councilman Judy that the first reading of Ord. 'No. 1663 be
consideredthe second reading and the third reading be by title only. Motion carried. Ordinance No. 1663 was again
read for the third time by title only, and it was moved by Councilman Hufford secondedby Councilman Sahli, that Ord.
No. 1663 be now adopted. Motion carried.
ORDINANCE NO. 1664

It was moved by Councilman Camfield seconded by Councilman Judy that the first reading.~of Ord. No. 1664 be
considered the second reading and the third reading be by title only; Motion carried. Ord. No. 1664 was again
read for the third time by title only and it was moved by Councilman Judy seconded by Councilman Rosbach that Ord.
No. 1664 be now adopted. Motion carried.
ORDINANCE NO. 1665

It was movèd by Councilman Camfield seconded by Councilman Judy that the first reading of Ord. No. 1665 be
considered the second reading and the third reading be by title only. Motion carried. Ordinance No. 1665 was again
read for the third time by title only, and it was moved by Councilman Judy seconded by Councilman Hufford that Ord.
No. 1665 be now adopted. Motion carried.
Mayor Steve said he had three Union Contracts, In the Fire Fighters Contract there were three additions, a wage
increase, sick leave, and call back time. The Police and Non-Uniformemployees, the contracts called for increase
in wages and one fringe benefit that was added, otherwise the same as 1972. If said if there was no objection from
the council he would sign the three union contracts. There was no objection.

Mayor Steve Brought back on the floor the purchase of a garbage truck and a fire truck'from the Federal Revenue
Sharing Funds, and again urged the council to purchase the equipment that he had recommended. Councilman Sahli
made a motion seconded by ßouncilman Rosbach that the paper work be- started to acQuire the two pieces of equrpment.
uoon the question, Councilman Camfield said he hated to do anything unless the finance chairman was present.
Councilman Judy said he didnt feel like earmarking the money at this time, he would like to know where the money
was comming from to cover the reservoir. Engineer French explained that the state: has announced the reservoir must
be covered by July 1,1973, and the city must decide upon the type of covering and then acquire a cost estimate.
Councilman Hafford said that he believed that the amount of care with which the fE:deral money is spent will largely
determine the ~ount of additional money rec~ived in the future. The City Clerk mentioned that the required forms
on which the city would disclose its intended use of the funds had not been received as of yet but should have the
forms 'by the end of the year. After some discussion, Councilman Sahli withdrew his motion, Cogncilman Rosbach
withdrew his second.
Attorney Abraham said he felt that each department head should submit their nef~ds to their committee chairman,
so that the council could see just what equipment was needed.
Garbage Supt. Perkins spoke before the council on why his need for a garbage truck and Fire Chief Jones also
spoke on why his need for a fire truck. After some further discussion, Mayor Steve said that he would bring the
subject up again at the next regular session.

PETITION FOR STREET VACATION
The following Petition for street vacation was presented and acted upon as follows:

TO: HAYOR AND CITY COUNCIL OF THE CITY OF PORT 'IOWNSEND
FROM: JAMES A., MICHAEL D., AND CARL J. DELEO, D/B/A DELEO BROTHERS, A PARTNERSHIP,
SUBJECT: VACATION OF STREET, HASTINGS 2nd ADDITION.
1. The writers hereby petition to have that portion of Morrison Street vacated lying between Washington and
Jefferson Streets in Hastings 2nd Addition.
2. The writers certify that they are the sole owners of Block 168 and that portion of Block 72 which includes
Lots 5,6,7, & 8.
3. In 1919, a steam plant was built on this street, followed by the actual fill of the street in 1929. In
addition to the steam plant building, there is a residence and a power distribution platform on the area which
is the street. This vacation is requested to ~aintain the continuity that exists in the immediate industrial area
and to provide for future expansion of facilities.

PETITION FOR STREET VACATION

TO fHE CITY COUNCIL OF THE CITY OF PORT TO~SEND, WASHINGTON:
Comes now the undersigned petitioners and, pursuant to RCW Chapter 35.79, respectfully show:
1. The undersigned petitioners request that the following described streets and alleys in the City of Port
Port Tow send be vacated pursuant to RCW 35.79:
a. All unvacated streets and alleys in Cowels Addition, Fairmont Addition, McBride's Addition and Gotts-
tein's Addition to the City of Port Townsend, Washington, and all streets adjoining said additions, except for
39th Street, for which no vacati~n is sought.
b. All unvacated streets and alleys, in and adjoining Lewis & Spitz Addition and Langert's Addition to the
City of Port Townsend, Washington.

2. Each of the undersigned petitiners is the owner of an interest in real estate abutting on the above described
area nd this petition is signed by the owners of more than two-thirds of the property abutting upon the subject
streets and alleys sought to be vacated.
Petitioners do not own one lot therein, namely, Lot 1 of Block 3 of John G. McBride's Addition to the City
of Port Townsend, which lot is claimed by one Janette Crown of 4809 Yard Blvd., Los Angeles, California 90042.
To the best beliefs of the petitioners, Dickerson, said Janette Drown has no clear title to the aforesaid block.
Said person should and shall receive notice of this petitio~.

Mayor Steve referred the Petition
to the Planning Commission.
Attorney Abraham recommended that the Planning Commission and also the council take a serious look at the
above Petition due to the large platted area.

Mayor Steve announced that two members of the Planning Commission, Mr Harry Deits and Chairman Kay Miner were
retiring at the end of the month and asked for recommendations from the Council.
ORDINANCE NO. 1666
AN ORDINANCE APPROPRIATING THE SUM OF ONE
THOUSAND DOLLARS TO THE SEWER DEPARTMENT FOR
ELECTRICITY AND SEWER LINE IMPROVEMENTS, AND
DECLARING AN EMERGENCY.

Due to the nature of the above Ordinance, it had to be held over until the next regular session.
Attorney Abraham explained to t~Q;,cOUDcil and other elective officials, some of the requirements of State
Initiative 276 which was approved by the voters in the November election. He said that all elected officials are
required to file by Jan. 31st a statement of a number of things such as bank accounts, stoc~s, life insurance,
property holdings and etc. He mentioned that if any official ~ted to resigne, it had to be done before January
¡st. He said he would have the clerk to copy for each official an analysis of the section in Iniatiative 276,
also there would be a suggested form that could be used just in case they did not send out forms to use.
Abraham said he could not advise other officials how to answer the questions specified or otherwise react to the
new law. However, he did call attention to suggested responses suggested by officials elsewhere who co~sider
the requirements an unconstitutional intrusion into their private affairs.

As there was no further business to come before the council at this time, it was moved by Councilman Camfield
seconded by Councilman Rosbach that the meeting do now adjourn. Motio arried.
