Mayor Steve presiding.' 8 ROLL CALL I, Officers and members present were as follows: , Mayor Steve, City Attorney Abraham, City Clerk Youngblood, Counon men Scheyer, Hoglund, Judy, Camfield, Sahli, Hufford. Mayor Steve called for nominations for councilman to fill the unexpired term left vacant by Mayor Steve. Council ,man Hufford wwe a motion seconded by Councilman Hoglund to nominate tor councilman:Mr Donald Rosbach for the un- iI expired twoY'term left vacant by former councilman Mayor Steve. Mayor Steve called for further nominatiûn1s, hearin ~: none. Motion was carried. 'I , MINUTES OFTHE PREVIOUS SESSION It was moved by Councilman Camfield, secorrled by Councilman Hufford that the minutes of the previous session be ¡' dispensed with. Motion carried. I Ma)¡or Steve as long as we have a new councilman now, he would relocate the following committees. Finance: Hoglund, Hufford, Rosbach; Water: Judy, 6amfield, Sahli. Street &: Sewer: Hufford, Juciy, Hoglund.. Police & License: Camfield, Hufford, Hoglund. Building &: Garpge: Sahli, Scheyer, Judy. Fire &: Light: Scheyer, . Rosbach, Camfield. Legislation: Rosbach, Scheyer, Sahli. - Mayor Steve commented on the revised code of Washington, 1971 Supplement chapter 35.79.030 about street vacatio Mayor SU .ve read the following: The legislative a\1thority determins to grant said petition or any ~rt thereof., suc city or town shall be authorized and have authority by ordinance to vacate such street,. or alley, or al17 part there f and the ordinance may provide that it shall not become effective until the owners of property abutting upon the street or alley or part therof so vacated, shall collplnsate such. city or town in an a8ilOunt which does not exceed one-half the appraised value of the area so vacated. Attorney Abraham said it i1s the same thing that was talked about before, the city of Seattle followed. that practi at . a petitioner in Seattle challenged them, took it to the supreme court and. won, that it was unconstitutional. He . said there were many Attorneys over the state think it is unconstitutional and he also thought so. He said if the council wants to set up the machinery to do that, then all he could do would be to advise in his itpinion that it wa 'unconstitutional and go ahead and do it. -- Chief of Police Doubek said he had a couple M requests, it would take council approval, number one was to make a change in parking between Washington and Water Street, number two would be to repeal the ordinance that set up the bus zone in front of the Delmonico. Mayor Steve the request would be brought up later in the meeting. Councilman Hufford reported for the Street Committee, saying they had met with Mr. Hawley in connection with th. "half cent gas tax, aOO it was agreed that part of it should be used- on Lawrence Street from Walker to Ieamey and: .. also to oil on SanJuan, Hastings and old Discovery Road. Mayor Steve said he would bring it up later in the meeting. Councilman Scheyer said there was a request for a street light at 10th &: Sheridan, which he investigated, a , 20,000 lum light was at 9th & Sheridan, a 7,000 lum was on 11th Ii Sheridan, he mentioned that therE} was very few :.lights on Discovery Bay Road, he would check it out and bring back an recommendation. .¡ I Mayor Steve recessed the meeting to have an Insurance Salesman talk to the council. The salesman said that he had eleven from city employees signed up wmbh included one from Jefferson County, to be able to get Qds insuranc ,¡ it had to be pay roll deduction. Councilman Hoglund question the salesman on different i teas of thehsuranee, ! Councilman Hufford spoke against it being pay-roll deduction. After some rurther discussion, Mayor at.- closed th recess and went into regular session. Mayor S~ve said he had a coD1Jllunication from the Planning Commission and it pertainedtto the Sub-division Ordi after reading it over, on final plat reauirements, he could not rind where it would be a 1"eCO8lendation to the city ,council for approval, all he could find was that the planning :coømission would ,approve and the Mayor and City Clerk 'Will sign, he said he didnt b~ that, he felt the fJlånning CoDlll1sion should ~.nIfT Md and the co6ncil shottld appro , Councilman HogluOO said that he agreed with the Mayor, it was just ,another exuple or creating gOYerl1llient by ,bureau, the council should be held accountable in matters of this nature. Mayor Steve said this would be brought u again at the next regular session. . I ': . Mayor Steve read a letter from the Board of Certification, for the State of Washington, of tbj Pacific Northwelft ~ollution Control Association. It announced a certificate of conpetency for Peter Sotie,. city sewer tmtment, plant ~perator. The letter announced that Sofie has been certit1ed at Grade 4, qualifying for this higher rating on the !basis of written examination and additional experience. It also COJllftended his dedicated interest in his work. The following Ordinances were presented and acted upon as follows: ""8 ORDINANCE NO. Motion carried. Ii " 'I I, 1 ORDINANCE NO. 163~ AN ORDINANCE REPEALING ORDINANCE NO. 1395. , Attorney Abraham explained that Ord. No. 1395 was for a bus zone that had been created by the council and it' ': would take council action to repeal it, the bus zone was in front of the DelMonico on Water Street. It was moved Ii I: by Councilman Judy seconded by C~uncilman Scheyer that the first reading be considered the second reading and the !¡ third reading be by title only. Motion carried. ,I Ordinance No. 1638 was again read for the third time by title only and it was moved by Cpuncilman Camfield seconded by Councilman Judy that Ordinance No. 1638 be adopted. Motion carried. ORDINANCE NO. 1619 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO. 1490, AS PREVIOUSLY AMENDED BY SECTION 1 OF ORDINANCE NO. 1531, regulating parking. I t was moved by Councilman Camfield seconded by Councilman Hufford that the first reading be considered the " second reading and the third reading be by title only. Motion carried. !; Ordinance No. 1639 was again read for the third time by title only and it was ~pved by Councilman Judy seconded;1 by Councilman Camfield that Ord. No. 1639 be adopted. Motion carried. " i I, RESOLUTION 72-4 A RESOLUTION AUTHORIZING PAYROLL DEDUCTION OF INSURANCE PREMIUMS FOR COLONIAL INSURANCE COMPANY PREMIUMS FROM CITY EMPLOYEE PAY WARRANTS. It was moved by Councilman Judy seconded by Councilman Scheyer Upon the question, Councilman Scheyer, Camfield, Hoglund spoke Hufford spoke against. Upon-~Roll call vote, Councilman Scheyer, yae, Councilman Hufford voted nae. Motion carrièd. Councilman Judy made a motion seconded i' :' by Councilman Scheyer that a light be installed at 10th & Hill. Motion carried. ! ¡: Mayo~tStavebrought back on the floor the half cent gas projects, after some discussion, it was moved by I~ Councilman Judy seconded by Councilman Hufford that the projects for the half cent gas tax be authorized. Motion if It carried. ': II ,: : Mayor Steve said he had received a call from Mrs Meyers in Olympia, on the twenty-thousand grant, upon which ¡! Eng. French said he had read the proposal to Mrs Meyers over the phone, she said it sounded good, but would have Ii : to get the approval of her associates and asked for a copy of the proposal. Mayor Steve said he would have to ;1 mark time on the interest free money.
