It was moved by Councilman Hoglund seconded by Councilman Scheyer that Resolution 71-11 be
now adopted. Motion carried.
Mayor Smith informed the Council that the Public Budget hearing would be on the 1st day of
December and had to be completed by the third day of December. Mayor Smith also said that the
Preliminary Budget w,-u Id be available to the public on the 19th of November.
Finance Chairman Don Hoglund called a meeting of council members for November 23rd for the purpose
of discussing personnel matters in the preliminary budget.
Mayor Smith again announced the meeting being held at Port Angeles on the 9th of November by
Wash ngton State Cities, and asked all to attend if' possible.

The City Council of the City of' Port Townsend, met in regular session this 16th d~~ of Nov.
1971, at 7:30 p.m. in the Council Chambers of' the City Hall. Mayor Smith presiding.
ROLL CALL
Off'icers and members present were as follows: Mayor Smith, City Attorney Abraham, City Clerk
Youngblood, Councilmen Scheyer, Hoglund, Judy, Camfield, Steve, Lindsey, Norwood.
MINUTES OF THE PREVIOUS SESSION
It was moved by Councilman Hoglund seconded by Councilman Judy that the minutes of the prèvious
session be dispensed with. Motion carried.
COMJITTTEE REPORTS
Councilman Judy reported for the water committee, saying that they had met with Crown Zellerbach
on the plan to enlarge the water nlain through Woodmans Gultch f'rom a twenty four inch line to a
thirty inch line. He said that Crown Z. WAS in f'avor of' tile project and would give the project'
all the cooperation possible. Councilman Judy said that there would be an increase of around
two million gallons of' water, around 600,000 gallons would be allocated to the city and the
remainder would be available for possible industrial expansion at the local mill. He said that
the City Attorney had contacted the trustee about the balance of money in the construction fund
and had received their approval, the amount in the construction f'und was around 124,000. and the
estimate figure at this time f'or the project would be around 106,000.
Councilman Judy said at this time he would like to make a motion for council approval to use
the construct Lon f'und monies to increase the size of tho line 'at Woodmans Gultch. Councilman
Norwood seconded ßhe motion. After some further discussion, Mayor Smith called for a vote,
Motion WaS carried.
Mayor Smith said that he would get together with the City Engineer and start the wheels rollin8.
OLD BUSINESS
PUBLIC HEARING
Mayor Smith said that under old business we have a ublic Hearing scheduled at this time, and
asked the City Clerk to again read the subjec f'or the public hearing.

Pcdersone Oil Inc. requests your consideration for a Zoning Variance in regards to our property
located between Sims Wa y, Gaines street and Water Street.
A variance is necessary as our location was not Zoned as an M-l1 bu a R-111. At this time we would
like to apply for a variance in order to add another bulk storage tank. This tank would be used
for the storage of Propane Gas, it would be an 18,000 gallon tank mounted horrizontaly above
gro nd as indicated in the diagram. Both the tank and the installation would meet any and all
fire, saf'ety and use regulations.
I have reviewed our re~uest with the City Engineer who is fully cognizant with all requirements
and regulations concerning such an installation. Our bulv plant, like nearly all others is in a
non-conforming situation consequently any changes or additions require your approval.
At the :¡:r esent time Propane is not distributed from a source eiti:er in our City or in Jefferson
County, but f'rom either Sequim or Port Angeles. Our installation will not be competitive with
any operation located in this City.
Tangible benef'i ts to the City will be in the f'orm of' increased rev ,mue s derived from both B&O and
sales taxes generated by the operation of' this business. A f'urther benef'it would be the hoped for.
growth of this business necessitating a driver and service man which would provide employment f'or two
more persons in øur city. To the people living in our trade area this woûld provide a much closer
source f'or their needs than is presently available. It is incomprehensible that such service
is not offered in our area at present but with your approval of' our variance request we would
begin installation immediately.
Enclosed you will f'ind a diagram showing location f'or the new tank. Please contact us if you
have any questions in this matter.

Mayor Smith asked if any member of the public ddesired to make a statement concerning the
requested variance.- Mayor Smith said that in the absence of no comment from the public he
would refer the request to the regular order of' business.
Mayor Smith commented that he was glad to see things of' this nature come up, bebanse it points
up to situations where we have learned what type of boundaries have to be settled and revised.
Councilman Steve said that this is one instant where M-l should have run through along Sims
way instead of it being R-Ill.
Mayor Smith asked the City Clerk to read a letter that had been received from the Planning
Commission on the request.

At the regular meeting of the Port Townsend Planning Commission, the CommissioneÐs considered
and discussed the request by 1w. Jeff Pedersen, for a Zoning Variance at his property located
between Sims Way, Gaines Street and Water Street.
This Commis s ion finds the reques t by Mr. Pedersen for the cons true t ion of a low pres sure gas
bulk plant consistent with the existing land use and the intent of' the Zoning Ordinance.
It was our understanding, at the time we reviewed the recommended Zoning Ordinance, that the
boundaries of' the draf't of the Official Zoning Map reflected existing land use, but in this
particular instance it does not.

Attorney Abraham said that it occured to him that the primary problem here is that we have
a non-conforming use, we should not be discussing variance and we cant discuss rezone becaue
for necessary rezoning procedures have not been accomplished. 'However Section 5.06 of the
zoning ordinance states that any part of abuilding, structure, or land occupied by a non-
conforming use may be changed to a use which is of the same or of a more restricted nature; but-
where the use of' a non-conforming building, structure, or land is hereafter changed to a more
restricted classification, it shall not thereafter be changed to a use of a less restricted
classification.
Att'orneyAbraham said if that was all there was to it, it did appear that a variance could be
grandied, - although, as said, a variance is not the right approche to this particular question,
under sec tion 5.10 referring to maintenance, in that see tion i t' say~;, A non-conforming building
or structure may be repaired and maintained as provided in and is limited by this section. The
maintenance of such building or structure shall ihclude,50nly necessary repairs and incidentàl
alterations, which alterations, however, shall not extend the extent or degree of non-conformitw
of' such building or structure, provided tha~ necessary alterations nmy be made required by I
other law or ordinance.
Attorney Abraham said he must say, it would appear to be that 5.10 would be in conflict with I
5.06, it would appear to him that the requested permit which has to do with a propane tank I;
would be permissible under section 5.06, he said he felt that because of the procedural aspect, the best action
the council could take would be to deny the vaiance and change it to a use permit which is the same and more
restricted under ~ection 5.06 and then the building official is at liberty to issue a permit upon his findings
that the structure is,sound.
It was moved by Councilman Camfield seconded by Councilman Scheyer that the variance be denied and the
and the request be changed under Section 5.06 which states, Change of Use. Any part of a building, structure
or land occupied by a non-conforming use may be changed to a use which is of the same or o~ a more restricted
naj;u:te; but where the use of a non-conforming building, structure, or land is hereafter changed to a more
r~stricted classification, it shall not thereafter be changed to a use of a less restricted classification.
Motion Carried.
NEW BUSINBSS
Under new business the City Clerk brought upon the floor the following request.
From Trooper J.L. Walterscheidt, Washington State Patrol, Port Townsend,
Nov. 12,1971, to-wit:

I request a mercury-vapor light be installed on the corner of 22nd and Kuhn St. in place of the old style light
bulb.
The area is extremely dark and I park my State Patrol vehicle in my driveway. At night a flood light is turned
on above the drive, but this lights a limited area and leaves the surrounding area quite dark.
Please realize that my State Patrol car is, in essence, public property and theft. from and vandalism to police
cars is becoming commonplace. A vandalized Patnol car could conceivably could cost some person his life.
Installation of a light as requested is a necessary and worthwhile step to the preservation of public safety.

Again under new business the City Clerk presented the follo~~ng request for variance.
REQUEST FOR VARIANCE
TO THE HONORABLE BOARD OF ADJUSTMENT OF THE CITY OF PORT TOWNSEND:
The Medical Building, a partnership consisting of Doctors H.G. Plut, Bruce Bryåges, W.J. Scheyer, and Roger
Dickerson, Alton Ross, here and hereby requests that a variance from the provisions of Ordinance No. 1625 of
said City be granted in that petitioners be permitted to construct a building within one foot of the back line
of the property herein described, and that requirements for parking spaces adjoining said property be waived.
This application is made in connection with remodeling of- a building located on Lots 5 and 7 in Block )8 of
the Original To~msite to the City of Port Townsend.

The following resolution was presented and acted upon as follows:
A RESOLUTION AUTHORIZING THE TRANSFER OF THE SUM OF
FORTY DOLLARS FROM THE FILM RENTAL, ONE HUNDRED TWENTY-
FIVE '.DOLElffiS FROM BUILDING MATERIALS AND FOUR HUNDRED
DOLLARS FROM BUILDING REPAIRS TO CAPITAL OUTLAY, AND
TRANSFERRING THE SUM OF FORTY-THREE and 99/100 DOLLARS
TO TRA~ EXPENSE FROM BUILDING REPAIRS IN THE 1971
budget of the port townsend library fund.

THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DOES HEREBY RESOLVE:
"
There is here and hereby transferred from the Film Rental Fund the sum of Forty Dollars, from the Building
Materials Fund the sum of One Hundred Twenty-five Dolíars, and from the Building Repair Fund the sum of Four
Hundred Dollars, to the Capital Outlay Fund; and there is further transferred from the Building Repair Fund to
the Travel Expense Fund the sum of Forty-three and 99/100 Dollarš, all being in the 1971 budget of the Port
Townsena Library.
The Mayor and City Clerk are authorized to draw warrants accordingly.
Passed this 16th day of November, 1971.

After some discussion it was moved by Councilman Hoglund seconded by Councilman Judy that R~solution No. 71-12
be adopted. Motion carried.
Mayor smith announced that under the Shore Line and Protection Act which was passed last YEiar, there is a
- section saying that local government bodies are directed with the regards to the shorlines to the state and
. their various jursidictions to submit to the director of the department withing six months from effective date
which is the 1st of December of this year, a letter stating that they propose to complete an inventory in the
development of a master program of these shorelines. He said that his is part of a long dræin out procedure, he
stated that about all that could be done is to tell them that we intend to develop a'master program and handle it
ourselves.

Mayor Smith announced that as a matter of record the preliminary budget for 1972 had been turned into the
City Clerk and that copies would be available to the public on the 19th of November.
Councilman Hoglund announced that there would be a meeting of the council at his place of business, the time
would be at eight in the evening, and ,the discussion would be personel and salaries.
Mayor Smity said that there were a couple of federal programs by which the city can håve some people to work,
cost~ng is very little and that if you happen to see some strange faces working around do not be surprised.

December 1, 1971
The City Council of the City of Port Townsend, Washington, met in Statutory Budget Sesstion this 1st day of
December 1971, in the Council Chambers of the City Hall. mayor Smith presiding.

Councilmen Scheyer, Hoglund, Judy, Camfield, Steve, Lindsey, Norwood.
BUDGET SESSION
mayor Smith announced that the purposedof the meeting was for the consideration of the budget of the City of
Port Townsend as required by statute. mayor Smith stated a 5.5% wage increase for employee's could be made
under Phase. II of ßresident Nixon's economic plan but his preliminary budget shows no salary increases since
Phase I was still in effect when this budget was made. He stated that the City has informally made an offer
to, the unions involved of a 5% wage increase for Teamster members which would go toward medical coverage and
anything remaining would be applied to the salaries. This is on an informal basis and to his knowledge had
not been accepted yet.
