MINUTES OF THE PREVIOUS SESSION

It was moved by Councilman Hoglund seconded by Councilman Judy thBt the minutes of the
previous session be dispensed with. Motion carried.

It was moved by Councilman Hog¡und seconded by Councilman Lindsey that the bills & claims be
approved as read and that the Mayor and City Clerk draw warrants upon the propa r funds for
payment of same. Motion carried.

Gentlemen:

It appears that at th.e City Council Meeting of May 4th, the impression was created in the course
of debate on the subject of thé application of Mobil' Oil for a stre(~t lease, that I questioned
the integrity of Jeff Pedersen. As a matter of fact, I neither said nor intended to say that
Mr. Pedersen was dishonest. If through a poor choice of words I cr'9ated' the imptess ion that I
thought Mr. Pedersen dishonest, I should like to set the rëcord straight., I believe Jeff
Pedersen to be'an honest man, and any remarks made by me in debate should not be considered to
indicate otherwise.
I am concerned that the foregoing remarks might be thought to be made in fear of some civil
action being brought agains~ me in the absence of an apology. Such is not the case. I am
advised by the City ~ttorney and the Attorney for the Municipal Research and Services Center ¡
that a councilman enjoys a qualified privilege in debate," and that the specific words used by
me appear not to be actionable. I want it to be very clear to my fellQw councilmen and the
public that I do not subscribe to any limitations on free and fair debate afan issue brought
before the Council.
My;sole and only motive is to correct an impression which has apparently been erroneously
cre,ated. I have no wish to wrongly label anyone as "dishonest". Particularly, I certainly do
not wish to so label Jeff Pedersen.

After some discussion on the bids, Mayor Smith asked the City Engineer and the Street Supt.
to take the bids and check them for any errors and then report back with their recommendation.
Mayor Smith said that the first reading of the zoning ordinance WaS at the last regular meeting
and had been placed on the agenda for the second reading tonight.
Councilman Norwood s*id she would like to recommend that the ordinance be tabled until the
budget is discussed and would recommend the city engineer or who ever the building inspector
is going to be, to submit a preliminary bud~ on the cost, she said she felt it was not a good
idea to pass an ordinance when we dont have the money to enforce or any provisions to enforce.
She said if the council would not go along with that, then she had one minor change she would
like to make in the ordinance, she would like to seedeleted in Chapter six Section 6ß4 under
Adminstration the part where it says (Non-conforming uses of land and non-conforming buildings
for which no certificate of occupancy has been issued within the year provide~ for herein, shall
be conclusively presumed in violation of this Ordinance and may be abated as provided herein.)
Cœuncilman Norwood statèdj the reason she would like to have that deleted, that particular
paragraph states that the building inspector can make his best efforts to notify non-conforming
users and inform them they must apply for said certificate and his failure to do so shall not
excuse the property ovmer from securing said certificate. She said she was afraid that we may
have some non-conforming users who are not aware that they are non-conforming users, a year
might go by and they would lose their right to use this building under the non-conforming use,
and would not like to see that happen.
City Attorney Abraham reminded the council that changes could be made prior to final adoption
by amendment so long as it didnt affect the title.
Councilman steve said there were a couple more amendments, first on page 3-2, at the top of
the page after single family resindential R-1A change the word exclusively to the word primarily
and also on page 3-2 after the paragraph on community commercial C-lll, add the following,
partialy use as apartments gives the permited use.
Councilman Lindsey said the only thing he could see, is the ordinance looked a lot better tham
it did, but still thought we should know where we are gomngto get the money for enforcement.
Attorney Abraham suggested that the second reading be by title only tonight. Councilman Steve
made a motion seconded by Councilman Judy that the zoning ordinance be read for the second time
by title only. Motion carrie..
The City Clerk read the zoning ordinance for the second time by title only.
Councilman Steve said he hoped between this reading and the last reading and when and if
adopted that if anyone has anyting to say, they should come forward and give their views.
Councilman Judy suggested an executive meeting before the next regular session.
Mrs Wallin suggested that the council reconsider elimination of the historic overlay section
of the ordinance and felt it was the councils responsibility to the community to protect the
historic features within the city.
Kay Wojt, Planning commission member asked the council why the lot size had been reduced to
five thousand square feet that it was a drastic chance. Councilman Steve he had six lmts fifty
feet wide and new of many others who had the same size and if they were made any larger you
would have to repla the entire city. Mayor Smith said the lot size determination was made as
an expediency, sa~ing that he knew of at least five hundred to a thousand lots in town that
were fifty feet wide.
Mr Wallin suggested that the entire ordinance be published for the public interest before
final passage.
After some further discussion, Councilman Norwood made a motion seconded by Councilman Lindsey
that the Zoning Ordinance be tabled until the second meeting in December. Upon the question,
Councilman Hoglund said it seemed to him, the delay was based on whether the ordinance could
be enforced, he said he realized that we are not geared up to enforce it to the letter of the
law, but did feel that it could be acted upon, get it adopted, then it would afford the city
with protection in regards to zoning, with just the basic presence on the books- would be a
guide line. He said he hated to see the ordinance just lay around for another four to six
months. Mayør Smith said he felt it would be a grave mistake to table this for six months, he
mentioned that the city may be eligible for federal funding in some areas, and that also under
the Shoreline Protection Act adopted by the 1971 legislature, the state could come in and zone
much of Port Townsend unless we ourselves have a zoning ordinance. Councilman Norwood said she
would like to withdraw her motion, Councilman Lindsey withdrew his second.
Councilman Steve made a motion seconded by Cðuncilman Hoglund that the third reading be table.

BID AWARD
CIty Engineer French said that all the bids had been checked, that J.P. Surace Const. C~. had
two errors, one in multiplication, one in addition, which brought the bid down from 18,919.00
to 16,802.00, He said that Mr tlawley had called informing Mr Surace o~ the errors and if he
wanted to leave the corrected bid in. Mr Surace said that he would leave the bid as correcteà.
Engineer French recommended the council to accept the low bid of J.P. Surace Const. Co. Inc.
for the amount of 16,802.00. Engineer French also informed the council that the bid of J.D
Shotwell Co. on the asphalt for 22,745.00 was correct and recommended the acceptance of that
bid.
It Was moved by Councilman Hoglund seconded by Councilman Lindsey that the low bid of J.P.
Surace Canst. Co. Inc. for the price of $16,802.00 be accepted, for the Sheridan Street Project.
Motion carried.

It was moved by Councilman Lindsey seconded'bý Councilman Judy that the Low bid of J.D.
Shotwell Co. on asphalt for the price of 22,745.00 be accepted. Motion carried.
The City clerk informed the Mayor & City Council that the WSC convention would be held on
June the 22,23,24,25 at Richland Wn. any official desiring to attend should contact the Mayor.
