I Councilman Judy that the bills & Claims be draw warrants upon the, proper funds for POLICE REPORT I The Police Report was reas in full for the Month of' April 1971 and was ordered filed. The City Clerk informed the Council that the Treasurers report would be read in the future at the second council meeting of the Month due t~ so many companies, Bonding and Etc. were on the computer system. , " I Mayor Smith said that once a year the school elects a slate of off:l.cers to city goverrunent, this year Miss Penny Westerfield Was elected Mayor, he said that chairs had been set up at each station and that if Mayor Westerfield would come forward take her position and introduce I the rest of the officers elected. Mayor Elect Penny Westerfield introduced the following offic~rs, City Clerk Miss Jackie Smith, C~ty Treasurer, Miss Carol Knoph, City Attorney Roger Kenyon, Councilwomen Carla Beres, Karen Henderson, Rosie Kvinslahd, Councilri1én Don Sandvig. Absent councilen' were Richard Qualls, Teresa Martin and Scott Marriott. Mäy()r Westerfield introduced I Phil Isle, the elected Police Chief. Mayor Smith called for regular roll call. COMMITTEE REPORTS 8 Councilman Norwood, chairman of the light committee, reported a request for a light at 54th & Jackman' 8j;reet, saying that the committee felt that a 7,000 light ::!hou.ld be installed as requested, the other request for a light on Blaine, between VanBuren and Harrison it was decided by the, connni ttêe that a 20,000' lum light should' be ins taIled." Couricibman Norwood made a motion seconded by Councilmen Judy that the requested lights be installed. Motion carried. Councilman Judy said that' the water committee had been requested b~r the Mayor to look into the SeaBreeze water problem, he said'the cornmi ttee had met, and the eharges made are the proIE r charges under the existing ordinance, the committee found that the addi tional charges wad due to additional business and in view of that fact they could see no ju:3tification to ammend the existing ordinance, therefore recommend the ordinance do not pass. Mayor Smith said he would b~~ng up the ordinance under old business. OLD BUSINESS I MJYor Smith said the next item on the agenda is if any motion is ~tde that the ordinance concerning the change to the basic water ordinance. Councilman Camfield made a motion secónded by Councilman Hoglund that ordinance No. 1620 be read for the second time. Motion carried. . Ordinance No. 1620 was again read in full for the second time and 1 t was moved by Councilman Camfield that °rd. No. 1620 be read for the third time by title only.. Motion failed due to the lack of a second. Mayor Smith said at the last meeting, one of the items was a lease that been requested for 12 feet of Water Street down by the Mobil station, there had been considerable discussion at the last meeting and the action taken was to authorize the City'Attorney be authorized to draw up an Ordinance so that it could be brought up at this meeting, Mayor Smith asked the City Clerk to read,t~e Ordinance. I don't really know what his particular 8 problems with the barging are, but I know that he does have some problems that he cannot barge anymore and he has to come in by truck and for him to come ,down here and say he's doing this for the good of the city, to me it is dishonest and I couldn't vote for this because his basic approach is dishonest, so I don't think it is reasonable. Councilman Scheyer said he disagreed with leasing of streets, the leasing of Cottons street, there is a long precedence here, where he has built a dock, he has had that for many years, but I think of leasing of streets and this does set a precedence, we had one at North Beach which was wrong at the time and we will suffer the criticism of this for a long time. Councilman Scheyer said he was really opposed to leasing of this street because he thought there was adequate room, that he didnt need our street, because on the far side of his premises he has adequate room to build a loading p1atf'orm and run the pipes underground to his tanks. He said, to what the future will bring he didnt know and could not forsee antthing being build there in the next five years. ' Sounci1man steve said all he wanted to do was to verify Councilmans Scheyer argument in this case, he said he had looked it over and the only advantage that he would have by us giving him a lease on the city street side that he would utilize his own property for other purposes. Councilman Norwood said she felt that each time a request comes for a lease we should judge it on the merits on the request before us, she stated that just because we have had an unhappy experience where an entire street was leased on water front property that this should be the basis for turning down other leases and that each councilman should take a long look at their conscious when ,you turn down a business man for a resonable re~uest. Councilman Camfield said he would go on record of opposing the request. Councilman Hoglund said he was inclined to go along in disapproving the request, that he felt we might be setting a precedent, he said he recognized councilman Norwoods concern about 18 business man and should not try and interferwith a local business man trying to ply his trade but felt that ~ business man should if possible not put the city in a position of requésting city property for his own personal use. He said he would appose this lease also to any other inElividua1. He thought there Was a precedent set here that we might regret. He said he would concur with Councilman steve and Counci~man Scheyer in that he has ample area within the confine of the business property to transfer the fuel. Councilman Judy said that this had been quite a hassel with him all week about this request and listening to others against it, he could see no reason outside of using his own property and useing a few more feet of pipe, he wouldnt have to have a city street to operate, and to him he would have to go along in turning the lease down. One of the students, acting Police Chief Phil Isle said he couldnt see why it Å“ de that difference, the street is not being used for anything, the extra money that would come in boost the citys economy somewhat, why not let him lease it, get what money you can out of and put the money in some worthwhile project. ' Mayor Sm1t~ asked if there were anymore comments, no further comments, no action taken on the ord inane e . I I 8 much would it NEW BUSINESS BID DPENING I Under new business the city clerk opened the fòllowing bids for liability insurance for the city of Port Townsend. Homer S. Smith Agency, Farmers Insurance, Port Townsend, Wn. Port Towrlsend, Wn. Total Bid Total Bid $3,805.00 3,413.00 The city clerk informed the Mayor and council that there had been only 3,100.00 budgeted for liability insurance, there would have to be an emergency ordinance of make up the'difference. , Councilman Judy made a motion seconded by Councilman Hoglund that the bid of $3,413.00 of Farmers Insurance be accepted. Motion carried. ' Mayor Smith commented that while on insurance, we nave run into two' or three situations, there is a seperate policy on the treatment plant and pumping stations, this year starting, we went to the agents to get an estimate on what the insurance might be for the comming year, the premium this year will still be a 106.00 more. Insurance companies'are scared to death of anything in the way of a public building, as can well be understood, we have to pay'for such things that go on in the Capital, Post Offices, Federal, State and School buildings, it is rough on all of us who have to pay for it. 8 CLAI M The following claim was presented and acted upon as follows: To: The City of Port Townsend PIEASE TAKE NOTICE THAT RICHARD wI. OLSON, SR., hereby claims damages against the City of Port Townsend, State of Washington, in the'sum of $10.50 for a towing charge ,suf£ered by him by reason of the negligence of said city, its officers and employees, and respectfully shows: 1. Claimant resides at 411 McKin1y St., Port Townsend, Washington 2. Claimant's loss consists of fee paid to Erickson Brothers Towing Service as hereinafter set forth. 3. Claimant's residence for the past nine years was at above address. 4. Claimant's loss occurred on the 23rd day of March, 1971, at approximately 9:00 P.M. on said day, and ' 5. Occurred on 12th Syreet near the corner of Grant Street in said City. G. The defect that caused claiman'ts loss is-as folmws: vfuile on his way to a mobile home located in Victorian Village and it being night, he turned off of Sheridan St. onto what would seem to be 12th st. There being no barricades or other markers, made his way up the would be street until almost reaching the corner Qf Grant Sot. At tHis time he became hopelessly mired in mud and after vain efforts to get his car free from this mud, had to call a wrecker to remove him. Subsequent to this incident the said City has put up barricades. 7. The charges rendered the claimant is as follows: Towing charge to remove car from mud: $10~00 Tax ~50 . Total 110.50 It was moved by Councilman Hoglund seconded by Councilman Scheyer that the claim be rejected, and the claim be referred to the Citys Insurance carrier. Metion carried. Councilman Scheyer said he would like to put the council on record that the council endorse th e school levy be ing held on May 11th, he s aid he would like <Ro do this because the real need for the special levy has not really been pointed out and it is about time the information gGt to the public, he said the items that would be cut from the budget next year, there would be six teachers cut, all curricle activities will be cut, in addition to sports this would mean the band, drama, debates, all type of curricle activities. One primary costodian will be cut supplies, text books, maintenance salaries, maintenance su~plies and others. Seconded by Councilman Judy. Motion carried. Councilman Hoglund said that still hangin fire was the YDCC program that r~ Loyds presented to the council a few weeks ago, he said he was asked if the council had arrived at a decision on the program. After some discussion on finances and etc, that it was a good project, it was the opinion of the council not to take on the program'this year. Councilman Hoglund said he would contact Mr Loyds of the decision of the council. I aOMMUNICATIONS The following communications were presented and acted upon as fol10V1S: Dear Mr. Youngblood mn behalf of the students involved in the Student Government Day, I'd like to thank you and all the other city officials for a wonderful day. I know that I learned a lot and I'm sure the others did. I hope that the school and the city can continue this program for I feel that it is very important and beneficial to maintain good relations between the youth and the government. The intersection is'now traversable thanks to the interest taken by all of you. Again we express our sincere appreciation. r~ & Mrs Melvin F. Awisus CALL FOR BIDS I City Engineer Roger French said that the plans were now ready to c.all for bids for the improvement of Sheridan Street from 14th to 19th street and also bid,s for asphalt, :'1nd urged the council to take action tonight due to théfaèt that 'the coùnty would have an asphalt plant in the area and the city could save around 2,000.00 on asphalt. Counilman Lindsey made a motion seconded by Councilman Hoglund that the city clerk b'e authòrized to call for bids for the Sheridan street project and bids for asphalt. Motion carried. OLD BUSINESS 8 Mayor Smith said that the Zoning Ordinance WaS on the agenda for tonight as gathered from the concensus of the opinions of the councilmen, it is in rough form to be read, and would recommenä it be read for the first time tonight, and if ~he Council wants to take further action tonight or get it in a final form before final action is taken. He said tha,t the council might note that there' are a couple of things a little bit different from copies that were previously, handed out, the original ordinance had an agricultural zone, the proposed ordinance contains an R 1 (A) which is a primary single-family resÅ“dential with agricultural allowed. Another one concerns the board ef adjustments, the proposed ordinance has the board of adjustments written in to it with a final paragraph that until such time the council dir'ects the Mayor to establish the board of adjustment, the council will function as the board and do all the work, as time goes on there will be a lot of detail and wouldnt be surprised if tha council will get tired of having it and when they do, all they have to do is to direct the Mayor to establ~sh ~ boar4.
