OF THE REGULAR SESSION OF NOVEMBER 4, 1969 CONTINUED

The city clerk presented the final Pedersen Addition Plat to the city council, Attorney
Abraham looked the final plat over: and said it needed additional signitures, saying the final
had been signed by Jefferson County Treasurer showing that all taxes had been paid but it did
require signm'dlures of the Planning commission'tQhairman.£f the Port .'I'ownsend City Council and
the City Engineer. Attorney Abraham said th~t ff8uÎ8uRgt a date for E. hearing if they so desired.

M~or Smith asked the planning commission chairman if the preliminary plat had been approved
by the planning commission, the answer was yes. Mayor Smith'said it was hard to place something
on the agenda before anyone has œd a chance to check,it out, h~ wo]¡ld refer the final plat to
the Planning commssionvalong with the proper committees of the ci~y council and would set a
tenative date ßßr a pub~ic hearing for the 16th od! December:.. Attorney Abraham said he would
check the law and would notify the city clerk on whether or not a hearing could be held on that
date.

The City Clerk inforI1}ed the Council that the Mayor's Preliñiinary Budget for 1970 had been
turned in and asked the council to 'accept at this time the Mayors' Preliminary Budgeet for 1970.
It was moved by Councilman Hoglund seconded by Councilman Ruby that the MayO[' s' Preliminary
Budget for 1970 be accepted. Motion carried.
ADJOURNMENT

As there was no further business to come before the council at thi~; time, it was moved by
Councilman Hoglund seconded by Councilman Lindsey that the meeting do now adjourn. _Motion
carried.

The City Council of the City of Port Townsend, met i~ -regular ses~¡{on this 18th day of Nov.
1969 at 7:30 p.m. in the council chambers of the City Hall. Mayor ~mith presiding.
Mayor Smith said that there being three new councilmen elected and one councilman re-elected
Councilman Steve, Councilman Camfièld arid Councilman Scheyer have already taken the oath of
office, Mrs Norwood who was elected counciœman would not be sworn in until the second monday
of January. ' Mayor Smith asked Councilman Steve, Councilman Camfield and Councilman Scheyer
to sitpp forward and againrecei'lte the oath of their 'office so the public would know that they
have been sworn in. After again receivirg their oath of office,' CouncilmenŠteve, Camfield and
Councilman Scheyer returned to their proper stations as city councilmen of the city of Port
Townsend. - - ,- ,-
Ma!,or Smith said that we also have a new city treasUrer that she had received and taken her
oath of office and at this time woul~, lik~_- to.,congrat'tlate - Verna Spin~or the new Ci ty Treasure1.
Mayor Smi th said he ,would like to congratulate the only councilman present tonight for service
to the public dUring the time he was in office and hoped he 'öould continue his civic interest.

Mayor Smith also said that CouncilmanSieberibaiim, Who has been ill of late and it was the
reason for not being here, that councilman Siebenbaum had put in a Jot of years as councilman
with the good of the city at heart, and_at all times a Bood solid contributer to the community.

It was moved by Counciihman Hoglund seconded--by Councilman Lindsey that the minutes ot: the

Despi te a considérable effort oil the p:l rt- of the Council and Mayor Smith and a not inconsiderable
expenditure of funds for- the feàsibility study'conducted by our firms the citizens of Port I
Townsend rejected the plan for prôviding improved public facilities which you put on the Nov,. 4
ballot. We can imagine yoùr disappointment and probable' confusion as to the best method of
proceeding fr~m this point.
It would appear to us somewhat as' outsiders that perhaps things movl3d to rapidly for adequate
dissemination of--all of the facts, ànd -consideration of the many questions in the minds of the
people. If we may, we would like to suggest that an effort now be made to bring more citiz.ens

OF VARIOUS VIEWPOINTS INTO THE PLANNING PROCESS TO SEE IF A PLAN CAN BE DEVELOPED WHICH will
permit the Ci~ to obtain the badly needed operating quarters.
In this public hearing process you should feel free to call on us for whatever explanation of
our report may be necessary. You have an investment in our work and we want it to be understood
and useful to all of the citizens of Port Townsend. If the presence of someone from our firms
is desirable at certain public meetings that can be arranged.
We can't help but feel that the plan presented to the voters by the Council was a workable plan
which would have provided the much needed facilities at a ráasonable price and with considerable
future benefit to the community. However, the public has made its desires known and must now
be consulted as to the future.
It will be our pleasure to assist you in whatever manner you may direct.

DISBURSEMENT OF SETTL:Th1ENT FUNDS

Gentlemen:

Enclosed please find a check in paymènt of this year's share of the proceeds of settlement of
the first phase of the pipe litigation.
You will recall that this settlement Was entered into prior to the involvement of our firm
in the litigation and that we, threfore, have no monetary interest in that settlement. Our
name appears upon the check merely because we are handling the disbursement of funds for the
State of Washington group.

Hoglund that the monies received had been placed in the Current expense Fund, The check should
be deposited there. '

OLD BUSINESS
Under old business, Councilman Hoglund said that we have a matter of acquisition of the block
of land adjacent to the treatment center. He said that he and Mr. Porter had a discusm on and
Mr Porter is willing to sell the property to the city. The amount is the same amount as was.
appraised by the Port Angelses Aavings & Loan, the am)unt of $4,250.00. Mr porter has prepared'
a deed which the city attorney says has to be looked into due to a morgage involvement, Mr
Porter also requsted the city pay the closing costs which would amount to 42.50. Councilman
Hoglund said that we also should have'title insurance on the property if purchased. He said
the total cost would be around $4,350.00 ànd personally felt that the amount w~s reàsonable, and
that the city ãDuld purchase the property.
Attorney Abbaham said he felt it was a fair price and that there was no doubt that the city
is going to have to have a secondary treatment plant in the future and in his mpinion the citu
should buy the property at this price and at this time.
Councilman Lindsey said he agreed with councilman Hoglund, the property should be purchased.
Mayor Smith said he was sure that there was money left in the construction fund to purchase
the property. Councilman Hoglund also reminded the council that money was put into the general
fund from the pipe litigation suit to purchase such type of property. After some discussion
on what fund to purchase the property it was decided if the money WaS available in the construction
fund it could come from there, if not then from thegeneral fund.
It was moved by Councilman Moody seconded by Councilman Judy that the City Attorney be
instructed to draw up the necessary documents to purchase the property in questi on. Motion
carried.

ORDINANCE NO. 1574
AN ORDINANCE VACATING THAT PORTION OF ROSECRANS
STREET LYING BETWEEN THE NORTHERLY BOUNDARY OF
FOURTH STREET AND THE SOUTHERLY BOUNDARY OF
STATE HEGHWAY NO.9, IN THE EISENBEIS ADDITION
OF THE CITY OF PORT TOWNSEND, RESERVING EASE-
MENTS THEREIN, AND PROVIDING FOR PAYMENT OF
PUBLICATION COSTS.

The City Clerk commented on the above ordinance saying that the council had held a public
hearing on the vacation of the street and had passed its approval, but somehow an ordinance
had not been prepared.
It WaS moved by Councilman Lindsey seconded by Councilman Moody that the first reading be
considered the second and the third reading be by title only. Motion carried.
Ordinance No. 1574 was again read for the third time by title only and it was moved by
Councilman Lindsey seconded by Councilman Moody that the ordinance do now pass. Motion
carried.

ORDINANCE NO. 1575
AN ORDINANCE APPROPRIATING THE SUM OF $1,000.00
TO THE APPROPRIATION FOR THE CI TY CLERK IN THE
1969 BUDGET OF THE CI TY OF POR T TOWNSEND, AND
DECLARING AN EMERGENCY.

The City Clerk commented on the. above ordinance saying that due to the B&O Tax that started
in the city the first of the year, ran of.fice supplies far more than the budget called for and
also the election expense was much higher for the year 1969 than was antisipated.
The above ordinance, due to its nature had to be held over until the next regular session.
PUBLIC HEARING

Mayor Smith said that a public hearing on the re;-:uest for the vacation of that portion of 0
Street between Beach Street and Cherry Street would' now' be held. Mayor Smi th asked for a
report from the Planning commission. Gus Lind"uist, chairman of the Planning Commission said
that at the October meeting of the city planning êommission, the matter was taken up and the
planning commssion members voted unanimous to vacate the street. ,
Mayor Smith asked if their. were anyone in the audience that would speak for or against the
vacation. There was no comment. ' .
City Attorney Abraham said that a gentleman had called him and said he thought he owned ."

council that he felt that the gentl eman was wrong that it Vias a diffetren t part of 0 street, but

Councilman Lindsey, Chairman of the Street committee, said that,he had checked -the steet out
and felt that it ,should be vacat'd.
Councilman Lindsey made a motion seconded by Councilman Judy that the portion of 0 street
requested to be vacated be granted along with the reserved utility rlghts of the city. Motion
carried-.

Councilman Hoglund said that under new business the 1970 budget had to be looked at, he
compl&mented the Mayor on the budget that he had presented to the colmcil. He would like to
have a meeting of the council this thursday evening to go over thebudget'and if necessary a
back up meeting on Tuesday the 25th. iiHßc:;¡iml1:t:e~ councilman elect Nor'wood, the City Clerk, Mayo~
City Treasurer and the City Kttorney if he could attend. The meeting would be at e:oo p.m.
Madge Wallin, City Librarian, presented the Mayor and Council with copies of a report from the
library, board.
Mayor Smith Announced that the Washington State Cities holds a school for new rm yors and
councilmen each year, the meeting or school wo.~d be' held on the 24tJ:-l of November. He said
he had attended one and felt it worthwhile to attend.

Mayor Smith announcwalso that we are coming up to a new year and negotiation with union
representatives over new contracts for police and garbage department rersonnel was scheduled
Wed. the 19th and asked if at all possible if the finance commi1tee could attend. Councilman
Hoglund, Finance chairman said the would attend.
Councilman Steve commented on the Peterson Plat,. s~ting he had been studying the comprehensive
plan that was adopted by the city, the Peterson Plat showed 57' stre€lts and by state Law should
be 60', and asked if there was an explanation. Mayor Smith said that is one of the things that
had to be looked into, and that thel-e was a tenatibe date set for a hearing on the 16th of De c.
