The City Council of the City of Port Townsend, met in regular' sess,ion this 1st day of July
1969, at 7:30 p.m. in the council chambers of the city hall. Mayor Smity presiding.

put in at the Fort Cemetery, he was informed by the City Attorney that they could that it was
part of the agreement.

Mayor Smit~ said that the public hearing for the v"cation of that portion of 13th street
lying between the east boundary of Gise Street and the west boundary of Holcomb Street was
re-scheduled ~or the regular meeting tonight due to no report by the planning co~mission. ~r
Harry Dei ts a mpnber of the planning commis s '::m said that they had a mee ting and that the
recommendation was that the vacation would not be in the best interests of the city considering
the generally undeveloped nature of the area in question.
Councilman Hoglund siddd with the p1an~ing commission l'eport saying that vacating this portion
of stroet cc:u1d set a dangerous precedent and result in block at a time loss ot street access
to surrounding property.
Robert Sahlie said that 13th street came to an end at Holcomb and menti mod if anyone wi th
bad brakes or so forth could run right into his garage, and reco~nended vacating that portion
of 13th street.

Councilman Lindsey made a motion seconded b;T Councilman Ruby that the stl-'eet vacation be
approved. Upon roll call vote, Counc ilman Scheyer w:i:o had to 10 ave the mee ting due to a phone
call was not present during the disnuss~on voted present, Councilmen Judy, Ruby, Lindsey voted
Yae, Councilman Hoglund, Siebenbaum voted nae. City Attorney Abraham said he would have an
ordinance prepared for the next regular session and th3n it could also be voted upon by the
absent councilmen.

Tho city clerk presented a petition for a sidewewer contractors license, the applicant Lonny
M. Kvinsland. The potitio~ was in proper form and the bond was attached to the request. .

r.layor Smith referred the abo~e peti ti em to the stree t committee and tho planning commission
and set a public hearing date at August 5, 1969.
The city clerk informed the council that a city'-è1ection was due this year and the four
councilmen whos term was up had to draw position numbers according to law. Councilmen Sœeyer
Ruby, Siebenbaum and Boody, Councilman l'Joòdy being absent. Councilman Scheyer drew positi n
No. one, Councilman Ruby drew position No. three, Councilman Siebenbaum drew position no. fonr.
Councilman I.100dys position was no. two.
Councilman Hoglund såidthat He are having a little difficulty with some individuals in
paying their ~ B&O tax, he quoted the ordinance where it stated if the tax payor fails or
refuses to submit a tax return, the city clerk i authorized to determine the ~l)Unt of tax
payable and by mail notify said tax payor of the a;11Ount so determined. The City Clerk
ment5.onod that the ones that v¡ere delinauj-nt Vlere notified and the names had beon turned into
the City Attorneys office. Attorney Abraham said that the ones who he had contac ted so far
were people that do not owe a tax -¡ncause they did not make enough money, but they have to
£ile a return anway and was told they didnt understand that part. He said that there were a
couple w~:.o probably tnuhnk they arc going to resist and the city may have to follow the procedure
as co~ncilman Hoglund mentioned. Councilman Hoglund said we should institute a strong
procedure in taking up these delinquents so we dont end up in a big mess.
Ai Manser from t:le audience, inquired about the status of persons living out of town and
doing business in town. He said he had n mi.nd one such person who has not obtained a B&O
license.
Councilman Hoglund said that the situation represents a l)olicing problem and is qui te
difficult to handle. lIe said that other c i tie shave b'Jen enl is ting the publi~s cooperation
in questining individuals with whom business is done.
Attorney Abraham said that while frequent com;',laints are heard, tho public should consider that
1m-v enforcement dosent end with the poli-ce der:artment, if' people dont coorerate by contacting ,
the proper officials, enforcement cannot work, a lot of the effectiveness is dependent upon
the citizens themselves.
Councilman Lindsey sug~ested that the news media help b explaining the role of ~ublice
cooperation. It was sußgested by a member of the audience that a sign should be erected at
the city limits showing the type of licenses needed in the city of Port To~msend.
Under new bus iness, I.Iayor STIli th said he would 1 ike to apP? -'.nt Hr. Robert Johnson to the
planning com:nission board to fill a vacancy. lie said that vIr Johnson was well qualified to
serve and asked the councils apPI'oval of the appointment. It was moved by Cì -ncilman Judy
seconded by Counc ilman Lindsey that the appo 'ntmcnt of IJr Robert Jo- .nson to the planning
commiss ian be a)provGd. ¡.lotion carried.
Mayor Smith informed the Council that the washington state Cities Convention would be held
in Seattle on the 16th, 17th and 18.th o~ July, and recommended any official to attend i~ possible.

BUILDING PERMITS

The following building permits were presented and acted upon as fol10ws:
Jack Hensel, Duplex, 30'X65', Frame, Center & Cedar, Lot 50,51,52,' Cherry Parle Addn. $12,000.
L.M. Titterness, House, 24'X63', Frame, 22nd & Sheridan, ~~6,000.OO.

Mayor Smith asked if both permits were on sewer and water, he was informed by the clerk that
the permit of L.M. Titterness at 22nd & Sheridan was informed by the sewer supt. that sewer -:0 u]â
be available and the p(:;rmit for Jack Hensel on the Duplex at Center & Cedar was p3. ssed by the
Health Department for a sceptic tank.
Councilman Lindsey said that if it was the place he thought it was;, the building has already
been started and that it was on §'rant street -not at 22nd (~~ Sheridan and that the sewer .in that
area was only a 4" line and that it was already serving four houses.
S8wer Supt. Hawley said that there was supp03ed to be only one hou~¡e to a four inch line.
Engineer Warren said it seems thDt poop-a will apply for a building perIni t after the house is
half finished then all of a sudden will come in and want utility pernits. He said it might be
well to s tart making them proof up on how they are going to providec;:;he utili ties before the
permit is granted.
Mayor Smith said that the sooner vie start enforcing some of the procedures the better and felt
very strongly against s tartl.ng a building before coTl1I11ing in and gett:Lng a permit.' I
Councilman Huby said that many ti1:1es the council has passed on bul.J.ding permits, moving permits
and tear downpormits that had already been buIlt, moved and torn down, and felt it was now timJ
to crack down.
Councilman Judy said that until we have a buildj.ng inspector it is tough to do, we can stop
construction but it's difficult to check.
Mayor Smith said that it is impossible for the city to continue ib¡ loose practice of granting
building permits after construction begins and should withold approval of any PJrmit until the
engineer has a chance to review the cons truc t:Lon plan and available utili tics.
Engineer Warren said he vlOuld revise the present building permit to conform to the city
requirements.
Mayor Smith said that he felt strongly that the budget for this cor1:::Üng year should include
at least a half time engineer and more would be desirable. He said that he would recommend the
council to table to per>mit at 22nd &; Sheridan and wo"ld refe:r'r it to the Sewer Committee får
a recommendation at thG next regular council meet1.ng.
After considerable nlæe discussion it was moved by Councilman Ruby seconded by Councilman
Lindsey that the building permit Of L.W. Titterness at 22nd & Sheridan be tabled and the p, rmit
for the Dunlex be granted. Motion carried.

While attending a convention in Yaldma recently, I was impressed by the fact that Yakima, by
ordinance, had adopted an official Flag for tho city.
The Mayor" of the Ci ty of Ya!{ima, in giving his wclcoming, -address to the convention delegates then
assembled, was proud to present this flag to the distingqished visitor present on that particuld[-.
occaSIon.
The thought occured to me that the City of Port Townsend should adopt a similar ordinance.
The flag, design could be selected as a result of a contest or by other appropriate means.
We are taldng the liberty of sending a copy of this letter to the Port Townsend Chamber of
Comnerce in the hope thEtt sufficient interest might be generated to have the city adopt an
offic ial flag.
