Port Townsend, Washington
The city council of the City of Port Townsend met in regular session this 20th day of May 1969,
at 7:30 p.m. in the council chambers of the City Hall. Mayor Smith presiding.
ROLL CALL

MINUTES OF THE PREVIOUS SESSION
The minutes of the previous session were presented and it was moved by Councilman Scheyer
sec::mded by C:uncilman Judy that the minutes of the previou,s session be dispensed vdth. Motion
carried.
BUILDING PERMITS

Mayor Smith said the permit at 1519 Washington and the permit 1727 Je~ferson were in the fire
zone and felt that they should be held back for further investigation. After some discussion
it was the opinion of the council that the fire zone in that area. should be looked into for it
was a residential section. It was moved by Councilman Judy seconààd by Councilman Lindsey that
the building permits be granted except the two that was in the fire zone. Motion carried.

MEMORANDUM TO ALL PIPE LITIGATION PARTICIPANTS
Gentlemen:
Enclosed is a check disbursing the balance on hand of the Pipe. Litigation Costs advanced
Fund.
The amo nt is determined as shown on the enclosure.
In the unlikely event that your city should find itself at a loss for a place in which to use
this money profitably, I invite your attention to the other enc10suros relative to the Asphalt
litigation.
As you will notice, the provisions for financing and disbursement in the Asphalt litigation
are nuite similar to those used in the Pipe litigation which we have now so successfully
concluded.

We, the undersigned do not understand how 3nd why the Port Townsend City Council is considering
passing an emergency ordinance to pay rent on the Teen Center, v¡hen you did not see it fitting
to give some amusement tax relief for the local theater.

The Teen Center vms supposed to be sel~-supporting and it benefits just a few, while the theater
is recreation for all.

COMMITTEE REPORTS

Councilman Moody cOInmented that the request for 2nd story addition at 720 vvater street, no
plans had been received so could not be taken up at t;-;is session.
Mayor Smi tli commended the Police Dept, Sheriff Dept for their good \'iork dur,ing the festival,
and also colnmended the street department for a good clean up job.

1w Kay Miner from the audinence stated that the city has no established recroat on and the
proposal presented sounds like a good bargain.
1~ Robert Harper, an official of ACT, spoke of accomplishments of past recreation programs,
and described the assurances received by ACT from .school officials that a full time recreation
program would again be resumed contingent on the outcome of the schools forest fund suit, action
by the state legislature and also the possibility of a special levy. He said a summer program
was again planned this summer and school facilities have been ma:e available wher8 responsible
adult supervision is provided.
I\1r Wallin, a member of the audience, spoke aga:inst the emergency ord:'nance, s:-oy='cng he felt no
emergency existed.
Councilman Moody, said he felt if th3 city paid the rent, it would deprive the teenagers of
the previlege of accomplish'ng something on their own and also it would be opening it up to
other similiar organizations to demand public funds.
Mrs Wallin, City LibÈarian, spoke against the proposed ordinance.
Mr Thompson, from the audience spoke agains the emere;cmcy ordinance.
Councilman Lindsey said he did not feel that this sh01lid come under an emergency ordinance.
City Attorney Abraham said he would like to point out thDt in sec. 2 of the ord7nance Dtctes t:.~at

by the chief of police, he said t~'lat the city is not in a position to appropric.te mney to a

the police depe.rtment for tho balance of 1969. He said he would like to see the pork board
consulted, he did not know what their feo1inßs would be in a recreati nal program, but it would
be botter if this proGram \vas incorporated into the park department as a long range program.
I.Iayor Smith se.id that he expressed his objections that it be under the police department at
the lost meeting for a lot of requirements are already placed upon the police department and
could not see the police chief be given added duttios of running and adminstering another
program such as this and it could run into additional personel.
Councilman Scheyer said that we as a co .ncil are lacking kindness, kindness in providing
human services, if the teenag~)rs are vlOrthy of support the city shou1 support them and if therO'
were 13 other clubs such as this that are worthy of our support, I, think we slloüld support them
as well. He said that the teenage club did not come to the city for support, that he, a fellow
councilman CruTIe to the council to ask for support.

Ken Soapes, president of the high school student body and also one of the leaders in organizing
the teen center, spoke for the teen center.

active interest in how it is run.
Councilman Scheyer made a motion seconded by Councilman ~uby that the ordinance be again read
for the third time by title only. Motion carried.

Councilman Scheyer seconded by Councilman Ruby that the ordinance do now pass. CounciDuan
Scheyer, Judy, Ruby voted yae, Counc 1man Siebenbaum, L'ndsey, ~Ioody voted nae. Motion did not
pass. City Attorney Abraham said that in case of a tie, the ¡',Iayor sll01Üd vote. I/îayor Smith
voted no. lIayor Smith corrected ~imsolf and said he did not have to vote to break a tie.

lest session and reco mended its passage. It was ~oved by Councilman Ruby seconded by Councilman
fuoody that the agreement be accepted. Motion carried.
NEW BUSINESS

between the East boundQry of Gise Street and the ,est Boundary of Holcomb Street, in the City
of Port Townsend, after due notice given and hearing had according to law.
Petitioners agfee to pay costs of publication of an ordinance for said vacation, and to the
reservation of utility easements in the vacQted street.

It was moved by Councilman Lindsey seconded by Councilman Siebenbaum that a public hearing
for the petition be held at a regular coD~cil moeting on the 17th of June. Motion carried.
Engin;)er 1'-:'arren rc:::,orted that theUAB informs us that the city's prospectus for the I¡lonroe
Street Arterial project was received prior to Mayl as renuested, but the board has revised their
procedures and the citys project will not be funded prior to January 1, 1970, ~nd nothing could
bo done with the schedule unless they change the rules again.
Engineer ,iarren said at the last meeting the colillcil wanted to extend the city hall investigation,
he said that each councilman had report on what tile study would be, he said with the citys approval
to associate ourselves with architect Ralph Anderson for certain portions of this study. Uith .
the councils approval they would do an actual scope of Phase 2 study and prepare in conjunection
with the architect, t~. Anerson, a firm fee and proposal for conductin the study and preparing

The city clerk asked the councils action to where to deposit the $81.64 that was received from
the Ii tigation suit. It \vas. moved by Councilman Judy seconded by Councilman LToody that the check
'oe deposited to tt..e Current Expense Fund. Uotion carried.
Councilman Judy suggested that if the city decided to give money for recreation, he thought
ACT should also cc:onsidered.

Councilman Ruby mentioned theat there were -'ui te a few caterpillars running ar()und the
trees Gnd suggested that the city take a hand to see what could be done. Mayor Smtth said
he would check with the coun<ty and others to see what they were doing.
