The City Council of the City of Port Townsend met in regular session this 18.th d~ of March 1969 at 7:30 p.m. in the council chambers of the City Hall. Mayor Smith presiding. ROLL CALL . Officers and members present were as follows: Mayor Smith, City Attorney Abrah~, City Clerk Youngblood, Councilmen Scheyer, Hoglund, Judy, Ruby, Siebenbal~, Lindsey, Moody. MINUTES OF THE PREVIOUS SESSION . It was moved by Councilman Hoglund seconded by Councilman Moody that the minutes of the previous session be dispensed with. Motion carried. P ERMI TS The following meår down permit was presented and acted upon as follows: Neb Balch, Tear down Steven's Apt-. Bldg. Blaine & Harrison and to abide by Ord. No. 907. I t was moved by Counc ilman Ruby seconded by Councilman I'(¡oody that the tear down permit be granted. Motion carried. C OflITvIUNICA TI ONS , The fò110wing communications were presented and acted upon as follows: From Olive Paddock, 1'1 Port ~ownsend, Wn. to-wi t:. j~arch 13, 1969 Honorable Mayor Mr. Frank Smith and City Council City Hall Port Townsend, Wash ngton , Gentlemen: In regard to Eddy Street, I herewith'submit an application for a six inch water tap located on athe north side of Hastings Av~nue and Eddy Street to serve Eddy Street from Hastings Avenue to Thirty Fifth Street. March 18, 1969 to-wit: To the Honorable City Council Port Townsend, Wash ington . Gentlemen: In order to connect to the ci ty sewer we find that we would have to install 120' of 6" sewer pipe in the city street. The contractors estimate for the installation is 475.45. We are vdlling to pay the cost of installation on the city street, if the amount can be applied against future sewer charges. . Respectfully, Karl & Lillian Jacobsen Fir &T Street Port Tovmsend, W n. March 18., 1969 to-wit: , I am wF'iting this letter as a request of your consideration to allow me to remain on the group medical plan which was set up & which I joined last year as a active working employee of the ci ty. Since I was placed on a six months inactive term the first of February 1969 with a tenative disability retirement to follow my income will be very minimal & with medical costs as they are & inflation as it is this is not going to go very far. I know that everybody feels that since I have a business & am now retired that I really have it'made, well this is fJery far from the truth as I find I am not able to work as I had in the past & probably will have to closé same in the near future. I will very much appreciate your consideration of this matter & be waiting to hear your answer. Thank You Lester M. Bume;arner J'r. Mayor Smith said that there was no group plan that it was an individual choice by full time CQty employees. Councilman Hoglund said that Mr Bumgarner had approched him that he felt the city should pay the 9.00 monthly cost that the city was paying for medical for full time employees. He said he told him that he was retired on a disability that he was no longür a full time employee. He mentioned that I'fJi> Bumgarner was getting medical through the Firemen Pension & Relief' fund. After some further discussion it was moved by Councilman Judy seconded by Councilman Scheyer that Mr Bumgarner be allowed to stay in the group plan but at his own expense. Councilman Lindsey made a motion seconded by Councilman Ruby that Mr. Swangon be given permission to open the street according to the street ordinance and under the supervision of the street supt. Upon the qu3stion councilman SiebenbaLLm said he would like to know just exactly where the street was for so far he had not been able to find out and could not see how anyone could vote on something where you dont know where or what you are voting on. Mayor Smith said the Mr. Swanson should be given a copy of the steet ordinance, for the city has no responsibility, he has to survey, show where it is and to do the necessary work, bring it up to certain standards. Nrayor S1:1ith asked the street Supt. to give a copy of the street ordinance to Mr. Swanson. Councilman Lindsey said that ~~ Swanson knew what he had to do, all he wanted from the council was permission to open the street. Upon roll call vote motion was carried. Mayor Smit~ brought before the council the request of ~œ & Mrs Karl Jacobsen to install a sewer line on a city street. He asked the council if they would like to discussit or put it out on committee for a later report. Counci~man Hoglund said that IDr Jacobsen had contacted him and had told him that at the present time he was on a sceptic tank, he was going to remodel which wculd tnen be necessary for him to- ty~ into the city seVier. He said that Mr Jacobsen would put the sewer in wnich would cost around 4~5.00 if the city would apply it against future sewer charges. Mayor Smith asked 1~ Jacobsen if he was within the required 160' ßß the sewer. r~ Jacobsen said he was not. City Attorney Abraham said he thoUght lli~der our ordinance the city does not häve the option of wavi~~ any fees of any kind in connection to this sewer project because we are obligated to the bonding company to collect all the fees that are chargeable under this ordinance. Councilman Scheyer said he was faced with the same problem, he had about 400' before he could connect to the sewer and felt personaly that it wasnt the citys obligation to put his 400' of sewer pipe down to the trunk line. Engineer Dick Warren mentioned that rnost citys get sewers where needed by LIDs and also mentioned that if a line was connected in that area it should be nothing less than an 811 line. opening by Mr. A. C. Swanson it was of Sunnyside Park. He said that he get an engineer to run the lines on 8 I I 8 After considerable discussion it was moved by Councilman Ruby seconded by CO1mci~man Scheyer that the request be tabled until the next regular session. Motion carried. The city clerk read the following request to petition streets. From A.C. Swanson, March 9,1969 to-wit: Mayor and City Council I request your consideration to vacate the following streets, Laurel Street, Ivy Street and Fifth Street which are all inside Sunnyside Park. Also the vacation of Sixth street that lies inside Sunnyside Park. All of these streets are dead ends, they are all inside my properËy. I Thank you, A.C. Swanson The above request for vacation uf streets was not in form and the city clerk was instructed to notify Mr Swanson. CALL FOR BIDS Request to call for bids on a Press Type Garbage truck, bids to be opened on April 15,1969. John Perkins Garba(~e Supt. 8 Mayor Smith said he would hold the discussIDon on the bid until af~er the public hearing. PUBLIC HEARING Mayor Smith said that tonight had been scheduled for a public hearing for the vacation of fourth street by ~~ Ellis and had the city clerk read the petition again. PETITION FOR STREE VACATION The undersigned, who are all of the abutting owners upon the portion of Cjty Street hereinafter requested to be vacated, here and hereby petition the City Council, ar~er due notice given and hearing on this Petition, to vacate that portion of Rosecrans street lying between the Northerly boundary of Fourth Street and the Southerly boUndary of Stae Highway no 9, in the Eisenbeis addition of the City of Port Townsend. Petitioners agree to pay cost of pu'J1ication of an Ordinance providing for the vacation 01' said portion of said street, and to the reservation of easements for utilities over, through and across said portion of street. I Lyman M. Ellis Rachel J. Ellis I Mayor Smith asked if there was anyone present how had any objections to the vacation, if not it would be turned over to the council for action. There was no objection. Councilman Hoglund asked if the planning commission h~d any objection. he remembered the planning commision had no objection. Mayor Smith said as Councilman Lindsey said he could never pin the street committee down on what their idea was on vacating the street but would at tnis time make a motion to vacate the street but wou~d reserve the rights of easements for any utilities on the street. Seconded by Cou~cilman Moody. 8 , Upon the qul3stion, Councilman Siebenbaum said that once before we had a problem come up about vacating streets in that area, and was under the impression that there mu1d not be any more cross street vacation and tnis street is one of the cross streets. He said he knew tile council had turned down a vacation of' a cross street there by John Kruse and unless he was misínI~ormed he could not seeVlhy VIe should refule one cross street vacation and grant one to some one else. Councilman Ruby said his findings \'Jepe the same, but there was a natural drainage City Attorney Abraham said thQt if there was a natural drain ~here and if we want a drain there then. that; should be included in the ordinance and would recormnend the be ammanded to muke that provision ö-S v".[ell as utility easements'. Councilman Lindsey made a motion seconded by colli1cilman Moody to ammend the original motion to include to maintain a drain in the proposed vacated street. Upon roll call vote motion was carrie d. there. to maintain mo~ion I Engineer Warren informed the council that the constructal team would be here next week to take a .hard look at the city hall. He also mentioned that each counc ilman h~'1d a note book on their desk with the new proposal and also there would be copies of pnwgnndsaro! pnpgt~6s to be entered as time went along. City Attorney Abraham recommended the council to take some action to approve the new proposal for as he recalled at the last meetIng there were two proposals which vlerecombined into one and not action was taken, t~;is proposal is the one that was ag~cptlDdpon but not acepted at that time. It was moved by Counci.Lman Moody seconded by Councilman Lindsey to accept the proposal of Cramer, Chin & Mayo~'as now wri tten. Mo~ion .carrieQ. I . ' Mayor Smith brought up the call for bids for a new press garbage truck, he said he thought such a truck would ease and help the situation of the department and that the city could handle the cost of that type truck. After some discussion of operational èetails, Mayor Smit1;1 said 'he 1Nould hold the reques t up until a later date. Supt. Hawley of the street department said he hud talked to Councilman Lindsey, Siebenbaum and Ruby about the purchase of a new tar pot for the street department that was badly needed, it would cost around 1,500.00 and had the money in the [resent budget to purchase it, and at this time would ihike to aske the councils permission to purchase a new tar pot. After some discussion it was moved by Couœ ilman Lindsey seconded by Councilman Ruby that the request be granted. Motion carried. "8 City Ættorney Abraham said that he would be presenting a voucher for travel due to a meeting in Seattle aon the Anti Trust suit on chlorine and also stated that one one these days we would be billed for a 1,000.00 for our share of the suit. Eng. Warren said that they had inspected the so called repairs of the hairline cracks at the treatment plan~ and round it unsatisfactory, he said that they insist that they dry the tanks one at a time and repair the cracks before they reccive their money. Mr Warren also stated that that repairs had been made on the pumping stations and that there should be no bill received. ADJOURNMENT I As there was no further business to come before the council at this time it was moved by Councilman Lindsey seconded by Councilman Siebenbaum that the meeting do now adjourn.
