The City Council of the City of' Port Townsend met in regular session this 5'th day of Dec. 1966
at 7:30 p.m. in the council chambers of the City Hall. Mayor Sullivan presiding.

It was moved by Councilman Ruby seconded by. Councilman Lindsey that tŒ building permits be
granted. Motion carried.

NEW & OLD BUSINESS
Councilman Ruby stated that Gordon Sandison WäS for decreased rates on'the Hood Canal bridge,
I and felt that the council should back him up. Councilman Ruby mö.de a.motion seconded by
I Counciiliman Judy that the city council go on record supportigg Gordon ~andison for decreased
rated on the bridge.
On the question, councilman Siebenbaum spoke against the decreased rate. Upon roll call
vote, motion was carried.
Mayor Sullivan asked the council for free parking on the 9th 10th 16th 17th 23rd and 24th
of Dec. It was moved by Councilmö.n Lindsey seqonded by Councilman Sweitzer that free parking
be had on the suggested dates. Motion carried.
r,-,Iayor Sullivan asked Mr Ron Mayo and NTæ Ark Chin Engineers of Carey & Kramer to talk on the
new sewage proposal. Both described the history of the city sewer systen1 up to and including
the present project, they answered questions that were asked by the audience, one which was asked
by Mr daly on whether the city had ever received in writing any official findings of the PO11utiion
control commission or s ta te department of health showing that lac al waters were actually POllut¡kd
to the podmt of endangering public health. He was informed the ci ty had not. City Attorney I
Abraham po nted out that it is not necessary. for the pollution control commission or anyone else
to rule the waters polluted that his project is an action of the city council whose duty it is to
act in the best interests of the city. He also stated that he wished to make it very clear
thö.t the city is not acting arbitrarily without having loo~ed into the matter. Mr Mayo also
explained that the $950,000. in revenue bonds will be in addit:Lon to the $218,000..regeived
from the federal government for the project, to another question that was asked hes-aid thö.t
the engineering design fee, bond discount ta es and miscellaneous other ,i'ees will boos~ the

~ COST TO ABOUT $1,080,000. Mr Chin informed the council and audience that the project
would start almos t immediately fol:.lowing the awarding of the contrac: ts.
Mr Arch McLean of McLean & Co, tacoma investment bankers, spoke on interest rates of the
bonds which would be around 4.92, he also said that the cost would be per hookúp on the sewer
system, for new sewer users, $5.00 per month, to the ones presently served by existing sewers
vvould be raised from ¡1.00 to $4.00 per month. Commercial users would pay 10010 of their water
bill or a minimum of ~p5. 00 to the new or $'4.00 to she exis.t'ing users.
It was also brought out that there would be a charge of $75.00 per' hookup, tne line would be
ran to the property line. It was al'so brought out that any house within 160' would be required
to hook up the the sewer.
After some further discussion City Attorney Abraham stated that the city had not accepted
the bids on the sewer contract and because of the federal re uirments envolved the bids hö.d to
be accepted by resolution, he also ö.n ordinance was to be read and that an agreement vdth the
state o~ washington department of institutions to be på.ssed on. It was moved by Councilman
Hoglund seconded by Councilman Ruby that the agreement now be read. Motion carried.
AGREEMENT
.
THIS AGREEMENT, made and entered into this day of 1966, by and between the City
of Port Townsend, a municipal corporation of the third class o:f the state of Washington, herein~
after called the "City" i:.\nd the state of Washington, acting by and -through the State Department
of Institutions and the state Department of General Administration, hereinafter referred to as
the "State.
WITNESSETH:
WHEREAS, the City intends to construct a sewage treatment plant, the City is willing to proviae
sewage treatment facilities and service for Fort Worden Treatment Center ö.nd
WH~REAS, various departments of Washington State Government, including the Department of
Institutions, the Department of General /Administration, Department of Health and the State
Pollution Control Commission, deem it feasible and desirable for the City to provide sewage
treatment and facilities for Fort Worden Treatment Center' and said dep~rtments have approved
such a plan, Now, therefore
In consideration of the mutual covenants herein contained, the :r:a rties do hereby agr~e as
follows: °
1. The City agrees to provide sewage collection, treatment, and disposal facilities to Fort
Worden Treatment Center at Port Townsend, Washington, hereinafter referréd to as "Thè Center"
within eighteen months after this agreement is executed, and the State agrees to pay a service
charge for such service all as further provided herein.
2. Term of Agreement --
This agreement shall be effective on the date first above written, and shall remain in efffect
for a total period of 30 hears from date hereof, provided that on or after January 1, 1977, thi~
agreement may be terminated by the State upon payment to the City of an amount sufficient to II
retire ten percent of the principal amount of the water-sewer revenue bonds of the City issued,
under date of December 1, 1966 then outstanding including the E.ccrued interest due thereon on süch
redemption date and the premium required, if any, to effect such redemption. II
Upon termination of this agreement, the. City agrees to charge the State for su ch services a rate
no higher than that is lbhen being charged a simil8.r customer of the City. . II
3. Faint of Connection ' . '.
Starting at the intersection of 47th and ;)pruce Street the City will construct an interceptinm
sewer line on the Fort Worden grounds which interceptor'will pick up all of the exišting live 11
main line sewers on such grounds. The Stö.te will grant an easement to the City for construction
of said interceptor. j
4. Capacit;y
The Stat9 shall be entitled under this 'agreement to a total connected load of 700 persons
including patients and staff, whether living within or without the hospital grounds. The state
shall be entitled to an average annual sewage flow of not less than ~100 mill. ion gallons per da~1
and a peak hourly flow of not less than. 250 million gallosn per day" If flows in excess of the~e
quantities are produc.ed, the State whall pay to the Cit.y additional eompensation pro-rated on t]le bf
basis of connected load. .
5. Treatment
The City shall provide primary treatment and discharge of effluent in~o the deep waters of
Puget Sound in accordance with the construction plans approved by the State Department òf Healtn
and the state Pollution Control Commission.
6. Character of Sewage
Tne sewage discharged from the Center into the City's sewage systenl shall not be injurious to
concrete sewer pipe nor of such a character as to cause serious problems in treatment. The
sewage now prodaced by.the Center shall be considered satisfactory.
7. . Service Charge
The service charge to þe paid by the State hereunder shall be Nîne Thousand Dollars (9000.00)
per year payable monthly at the rate of Seven Hundered and' Fifty Dollars ($750.00) per month.
8. Time of Payment
The service charge hereunder shaoll be billed by the City and :~aid by the State on a monthly
basis, prior to the tenth day of each month, starting on the payment date next following the
date that sewage service is made available to the State hereund,:œ. All bills shall be payable a~
the City of Port Townsend Treasurer's Office in Port Townsend, Washington. Termination of this agree
mentshall not effect any liability for money due on or before the date on which the termination
becomes effective.
9. In$erruption of service beyond control of the City
The lhty or its officers, ö.gents and employees shall not be liable to the State for damages
or for breach of contract in the event the City's operation of its sewage system or any part
thereof is suspended, interrupted or interferr3d with for any cause reasonably beyond the Citys ~EN
control.
IN WITNESS WHEREOF, the r:arties have executed this agreement each by the signatures and attest

PASSAGE OF ORDINANCE NO. "1505

Ordinance no. 1505 which is duly incorporated in the minutes of the previous session was..
brought before the Council for passage or re:tJectinn. It was moved by Councilman Hogluhd second'ed
by Councilman Judy that the first reading of ord. no. 1505 b~ considered the second reading and
the third reading be by title only. Motion carried. .
Ordinance No. 1505 was again read for the third time by title only and it wan moved by
Councilman Lindsey seconded by Councilman Hoglund that ord. No. 1505 do now pass. Motion carried.
ORDINANCE NO. 1506
Ordinance No. 1506 was read in full and acted upon as follows:

AN ORDINANCE OF the City of Port Tov'illsend, Washington adopting a plan
for the acquisition, construction and installation of certain additions and
improvements to and extensions of' the existing sanitary sewage system of' the
city,_and making said system as so improved a part of and belonging to the
water system of' the city; declaring the extimated cost of such addit:~ons,
improvements and extensions; providinr; as a part of said plan for the issuance
and sale of $950,000 principal amount of water-sewer revenue bonds of the
city for payment of ~rt of the cost of such additions, improvements and
extensions; fixing the date, form, terms maturities and covenants of said
bonds; providing that the same will be issued on a parity wi th certa:~n
outstanding water revenue bonds of the city; creating a construction fund;
creating a bond redemption fund for the payment of the principal of and
interest on such bonds, and a reserve account; providing and adopti~~
certain covenants and protective provisions safeguarding the payment of
the principal of and interest on said bonds; confirming the sale thereof
and declaring an emergency.
It was moved by Councilman Hoglund seconded by Councilman Sweitzer that the first reading of
Ord. No. 1506 be considered the second reading and the third reading be by ti t=~e onl y. Motion
carried.

DO RESOLVE: -
The City Council of the City of Port Townsend after reviewing all bids submitted
on its §ewage System Improvement Program awards Schedule "A" to Ott-Atwater Inc.
of Seattle for the sum of $367,000.00, Schedule "B" to National Construction Co.
of Seattle for the sum of ~p293,615.00, and Schedule tiC" to National Construction
Co. for the sum of $241,227.50. These awards are conditioned on approval of award
by the Federal ~ater Pollution Administration and completion of financing. Carey and
Kramer is hereby authorized to give "Notice to Proceed" to the contractors when the
ap:proval of award has been received from the Federal ,vater Pollution Control
Administ ation and the financing is completed.
