MINUTES OF THE REGULAR SESSION OF SEPTEMBER 1, 1987

The City Council of the City of Port Townsend met in regular session this first
day of September, 1987, at 7:30 PM in the Council Chambers of City Hall, Mayor
Brent S Shirley presiding.
ROLL CALL
Councilmembers present at roll call were Jean Camfield, Glenn Ison, Vern Jones, ohn Clise,
Mike Kenna, Mary Norwood and Norma Owsley. Also present were City Attorney Keith I
Harper, Public Works Director Ted Stricklin, Clerk-Treasurer David Grove and
Executive Administrative Assistant/Planner Michael Hildt.
MINUTES
Councilmember Jones made a motion to approve the minutes of August 18, 1987, as
written and to dispense with the reading of them which was seconded by Council-
member Ison and passed unanimously by voice vote.

IA letter dated August 20, 1987, from Michael Kenna to Randy Radock and Bob Sher-
¡wood of McDonald's Corporation was copied for the Council requesting additional
¡information for the threshold determination on their environmental checklist on
,the construction of a restaurant in Port Townsend.

The Council received a claim for damages dated August 20, 1978, from Daniel
O'Connell for $250.00 to replace a windshi~Tdon a boat alledged to have been
broken by a low hanging tree on Cherry Street about S or T Street. Councilmember
Jones made a motion to refer this to the Washington Cities Insurance Authority
¡WhiCh was seconded by Councilmember Camfield and passed unanimously by voice vote
¡The Council received a letter dated August 20, 1987, from Lois A Venarchick of .
¡Norfolk, VA, with a copy of a letter to a local editor about a McDonald's Restaur¡
,ant and urged that a McDonald's Restaurant not be allowed in Port Townsend. Mayow
¡Shirley referred this to the Legislative/ Environmental Committee.

¡The Council received a letter dated August 24, 1987, from the Port Townsend Fire
Department requesting that the levy for Emergency Medical Services be renewed.
IA resolution to this effect will be prepared for the meeting of September 15, 1987.

IA letter dated August 24, 1987, was on each Councilmember's desk from Lee Arey,
Principal, Port Townsend Intermediate School, requesting signing for traffic
¡safety around the schools. Councilmember Jones made a motion that the City pro-
Ipose that it will install the signs if the school will buy them which was seèondeÅ’
¡by Councilmember Kenna and passed by voice vote with Councilmember Camfield -

'A letter from Marcia Meyers was received by each Councilmember requesting that a
Iset of strict codes and procedures be created for review for all future commercial
Ideve 1 opment.

IThe Council received a copy of a letter dated August 31, 1987, from Richard L
¡Shaneyfelt to City Attorney Keith Harper requesting a refund of money paid by
¡Fred Hauser for a street vacation. After a brief discussion, Councilmember Jones
'made a motion to reject the claim which was seconded by Councilmember Ison and
passed unanimously by voice vote. -

A claim for damages dated August 14, 1987, from Whitey Johnson resulting from a
stop work order issued for the Calvin Gleason residence in January, 1986, was
discussed. Councilmember Ison made a motion that the Council reject the claim
land refer it to the Washington Cities Insurance Authority which was seconded by
Icouncilmember Jones and passed unanimously by voice vote.
: COMMITTEE REPORTS

Iwater Restrictions. Mayor Shirley announced water restrictions as follows: :
¡,Alternate watering days with odd numbered addresses watering on odd numbered days!
,and even numbered addresses watering on even numbered days between the hours of
16 to 9 AM and 9 to 12 PM. The Golf Course and the Parks Department have been
asked to cut back as well.
Highway Work. Ted Stricklin explained the work that is going to be done by the
¡State Highway Department from the City Limits to the Ferry Terminal.
I PUBLIC HEARING
¡Street Vacation No 587-05 -Krieger. Michael Hildt reviewed the findings and con-¡
'elusions recommended by the Port Townsend Planning Commission. Mayor Shirley!
opened the hearing to the audience. Loren Krieger was recognized and spoke in :
favor of the application. There being no further testimony, Mayor Shirley closed!
the hearing to the audience and turned the application over to the Council for:
'disposition. Councilmember Isba - made a motion that the Council grant Street!
Vacation No 587-05 with the following findings and conclusions which was seconded!
by Councilmember Jones.
¡FindingS of Fact.
1. Applicant requests vacation of the east three (3) feet of the Grant Street
¡right-of-way which borders the applicantts property from the First Street right- ¡
of-way, south to the north boundary of the adjacent lot (Lot 1, Island Vista). .
2. The single family residence on the property intrudes into the Grant Street.
right-of-way approximately 1.5 feet. Applicant seeks the vacation to clear title¡
for impending sale of the property.
3. The concrete slab drive to the garage extends into the Grant Street right-of-,
way approximately 13.5 feet.

14. The front yard setback after the vacation wound range from approximately 1.5 I
to 3.75 feet if the vacation is granted. Built prior to enactment of the Port'
Townsend zoning code (1971), the residence is a legal, nonconforming structure in!
'the R-1A zoning district.

The Grant Street right-of-way is sixty-six (66) feet wide.
Conclusions:
11. The proposed street vacation is in compliance with the goals and policies of
¡the comprehensive plan.
2. The portion of Grant Street proposed to be vacated is not required for current
or anticipated overall area circulation.
