ROLL CALL Councilmembers present at roll call were Jean Camfield, John Clise, Janis Hunt, Glenn Ison, Vern Jones, Mike Kenna and Mary Norwood. Also present were City Attorney Keith Harper, Public Works Director Ted Stricklin, Clerk-Treasurer David Grove and Executive Administrative Assistant/Planner Michael Hildt. I MINUTES Councilmember Hunt made a motion to approve the minutes of May 5, 1987, as writte? and to dispense with the reading of them which was seconded by Councilmember Jones and passed unanimously by voice vote. Councilmember Hunt made a motion that the bills and claims be paid from the proper funds which was seconded by Councilmember Isbn and passed unanimously by voice vote. He I expressed concern about the environmental-situation of the proposed bed and breakt /ast inn at 1208 Franklin Street. \ I MS Cheryl Van Dyke was recognized and gave the council an update on the Chamber of Commerce Tourism statistics and promotional information. Ithe Environmental Checklist for Joan and David Deering to operate a bed and break~ fast inn at 1208 Franklin Street which was seconded by Councilmember Jones and. passed unanimous ly by voi ce vote. : Finance. Councilmember Hunt reported the committee had met with Mr Lewis Leigh or ,Washington Cities Insurance Authority and Homer Smith Jr and Homer Smith III. Th~ ¡quote for tail coverage on our present policy in exorbitant. M~ Grove reported h~ had been to a meeting of the Washington Cities Insurance Authority and had heard ¡ that several other cities were self-insuring~because of the high cost of tail .insurance. A further report will be made at the next council meeting. Icouncilmember Hunt also reported the committee had met and received an update on I !the current year's budget. liParks/property. Councilmember Camfield reported that there has been a tentative date set for ribbon cutting at Kah Tai Lagoon Park for June 21, 1987, and that' they hope to be able to have someone to take care of the street trees and flowers ¡this summer. ': í I ¡Police/Fire/Animal Control. Councilmember Clise reported that the Fire Committee, ¡had met and they will be coming to council with some recommendations in the near \ ¡future. Mayor Shirley reported on the reservations made for the Associated Washing- ton Cities meeting on June 17, 18 and 19, 1987, in Yakima. OLD BUSINESS ORDINANCE NO. 2067 AN ORDINANCE APPROPRIATING THE SUM OF $1,250 TO THE CURRENT EXPENSE FUND, $5,947 TO THE LIBRARY FUND, $20,650 TO THE HOTEL/MOTEL TRANSIENT TAX FUND, $5,050 TO THE KAH TAl PARK FUND, $60,000 TO THE WATER-SEWER FUND, AND $60,000 TO THE EQUIPMENT RENTAL FUND, MAKING FINDINGS, AND DECLARING AN EMERGENCY. IMr Grove read the ordinance by title. Councilmember Hunt made a motion that the second reading be considered the third by title only which was seconded by Council- member Jones and passed unanimously by voice vote. Mr Grove again read the ord- inance by title. Councilmember Hunt made a motion to adopt the ordinance which was seconded by Councilmember Ison and passed unanimously by roll call vote. ORDINANCE NO. 2069 AN ORDINANCE PROHIBITING PEDESTRIAN AND BICYCLE TRAFFIC' ON THE NORTH AND WEST SIDES OF SIMS WAY/ STATE ROAD 20; MAKING VIOLATIONS HEREOF A TRAF- FIC INFRACTION; AND PROVIDING FOR PENALTIES AND ENFORCEMENT. I NEW BUSINESS , i ¡Revision to Shoreline Permit SH 12-86 for Port of Port Townsend. Bob Duffy of the ¡Shoreline Commission was recognized and explained that a request to revise the I !permit was submitted on May 7, 1987. The revision would relocate the fuel storag~ ¡tanks from the peninsula to the parking lot at the end of Jefferson Street in Port ¡Townsend. The tanks would be placed underground, not in an enclosed building as I ¡currently permitted. A new fueling dock would not be built; the current facility !would continue to be used. Appropriate changes would be made to the fuel lines. ¡!After a brief discussion, Councilmember Kenna made a motion to approve the Revis- ion to Shoreline Permint Application SH 12-86 under the following condition and I¡that the council make the following findings which was seconded by Councilmember Jones: i I I IThe design, material, and installation method of the facility and the emergency equipment associated with the façility shall be approved by the Port Townsend Fire Chief before construction begins. The Port Townsend City Engineer shall give pri~r ,approval for work occurring within the city right-of-way. I CONDITION i 1. The revision is to be reviewed by the Port Townsend City Council pursuant to WAC 173-14-064 and Section 6.404, "Revisions," of the shoreline master program. 2. No additional over water construction is proposed. ,3. No new structures, other than a change in the tank configuration, 14. Bob Duffy of 'I the Shoreline Commission reviewed the Permit Application SH 2-87. Councilmember. Hunt made a motion to approve the Substantial Development Permit SH 2-87 with the! following findings and conditions which was seconded by Councilmember Ison: I FINDINGS I~ The Jefferson-Port Townsend Shoreline Management Master Program requires that! a shoreline substantial development permit and variances be issued by the City of! ¡Port Townsend for development of the proposal. The following sections of the: program apply in the review of the proposal: 1.20, "Rurposes"; 4.101, "Aquatic i Designation"; 4.105, "Urban Designation"; 4.202, "Secondary Use"; 4.30, "Shorer lines of State-~~ide Significance"; 5.50, "Commercial Development"; 5.60 "Docks,! Piers, and Floats"; 5.110, "Marinas"; 5.140, "Parking Facilities"; 5.160, I ,"Residential Development"; 5.170, "Scientific and Educational Facilities"; and I 7.10, "Variances." ~ 2. The proposed use:- of the property involves residential, non-water dependent commercial, marina and marine transportation, and scientific and educational development. The project has been administratively classified as a secondary use in an urban and aquatic shoreline area. I'~ Variances are required from the following performance standards of the Jeff- : erson-Port Townsend Shoreline Management Master Program: 5.50.2 and 5.50.8, i ¡,"Commercial Development"; 5.60.10,"Docks, Piers, and Floats"; and Subsection' ,5.160.5, "Residential Development." A variance is -also requested of Policy 15.160.4, "Residential Development." ¡4. The following local regulations, plans, and documents apply to the proposed deve 1 opment: I a. City of Port Townsend Zoning Ordinance. b. City of Port Townsend Comprehensive Plan. c. Port Townsend Urban Waterfront Workbook. : 5. The following additional permits or approvals are required for the development of the proposed project: a. U S Army' Corps of Engineers Section 10 permit. b. Washington State Department of Fisheries and Department of Game hydraulic project approval. c. City of Port Townsend building permit and right-of-way approval. d. Washington State Department of Natural Resources lands lease. i 116. The proposal has been reviewed .according to the Washington State Environmenta~ POlicy Act by the City of Port Townsend as lead agency. The city has issued a ¡ ¡determination of non-significance for the proposal on March 3, 1987. The deter- : Imination states that the anticipated environmental impacts were adequately! addressed in the environmental checklist and the preparation of an environmental j limpact statement was not necessary. I 17. Notice of the application was made by publishing legal notices in the January 128 and February 4, 1987, editions of the Port Townsend Leader, posting the site or Ithe proposed development with notices on March 9, 1987, and notifying by mail' , ¡immediate adjacent property owners. Notice of the variance request was made by ¡ ¡publishing legal notices in the March 11 and March 18, 1987, editions of the Port! ¡Townsend Leader, posting the site of the proposed development with notices on ì !March 13, 1987, and notifying by mail immediate adjacent property owners, and ¡interested parties. , i~ Notice of the public hearing scheduled for March 18, 1987, was made by publish- ling a legal notice in the Port Townsend Leader on March 4, 1987, and notifying bYi mail immediate adjacent property owners and interested parties. Notice of the i variance request scheduled for April 22, 1987, was made by publishing a legal not~ ice in the Port Townsend Leader on April 8, 1987, and notifying by mail immediate, adjaCent property owners and iterested parties. The public hearing is held by the ¡Jefferson County Shoreline Management Advisory Commission. I '9. An inspection of the site was made on March 13, 1987, by members of the Jeff-! erson-Port Townsend Shoreline Management Advisory Commission and a representative! of the Jefferson County Planning 'and Building Department. ! 10. The Coastal Zone Atlas of Washington indicates minimal sand and gravel: ¡resources are present; no critical biological areas are present; moderate amoun~s !of coastal drift towards the Straits of Juan de Fuca in summer and toward the Por~ II,Townsend Boat Haven in the winter; and wave heights of greater than four feet; ,five percent of the time. I !11. The site of the project is an important element in the historic downtown Por~ ¡Townsend waterfront. There is no comparable site within Jefferson County. \ I , I I 348 MINUTES OF THE REGULAR SESSION OF MAY 19, 1987, Cont. ----,------------ -------------- I CONDITIONS 1. The design of all overwater facilities shall be certified by a registered ,professional engineer licensed in Washington State. Overwater facilities may I include but not be limited to the marina, the wharf, structures on the wharf, and ¡the ferry terminal. The facilities shall be designed to meet expected environmen~al stresses. An engineer familiar with the storm events of Port Townsend Bay shoud b e consulted for this certification. ~ Street lights shall be provided and installed on or near the project site an~ ¡be consistent with the design of the street lights currently along Water Street in ¡the downtown Port Townsend area. The number, design, and location shall be appro~ed ¡by the City of Port Townsend and installed at the time of project construction. 3. No back-lighted building materials shall be used in the development. ~ All outdoor lighting shall be shielded to prevent hazards to waterborne traf- fic and to prevent glare impacts to upland properties. 5. The final design of the proposed development to be submitted for building permit approval shall be reviewed and approved by the Washington State Office of Archaeology and Historic Preservation. 6. I~ Handicapped access provisions shall be included in all elements of the pro- posal, and the design approved by the City of Port Townsend engineer. 19. The permittee shall cooperate in the design and installation of any traffic improvements needed to mitigate traffic impacts identified in association with the project. The improvements shall be at the direction of the City of Port Town- send engineer. 10. Emergency service provisions, such as but not limited to fire truck access, emergency equipment, and operating techniques, shall be provided as required by the Port Townsend fire chief or other responsible official. 11. The interior promenade of the project shall be available to the general public. IThis interior space shall be designed to encourage intensive public use. Reason- ¡able restrictions for security and safety may be placed on public access. I~ Parking for the proposed project shall be provided according to the provisions of the Port Townsend Zoning Ordinance. No overwater parking shall be permitted. 13. The project shall not contain permanent residences. 114. No free-standing, on-premise advertising signs shall be used. All signs sha 1 ,¡COnfOrm to the City of Port Townsend Sign Ordinance. 15. No more than fifty percent of the gross area of the buildings shall be sued !for overnight accommodations. 'I~ The project shall be developed essentially the same as indicated in Site Plan "A"; however, the public area shall not be reduced below that indicated in the ¡site plan. Where dimensions are given, they shall not be reduced. The potential public area shall be included, if feasible. ~ The project shall include a permanent display that presents the history of IUnion Wharf. This display shall be at least fifteen square feet in size and shall ¡be located in the public area of the project. 118. Public restrooms shall be incorporated in the development of the marina. ¡These restrooms shall be available twenty-four hours a day to customers of the I . ¡manna. 119. No commercial fueling facility shall be included in the project. 20. There shall be no parking areas included in the project: however, this cond- ition does not preclude the designation of loading and service areas. I provided at the marina. After further discussion by the council, the motion passed unanimously be voice vote. David Goldsmith then explained that the next step will be for the permit to be sent to the Department of Ecology and then the Shoreline Hearing Board. I Michael Hildt reminded everyone of the parking variance for this project and the second Planning Commission Workshop on downtown parking on June 11, 1987. ORDINANCE NO. 2071 AN ORDINANCE AMENDING THE STORM WATER UTILITY SERVICE RATES FOR THE CITY OF PORT TOWNSEND, FOR ALL PROPERTY AND II PROPERTY USES OTHER THAN SINGLE FAMILY RESIDENCES, AND AMENDING SECTIONS OF ORDINANCE NO. 2054 AND CHAPTER 13.20 , OF THE PORT TOWNSEND MUNICIPAL CODE. , i !
