MINUTES OF THE REGULAR SESSION OF APRIL 15, 1986
The City Council of the City of Port Townsend met in regular session this 15th
day of April, 1986, at 7:30 P,M" in the Council Chambers of City Hall, Mayor
Brent Shirley presiding,
ROLL CALL

Councilmembers present at roll call were Jean Camfield, Janis Hunt, Frieda Imis-
lund, Glenn Ison, Vern Jones, Mike Kenna and Ila Mikkelson, Also present were
City Attorney Keith Harper, Public Works Director Ted Stricklin, and Clerk-
Treasurer David Grove,
MINUTES
Councilmember Hunt made a motion to approve the minutes of April 1, 1986, as
written and to dispense with the reading of them which was seconded by Council-
member Jones and passed unanimously by voice vote,

Councilmember Hunt made a motion that the bills and claims be paid from the
proper funds which was seconded by Councilmember Ison and passed unanimously
by voice vote,

The council received a letter dated March 27,1986, from James DeLeo, Port Com-
missioner for the Port of Port Townsend, requesting their support for the con-
struction of a new office building for the Port, Mayor Shirley indicated that
if the council had any input for the Port on this proposal, thpy should give
Mr, DeLeo a call,
The council received a letter dated April 1, 1986, from Murray Hayes opposing
the olacement of fish pens on Port Townsend's water front, Mayor Shirley
referred this to the Legislative/Environmental Committee,

The council received a letter dated April 1, 1986, from Peter Simpson, President
of the Board of Directors for the Jefferson County Historical Society requesting
that the city work with the carnival management to find anothe: location for
the Rhody Festival Carnival, Councilmember Imislund suggested the use of the
area next to the transit office, Mayor Shirley explained that they already use
half of that area to park their equipment, Mr, Simpson was recognized and ex-
plained that they loose approximately $250 in donàtion when th=y are forced to
close while the carnival is in operation, Councilmember Hunt explained that
this may be the last year for the carnival because of the high cost for insur-
ance, Mr, Bernie Lungren was recognized and spoke in favor of the continuance
of the carnival in the downtown area explaining that it generates one fourth of
the Rhody Festival budget, After a brief discussion, Mayor Shirley indicated
the city would work with the parties involved to do what we can,
I A claim for damages dated April 3, 1986, from Pat Burke in the amount of $154,00
was copied for the council for injuries alleged to have occured as the result of
a fall into a meter hole in front of Ray and Lil's Second Hand Store at the
corner of 3rd and Thomas Streets, Councilmember Ison made a motion to reject
this claim and turn it over to the insurance company alon§ with the claim from
! Rusty North which was seconded by Councilmember Jones and pas~ed unanimously by
voice vote, Councilmember Hunt asked Mr, Stricklin to explain their procedure
for limiting these hazzards which he did,

The council received a letter on April 4, 1986 from Leo White requesting that a
two hour parking zone be established on the northeast side of Monroe Street be-
tween Water and Washington Streets, Mayor Shirley referred this to the Street
Committee,
i The council received a letter dated April 4, 1986, from Peter Albrecht requestin§
i that the council investigate the fraudulent use of city revenues to plow away the
I' turf adjòcent to paved streets in Port Townsend, After a brief discussion, Mayot
I Shirley indicated that they will continue to maintain the shoulders of the roads
I unless they are directed to do otherwise by the council,

The council received a letter dated April 7, 1986, from Jay Gibson requesting that
the city change the name of Steve Street to Claremont, Mayor Shirley referred t~is
to the Street Committee,
The council received a letter on April 7, 1986, from Jean Anderson opposing the
two fish pens proposed for the downtown part of Port Townsend, Mayor Shirley
referred this to the Legislative/Environmental Committee,
The council received a letter dated April 8, 1986, from Zelda Scheyer, Secretary
¡ of the Port Townsend Arts Commission, reporting that at its April 7 meeting the I
Port Townsend Arts Commission voted to advise the Council that in its opinion the
vitality of the town depends upon a clear vision of its historic image, There-
fore the Arts Commission endorses any effort to develop and initiate programs to
that end, Mayor Shirley explained that this will be addressed later on the
I agenda.
A letter dated April 8, 1986, from David Kahley and Bart
II was copied for the council proposing that the city apply
Interagency Committee for Outdoor Recreation to renovate
I Mayor Shirley referred this to later on the agenda,
, A note dated April 8, 1986, from Mr, and Mrs, Arthur Tickner was copied for the
i council opposing the sewer rate increase because his budget won't stand anymore
II adjustments, Councilmember Hunt suggested that the city run an ad in the paper
reminding people why the sewer rates were increased,

The council received a letter dated April 10, 1986, from Julie McCulloch, Pres-
ident of the Port Townsend Civic Trust, recommending approval of the historic
properties program because it will encourage private investment in our historic
buildings, one of the city's most valuable assets, Mayor Shirley also referred
this until later on the agenda,
On April 15, 1986, the council received a letter from Joseph Hailey in oppositiom
to the Variance Application No, 186-01 of Douglas and Lynette Johnson, Mayor
Shirley referred this to the hearing scheduled for later in the meeting,
PUBLI C COMMENTS
Ms, Cheryl Van Dyke was recognized and reported that the Library Board is in the
process of selecting an engineer to evaluate the present library structure to
determine the feasibility of remodelling and adding to the present building.
They hope to have one selected by June 1, 1986,
Insurance for Homes Tour, Councilmember Camfield explained that Bob Carter of
Homer Smith Insurance suggested that the Homes Tour could avoid an additional
bill of $800.00 for insurance by approaching the city to include the tour as
a city function, She explained that all the income from the tour will be spent
on civic projects, Mr, Carter was recognized and explained the definition of
insured under the city's present insurance policy and indicated that it would
be possible to label the tour as a city function and have it covered under the
city.s insurance, Mr, Grove expressed support for the proposal pointing out
the concerns identified by the City Attorney in his memorandum of April 11, 1986
must be weighed against the benefit to the community, After a brief discussion,
Councilmember Kenna made a motion to authorize the inclusion of the homes tour
under the binder of the city if it is possible based upon a meeting between the
Mayor, City Attorney, and the insurance carrier which was seconded by Council-
member Jones and passed by voice vote with six councilmembers voting in the
affirmative, Councilmember Camfield abstained from voting,

the road and is suggesting that a gate be installed to restrict unauthorized use
of the road,
Proclamations, Mayor Shirley proclaimed April as"Masonic Public Schools Month'~
designating May 1, 1986 as"Law Day U,S,A,'~ and proclaiming the week of April 19-
April 27,1986, as"Port Townsend Spring Rally Cleanup and Recycling Week",
Citywide Cleanup, Mr, David Kahley was recognized and explained that the Main-
street Program has been organizing a city cleanup for the week of April 19 thru
27,1986, He indicated that from April 21st through the 25th Superior Refuse
I will pickup extra household garbage at no extra charge and described other
volunteer activities that week,
Undercover Drug Investigation, Police Chief Robert Hinton reported to the
council on the under cover investigation recently conducted by his department
'I which resulted in the arrest of two dealers and the seizure of thousands of
dollars worth of drugs and property including a motorhome, He thanked the
I council for the monitary support of the confidential fund, These funds may be
replaced by the sale of seized property,

COMMITTEE REPORTS
Parks and Property, Councilmember Ison reported that a new lease is being
prepared for the golf course property, Charlie Botts will be representing
the Park Board in negotiating the lease according to Mayor Shirley,
Finance, Councilmember Hunt reported that thecommittee is considering a bond
issue for storm sewers,
Community Services, Councilmember Mikkelsen reported that she thinks the
problems with garbage service have been resolved,
Legislative/Environmental, Councilmember Kenna reported that he anticipates
a recommendation from the Shoreline Advisory Board on the fish pens and the
proposed expansion of the Tides Inn Motel at the next meeting, He recommended
that the council conduct a public hearing on the proposed sign ordinance during
the regular meeting scheduled for May 20, 1986, He explained that he would
like the City Attorney to have the ordinance in proper form by that time,
PUBLIC HEARINGS
Variance Application No, 186-01 - Johnson, Mr, Grove explained that the
Planning Commission is recommending that the council deny this application
to build a garage-apartment on an empty lot between 807 and 823 Taylor Street
with a rear setback of ten feet rather than the required twenty feet, Mayor
Shirley opened the hearing to the audience, Mr, Kenneth Webb was recognized
and spoke against the application because he has a building on the property
line which would only be ten feet away from the proposed structure and would
be detrimental to his property as defined in section 6,10 of Ordinance No,1625, :
There being no further testimony, Mayor Shirley closed the hearing to the'
audience and turned the application over to the council for disposition,
After a brief discussion, Councilmember Camfield made a motion to deny the
application which was seconded by Councilmember Mikkelsen and passed unanimously
by voice vote,
I Variance Application No, 286-02 - Raab, Mr, Grove explained that the Planning
Commission is recommending approval of this variance to the setback requirements:
to allow an addition to an existing garage at 812 Harrison Street, Mayor Shirley
opened the hearing to the audience, Mr, Peter Raab was recognized and spoke'
in favor of his application explaining that the addition will allow him to
enclose equipment and materials presently out in the open, There being no furth~r
testimony, Mayor Shirley closed the hearing to the audience and turned the!
application over to the council for disposition, After a brief discussion,
Councilmember Kenna made a motion that the council find that the application
complies with Section 6,10 of Ordinance No, 1625 and grant the variance as
requested which was seconded by Councilmember Hunt and passed unanimously by
voice vote,

[Variance Request No, 486-01 - Sikes, Councilmember Ison made a motion that the
council conduct a public hearing on this application during the regular meeting
on May 6, 1986 which was seconded by Councilmember Hunt and passed unanimously
by voice vote,

NEW BUSINESS
Renovation of City Dock, Councilmember Ison reported that the Parks Committee
and Park Board are in agreement that the Mayor be authorized to sign a letter
of intent to apply for a grant from the Interagency Committee For Outdoor
Recreation, He made a motion to that effect which was seconded by Councilmember
Jones and passed unanimously by voice vote,
ORDINANCE NO, 2035
AN ORDINANCE ESTABLISHING A HISTORIC PRESERVATION
PROGRAM IN THE CITY OF PORT TOWNSEND TO PROMOTE
THE PRESERVATION OF HISTORIC PLACES, STRUCTURES,
AND OBJECTS, CREATING A HISTORIC PRESERVATION COMMISSION,
REVIEWING AND ADVISING THE MAYOR AND CITY
COUNCIL IN MATTERS CONCERNING HISTORIC RESOURCES
Mr, David Kahley was recognized and explained the background to the enabling
legislation which allows for a tax credit of the cost to restore historic
buildings, He explained the effect this would have on future property tax
revenues and the willingness it will stimulate in private investors, He indicat~d
that the ordinance does two basic things:l) Establishes a local review board, and
2) Establishes a class of historic properties which are targeted for encourage-
ment in restoration, After a brief discussion, Mr, Grove read the ordinance by
title, Councilmember Hunt made a motion that the first reading be considered
the second and the third be by title only which was seconded by Councilmember
Ison and passed unanimously by voice vote, Mr, Grove again read the ordinance
by title, Councilmember Hunt made a motion that the council adopt the ordinance
which was seconded by Councilmember Ison and passed unanimously by roll call vote,
ORDINANCE NO, 2036
AN ORDINANCE PROVIDING FOR MONETARY PENALTIES
FOR ANIMAL CONTROL VIOLATIONS, AND AMENDING
ORDINANCE NO, 1969 AND CHAPTER 8,04 OF THE
PORT TOWNSEND MUNICIPAL CODE 1
Mr, Grove read the ordinance by title, Councilmember Hunt made a motion that the
first reading be considered the second and the third be by title only which was
seconded by Councilmember Ison and passed unanimously by voice vote, Mr, Grove
again read the ordinance by title, Councilmember Hunt made a motion to adopt
the ordinance which was seconded by Councilmember Jones and passed unanimously
by roll call vote,

A letter dated March 31, 1986, from Kari Rokstad Samuelson from the Environmental
Review Section of the Washington State Department of Ecology to Mayor Shirley
! was copied for the Council commenting on the environmental checklist and deter-
mination of nonsignificance on the placement of three sets of s3lmon rearing
pens in Port Townsend Bay by Diversified Marine Industries, Mayor Shirley
referred this to that item scheduled under new busines later in the agenda,
A form letter dated April 8, 1986, from Mayor Shirley to several garbage customdrs
was copied for the council indicating that the Community Services Committee of
the council decided to conform with the existing ordinance and contract with
Superior Refuse,
