Also present were City Atto~ney Ted Stricklin, and Clerk-Treasurer David Grove. MINUTES Councilmember Kenna made a motion to approve the minutes of October 16, 1984, as written and to dispense with the reading of them which was seconded by Council- member Jones and passed unanimously by voice vote. BILLS AND CLAIMS following bills and claims were presented for payment: Current Expense $35,268.46 Street 6,961.41 Library 2,853.39 Park, 1,069.06 Emergency Medical Services 2,922.09 Federal Shared Revenue 1,000.00 Kah Tai Lagoon Park 97.78 Water-Sewer 19,910.17 Equipment Rental 2,843.98 Firemen's Pension And ReI ief 2,242.24 Memorial 12,269.56 i Payroll 27,729.52 I Mr. Grove explained that the Memorial Fund does not have sufficient funds at I this time to cover the 12,269.56 requested but will have by the 15th of the ! month when the warrants must be issued. I I I !The Council received a letter dated October 8, 1984, from Mayor Shirley to Wolf I' Bauer authorizing him to study the problem of shoreline erosion on Port Townsend beaches and present a report, final engineering designs, and implementation I stratagies. Mayor Shirley explained that this will be paid from a grant secured by the county and there will be no out-of-pocket expense to the city. IAn Environmental Checkl ist dated October 11, 1984, from Stanley Dick was copied : for the counci 1 on the short subdivision of lot 1 in the plat of San Juañ Estates ¡ into four lots. Mayor Shirley referred this to the Legislative/Environmental I Commi ttee. IAletter dated October 15, 1984, from David Goldsmith to Nancy Men. efe. e, chârrpers¡on of the Port Townsend Planning Commission, was copied for the council addressing ! three areas òi concern on Lakeside Industries Rezone Application No. 782-01 - access, buffering, and drainage. Councilmember Kenna reported that the Legislati e/ ¡Environmental Committee has met on this and will have a report. liThe Counci 1 received a letter dated October 16, 1984, from Eva Taylor requesting ,that the law be changed which assesses a penalty of $.50 on all water bills not 'I: paid by the tenth of the month. She suggests that the deadline be extended until ¡the 20th. Mayor Shirley referred this to the Water/Sewer/Street Committee. I IA letter dated October 17, 1984, from Frank Kilham opposing the rezone request of !Lakeside Industries was copied for the council. He sited as his reasons the lack ¡of performance standards, lack of proven need, traffic problems, and the adverse 'I impact in the residential area. Mayor Shirley referred this to the Legislative/ Environmental Committee. t{;A letter dated October 22, 1984, from Mary King, Statewide Coordinator of Washing on \ COMMUNICATIONS I I I I I 121 MINUTES OF THE REGULAR SESSION OF NOVEMBER 6, 1984 Cont. ----------- ------------ -------- ---- -- ------ ---------- -- ----- ------- --- ------ ------------ -- -- ---- ------- Main _Street Project to Mayor Shirley was copied for the Council indicating the National Main Street staff will visit Port Townsend on December 7, 1984. I The Council received a letter dated October 25, 1984, from Cathy Vickery of the Department of Retirement Systems advising the city that excess compensation to Verna Spindor increased the expense of her retirement by $2,998.92. Mr. Grove explained that this additional cost will be a potential liability with every retirement as long as the union contract includes a payment for any percentage ¡of unusedsickleave. After a brief discussion, Mayor Shirley referred this to the Finance Committee. I IA letter dated October 29, 1984 from Robert S. Burd to Mayor Shirley was copied ,for the Council notifying him of the U.S. Environmental Protection Agency's tentative determination to deny the city a variance from secondary sewage treat- ment. Mayor Shirley reported that the other cities involved may challenge this action, and if they do, he suggested that we be involved. I IA letter dated November 6, 1984, from Mayor Shirley to Richard Smith, President ¡of Rotary, was copied for the council indicating that if rotary pays the tap fee ¡fpr the ferry terminal park, the city will handle the monthly cost of water. IThe Council received a letter dated November 6, 1984, from Frank Kilham request- ¡ ing that the city appropriate $300 for water to be used at the community garden, i in 1985. Mayor Shirley indicated that he would like to add this to the budget. - ¡MaYOr Shirley indicated that the council received a report from Pol ice Chief Hinton on the intersection of Tyler and Jefferson Streets. Chief Hinton was recognized and reviewed the history of activity at this intersection. His recommendation was that if we are going to do anything at this intersection, ¡ lets do it right or not do anything at all. A discussion ensued on the possibili~y of stop signs, closing off Jefferson at the Bell Tower, or leaving the location' as is. At the conclusion of the discussion, it was a concensus of the council to lèave the intersection as is. PUBLIC COMMENTS Mr. David Johnson was recognized and asked the council to reconsider his request i for a variance to allow him to build a garage at 915 Taylor. He complained aboutl ¡the information given to the Ad-hoc committee formed to investigate what options .i might be available him, alledging that the committee met in violation of the I open meetings act. He explained that he has written a letter to each councilmemb~r individually disputing the report provided by city staff. A brief discussion! ensued on the activities of the adhoc committee. Mr. Harper explained that the I council took their action prior to the investigation of the Adhoc committee and the request was denied. He suggested that if the council did not want to recon- ¡ ¡sider his original request, that Mr. Johnson modify his plans and resubmit the I proposal in a different form. : I , Mr. Henry Edgarton was recognized and requested that the council adopt a resolu- : tion authorizing the Mayor to apply to the State of Washington for a Community Development Block Grant for Housing Rehabilitation and to provide shelter for the homeless. He explained that the application is in Olympia and can not be processed further without a more definite commitment on the part of the city. He emphasized the fact that the city can withdraw its request at any time even though the state would prefer"only firm commitments. He presented the council with a proposed budget for the project which was discussed at length by the council. Mayor Shirley indicated that the council could review the material and discuss the proposal with Mr. Edgarton individually and make a decision at the next council meeting. COMMITTEE REPORTS Legislative/Environmental. Councilmember Kenna reported that the committee met with Lakeside Industries to discuss the environmental concerns with regatd to their rezone request. He explained that certain covenants will be recorded on the deed to require measures to reduce the environmental concerns. In response ¡to Mr. Kilham's letter, he explained that the topography on the south side of ¡Sims Way does not lend itself to development for industrial purposes. Mayor Shirley proclaimed the month of November, 1984, as A1tzheimer's Desease Awareness Month. NEW BUSINESS RESOLUTION NO. 84-41 A RESOLUTION DECLARING PROPERTY SURPLUS AND AUTHORIZING SALE OR TRADE Counci1member Ison made a motion to adopt Resolution No. 84-41 by Counci1member Jones and passed unanimously by voice vote. i i which was seconded ORDINANCE NO. 2006 AN ORDINANCE APPROPRIATING THE SUM OF $4,300 TO CURRENT EXPENSE, $393 TO LIBRARY FUND, AND $5,000 TO THE HOTEL/MOTEL TRANSIENT TAX FUND AND DECLARING AN EMERGENCY Mr. Grove read the ordinance by title. He explained that the changes here have become necessary as a result of events during the past few months which could not have been foreseen at the time the budget was prepared last year. It will be ready for adoption at the next regular meeting. ¡Public Hearings. Counci1member Kenna made a motion that the counêi1 conduct pub1ia IhearingS on December 4, 1984, for Variance Request No. 884-02 Maier & Tavernakis and Variance Request No. 984-01 Wester which was seconded by Counci1member Imis- 11und and passed unanimously by voice vote.
