AN ORDINANCE RELATED TO WASTEWATER DISPOSAL AND TREATMENT CREATING A NEW CItAPTER 13.06 ESTABLISHING A CLASSIFICATION AND FEEING SYSTEM FOR CERTAIN COMMERCIAL, INDUSTRIAL AND GOVERNMENTAL GENERATORS OF WASTEWATER AND ESTABLISItING A SPECIAL COMMODITY CHARGE FOR THE GENERATION OF ltIGH STRENGTIt WASTE WITH HIGH VARIABILITY IN LOADINGS BY USERS SUCH AS THE WASHINGTON STATE FERRY SYSTEM WHEREAS, the City of Port Townsend is in the process of financing and constructing facilities for the treatment of wastewater through secondary treatment processes under State and Federal mandates; and WHEREAS, secondary treatment is a process that is sensitive to solids and organic loadings; and WHEREAS, certain commercial, industrial and governmental operations generate waste strengths that are greater than average for household wastes; and WHEREAS, it costs the City more to treat wastes that are greater in strength than average household wastes; and WHEREAS, the City desires to establish a system to be able to charge such commercial and industrial establishments their fair share of the costs of treatment; now therefore THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS: Section 1. A new Chapter 13.06 of the Port Townsend Municipal Code is hereby established to read as follows: CLASSIFICATION AND COMMODITY CHARGES FOR GENERATORS OF HIGH STRENGTH WASTEWATER 13.06.010 Purpose. The purpose of this Chapter is to establish special wastewater rates for users of the City's sewer system which generate certain high strength wastes or have high variability in waste loadings. It is intended that such special rates will provide a system of charges which equitably reflect the costs to the City of treating such wastes. 13.06.020 Definition of Terms. For the purposes of this Ordinance, the following words and phrases shall have the following meanings: a. City shall mean the City of Port Townsend. b. The facility shall mean the facility discharging to the City system. e. Biochemical Oxygen Demand (BOD) shall mean the amount of oxygen utilized in the biochemical oxidation of organic matter as measured in accordance with the appropriate procedure contained in Standard Methods and is expressed in milligrams per liter (mg/1). d. Deleterious Wastes shall mean wastes that are or may be corrosive or harmful to the wastewater treatment plant, pump stations, transmission lines, and/or plant effluent or sludge, or which may violate City, State, or federal standards. e. May shall-be permission, Shall be mandatory. f. Suspended Solids (SS) shall mean the residue from wastewater which remains after filtration in accordance with the appropriate procedures contained in standard methods. g. Pretreatment is the reduction of Biochemical Oxygen Demand (BOD), Total Suspended Solids (TSS), Fat, Oil and Grease (FOG), and Hydrogen-ion concentrations (pi-I), using screening, chemicals, equalization tanks, and other applicable methods and procedures. h. Average Daily Flow is the total monthly flow divided by the days of operation. 13.06.030 Standard Industrial Code Classifications. activities shall be assigned Standard Industrial Code classifications as indicated below: BUSINESS ACTIVITY GROUP CLASSI~CATION Restaurants/Taverns full service Fast Food Pre-packaged Servers Supermarkets with Deli, Bakery, etc. without Deli, Bakery, etc. Convenience Stores The folloWing types of business ~ SIC ~ ......................... SIC #4 Each commercial and industrial account shall be assigned to a SIC by the Director of Public Works based on a review of the wastewater discharges from each account. 19,06,040 Commodity_ Charge. A commodity charge shall be based on water use and wastewater strength. Charges shall be on a block rate, with the block rate increasing based on strength of the waste, as follows: COMMODITY CHARGE $/1000 GALLONS SIC #1 < 300 MG/L BOD OR TSS $2.08 SIC//2 301 - 500 MG/L BOD OR TSS $2.08 SIC #3 501 - 700 MG/L BOD OR TSS or $2.08 SIC #4 > 700 MG/L BOD or TSS or Variability in Loadings * $0.88 PER 1000 GALLONS, PLUS $0.98/LB BOD, PLUS $0.62/LB TSS * Such as Washington State Ferries or other users with instantaneous discharges or other use that muses wide swings in either wastewater quantity or strength that may cause collection or interceptor sewer concerns or potential adverse impacts on the wastewater treatment plant process. Water may be measured at the customer's water meter, or by installation of a sewage meter to be owned by the City. The City shall have installed and shall insure that a sewage meter is maintained, the costs of both of which shall be paid by the customer. These commodity charges shall be in lieu of the commodity charges for commercial uses otherwise provided for in Chapter 13.04, except for SIC #4 users, which shall pay the commodity charge under Chapter 13.04 and the charges provided for hereinabove 13.06.050 Introduction of Certain Substances Prohibited. Notwithstanding any other provisions herein, no facility shall be allowed to deposit any salt water toxic, potentially hazardous, or other material that may cause or inhibit the normal metabolic function of an aerobic biological waste treatment system, or which may be limiting, or in any way harmful to plant personnel. 3 13,06,060 Special Rates Established by Contract. Nothing in this Ordinance shall constrain or impair the City's ability to establish special rates for selected customers through separate contracts or agreements. Further, nothing in this Ordinance shall affect a pre-existing rate agreement between a customer and the City for the term of such Agreement(s). 13,06,070 Alternate Approach tO Determination of Rates. Any Sewer Customer who believes they have been assigned a Standard Industrial Code Classification which is not appropriate may choose to determine their sewer rate as follows and shall pay the City a monthly fee based upon the actual use of the City wastewater treatment plant as measured by parameters which shall be determined in accordance with the following procedures: a. Metering: The wastewater flow into the sewerage system will be metered at the point where the facility discharges wastewater into the City system. (The cost of installation and maintenance of the meter shall be paid by the facility.) The flow metering installation at the facility shall be calibrated quarterly and equipped with a totalizer. Daily maintenance by the facility shall include at least a check of the primary element of the flow-meter for obstructions and visual check of all other elements of the installation for normal operation. A daily log shall be kept by the facility in which all maintenance operations performed and any abnormalities observed shall be noted. The totalizer reading shall also be recorded daily in the log. At the end of each month, the average daily flow during the month shall be determined by using all the valid data collected during the month (Total flow divided by days of operation). b. BOD and Suspended Solids: The monitoring facility shall be equipped with an automatic liquid sampling device which shall be integrated with the flow- metering installation in such a manner that wastewater samples can be collected on a flow-weighted basis and stored. A composite sample shall be prepared weekly, as directed by the City, from all samples collected during a uniform 24-hour period. The BOD and SS of each sample shall be determined and recorded in the log. At the end of each month, the average BOD and TSS during the month shall be determined by using all the valid data collected during the month. After a period of one year, the City may reduce the frequency of monitoring (provided there are no other constraints such as a Department of Ecology permit precluding less frequent monitoring). c. The facility shall maintain records of all information resulting from any monitoring activities. Such records for all samples shall include: 3. 4. 5. 6. The date, exact place, method and time of sampling. The names of persons taking the sample. The date the analysis was done. The names of persons doing the analysis. The analytical techniques used. The results of the analysis. 4 d. The data collected shall be used by the City to calculate the share of the total Maintenance and Operation Expenses which shall be charged to the facility. The method of calculation of Maintenance and Operation Expenses to be charged shall be as follows: 1. CN - cost factor x monthly plant O&M cost. 2. Cost Factor- (Vf/Vc) (0.2 + 0.4 BODf/BODc + 0.4 TSSf/TSSc). 3. Vf = Average daily wastewater flow of the facility during billing period (gallons). 4. Cf -- O&M charge to the facility during billing period. 5. f = The facility. 6. c = City of Port Townsend wastewater treatment plant. 7. Vc = Average daily wastewater flow for the City of Port Townsend wastewater treatment plant during billing period (gallons). 8. BODf = Average daily five-day BOD concentration of wastewater from the facility during billing period. 9. BODe = Average daily five-day BOD concentration of total plant wastewater during billing period. 10. TSSf = Average daily TSS concentration of wastewater from the facility during billing period. 11. TSSc = Average daily TSS concentration of wastewater of total plant during billing period. e. Additional charges: Lab Testing: One set of BOD, FOG, TSS, VSS, and pH tests will be required on a composite sample collected by the City representative on a weekly basis while the facility discharges to the City sewerage system. The City shall have free access to the facility and the records of operation and maintenance. The records of operation and maintenance shall be kept at the facility and shall be made available to the City during the site visit by the City. The City shall have access to the facility at reasonable hours without prior notice. Section 3. This ordinance shall become effective sixty days after its passage and publication.
