as the funds are limited and only one application per County will
be approved, therefore, the Olympic Trail proposal will be
forwarded from Jefferson County.
Contractors Working in City Streets. Councilmember Jones
questioned if there a way to require contractors working in public
streets to notify neighborhoods what they are doing. A brief
discussion of work being done by the telephone company ensued.
Forrest Corridor Purchase. Mr Hildt reported that the State is
ready to go forward with the sale of the property to the Cioty for
$22,500.00, and that he has met with Roger Evans and his two sons
although they are not ready with a specific proposal for their
property. The property acquired by the City would be used to
negotiate with them with the goal of preserving the south side of
the forest corridor which is a community goal adopted in 19B8.
Earthquake Preparedness. Councilmember McCulloch suggested that
the City discuss focusing future HUD loans on seismic retrofit.
Councilmember McCulloch reported Ted and Cynthia Simmons have put
together a slide show of the earthquake in Santa Cruz have specific
recommendations of how a municipality could handle a similar
disaster and that she would like to have the slides ShO~l at a
meeting after the first of the year. A discussion of problems and
issues of historic preservation and seismic safety ensued.

MINUTES OF THE SPECIAL SESSION OF SEPTEMBER 28, 1992
The City Council of the City of Port Townsend met in special
session this 28th day of September, 1992, at 7:00 PM in the Council
Chambers of City Hall, Mayor John M Clise presiding.
ROLL CALL
Councilmembers present at Roll Call were Vern Jones, Norma Owsley,
Robert Sokol, Sheila Westerman and Cindy Wolpin. Councilmember
Jean Camfield arrived at 7:10 PM and Councilmember Julie McCulloch
was excused. Also present were Clerk-Treasurer David GroVE!, City
Attorney Dennis McLerran, City Planner Dave Robison and City
Engineer Randy Brackett.
PUBLIC HEARING
Mr Robison gave a brief overview of draft #9 of the EnvironmEmtally
Sensitive Areas Ordinance, the changes made to the ordinance since
the joint hearing with the Planning Commission on July 15" 1992,

and the procedures manual. Mr McLerran reviewed the ordinance
amending the State Environmental Policy Act policies. Mayor Clise
opened the hearing to the Public. David Wren was recognized and
spoke against the ordinance and stated that if the ordinance was
changed to apply to the whole city of Port Townsend, he would
support it. Michael Neubauer was recognized and spoke against the
ordinance stating his concerns with the single ownership clause.
Dana Roberts was recognized and spoke to encourage early adoption
of the ordinance stating that prevention is better than cure when
it comes to groundwater recharge and aquifer protection. Doug
Simpson was recognized and spoke in favor of the ordinance
representing the Stormwater Wetlands Advisory Committee. Mr
Simpson spoke as a concerned citizen about affordable housing
ramifications and the "taking" of one's property needs to be
addressed. Paula Mackrow was recognized and spoke in favor of the
ordinance stated that we should not delay any longer as people are
in favor adequate wetland protection, large buffers, and workable
mitigation. Betty Wren was recognized and suggested that
allowances and some flexibility be made in the 9900 square foot
ruling. Mr McLerran responded to the "takings" and "due process"
issues stating that the ordinance does address these issues in
several ways and explained them. Mr Neubauer was recognized and
stated that he cannot build on his second lot if the ordinance is
adopted but that someone else could and that this is a taking of
his property. Margaret Caro was recognized and spoke in favor of
the ordinance stating that implementation will cost money but far
less that liabilities associated with unregulated development.
Janeen Hayden was recognized and spoke in favor of the ordinance
although she does not think it is perfect and needs further work.
Ms Hayden then discussed the categories of wetlands, viability
issues, maintenance bonding, and buffers. Kathryn Jenks was
recognized and commented that the appeal fee should be low. Greg
Bennett was recognized and stated that the ordinance is not perfect
and does not do enough for the environment but will save taxpayers
some money. Bob Rickard was recognized and addressed text added to
the ordinance since it was discussed at the Planning Commission.
Mr McLerran responded that the intention of the language is that
the maps are not firm a~d that there will be staff determinations
on the ground in the field and then explained "aggrieved parties".
A brief discussion of definitions in the Growth Management Act and
the State Environmental Policy Act ensued. David Wren was
recognized and added his voice to those questioning building new
wetlands to replace established natural wetlands stating that there
should be very little flexibility offered in the destruction of
natural wetlands. Dana Roberts questioned if you want to add a few
things in print and correct some minor typing errors, what date
should they be in by. Mayor Clise responded that they should be in
by the next couple of days. There being no further testimony,
Mayor Clise closed the hearing to the Public.
A discussion of regulations for the entire city, affordable housing
in environmentally sensitive areas, lot size and reasonable use
exception process, property needed for storm drainage, and then
items throughout the ordinance section by section through #7
ensued.
RECESS
Mayor Clise declared a recess at 9:22 PM. The meeting reconvened
at 9:26 PM. Discussion of the remaining sections of the ordinance
continued.

The City Council of the City of Port Townsend met in regular
session this Fifth day of October, 1992, at 7:00 PM in the Council
Chambers of City Hall, Mayor John M Clise presiding'.
ROLL CALL
Councilmembers present at Roll Call were Jean Camfield, Vern Jones,
Norma Owsley, Robert Sokol, Sheila Westerman and Cindy Wolpin.
Councilmember Julie McCulloch was excused. Also presen't were
Clerk-Treasurer David Grove, City Attorney Dennis McLerran,
Director of Planning and Building Michael Hildt and City Engineer
Randy Brackett.
INTRODUCTION
Mayor Clise introduced Lisa Enarson the new Planning Commission
Member.
PUBLIC COMMENTS
David Wren was recognized, stated that his corporation prior to
moving to Port Townsend seven years ago was called Ecological
Research Associates, Inc, and does not represent any group, then
stated that he is very dissatisfied with Draft #9 of the
Environmentally Sensi ti ve Areas Ordinance. Mr Wren prE~sented
"Notice for Non Inclusion" forms for three real estate parcels, a
letter dated June 12, 1991, from Harold W Kerster, Professor,
Environmental Studies, California State Uni versi ty, Sacramento,
commenting on an Environmentally Sensitive Area ordinance and an
undated text from Michael D Atkins, PhD, Environmental SciHntist,
stating that the entire area of the City of Port Townsend and even
the entire Quimper Peninsula should be designatE~d as
environmentally sensitive.
Robert Gibson was recognized was recognized and spoke against the
Environmentally Sensitive Areas Ordinance. Mr Gibson presented a
"Notice for Non Inclusion" form for his property.
Ruth Short was recognized, spoke against the EnvironmE~ntally
Sensitive Areas Ordinance and presented a "Notice for Non
Inclusion" form for seven real estate parcels of her propE~rty as
well as one form for Robert and Eleanor Such.
Eric Dobson, owner of Chula's Restaurant, was recognized and spoke
against the sign code stating that he no longer has any form of
off-premise advertising to let people know where he is loca'ted and
that it has hurt his business as well as possible sale of 11is
