ORDINANCE NO. 2905
AN ORDINANCE OF THE CITY OF PORT TOWNSEND, WASHINGTON,
AMENDING PORT TOWNSEND MUNICIPAL CODE CHAPTER 2.06, CITY CLERK,
TO ADD SECTION 2.06.035, DESIGNATING THE CITY CLERK AS PUBLIC
RECORDS OFFICER
WHEREAS, pursuant to Port Townsend Municipal Code 2.06.030 Powers and Duties of
the City Clerk, the City Clerk has the responsibility for records management for the City; and
WHEREAS, the Washington State Legislature enacted Chapter 483, Laws of2005
(Second Substitute House Bill 1758), which provides among other things that each local agency
shall appoint and publicly identify a public records officer whose responsibility is to serve as a
point of contact for members of the public in requesting disclosure of public records and to
oversee the City's compliance with the public records disclosure requirements the Public
Records Act, and further, to take steps reasonably calculated to provide notice to the public of
the name and contact information of the public records officer,
NOW THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
SECTION 1. Chapter 2.06, City Clerk, is hereby amended to include a new section
to read as follows:
2.06.35
Clerk as Public Records Officer.
The City Clerk shall serve as the City's public records officer, whose responsibility is to
serve as a point of contact for members of the public in requesting disclosure of public
records and to oversee the City's compliance with the public records disclosure
requirements of Chapter 42.17 RCW (Public Records Act). The City Clerk shall take
steps reasonably calculated to provide notice to the public of the name and contact
information of the City's public records officer.
SECTION 2. Severability. If any section, subsection, sentence, clause, phrase or word
of this ordinance should be held to be invalid or unconstitutional by a court of competent
jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or
constitutionality of any other section, subsection, sentence, clause, phrase or word of this
ordinance.

This ordinance shall take effect and be in force five days after the date of its publication
in the manner provided by law.
Adopted by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this first day of August, 2005.
