ORDINANCE NO. 2903
AN ORDINANCE VACATING BLOCKS 2 AND 3 OF BORNSTEIN'S ADDITION
TO THE CITY OF PORT TOWNSEND, INCLUDING ALL STREET RIGHTS-OF-
WAY AND ALLEYS LYING THEREIN; RESERVING UTILITY AND NON-
MOTORIZED EASEMENTS AS CONDTIONS OF THE PLAT VACATION; AND
ESTABLISHING AN EFFECTIVE DATE

WHEREAS, the Hearing Examiner for the City of Port Townsend has considered a
Plat Vacation request submitted under File No. LUP03-125 (Windstorm & Breunig), and
following due notice has held a public hearing upon the request; and
WHEREAS, the Hearing Examiner issued a Findings of Fact, Conclusions of Law and
Decision on December 26, 2003 approving the Plat Vacation request with conditions; and
WHEREAS, the conditions of approval are acceptable to the applicant, who now
wishes to finalize the Plat Vacation; now, therefore,
NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
Section 1.
Subject to the conditions in Section 2 of this Ordinance, Blocks 2 & 3 of
Bornstein's Addition to the City of Port Townsend together with the street and
alley rights-of-way shown therein are hereby vacated in their entirety.

Section 2.
That the Plat Vacation aforementioned is conditioned on the following:
1. Along the east line of the former Bornstein's Addition, a non-exclusive
25 foot wide utilities and non-motorized access easement is herein
reserved for the benefit of the City of Port Townsend and the public in
general.
2. Along the north line of the former Bornstein's Addition, a non-exclusive
30 foot wide underground utilities and non-motorized access easement is
herein reserved for the benefit of the City of Port Townsend and the
public in general.
3. This Ordinance shall be recorded by the City at the applicant's expense
with the Jefferson County Auditor.
Section 3.
This ordinance shall take effect upon its passage, approval and publication in
the form and manner provided by law, and after it has been recorded by the
City with the Jefferson County Auditor pursuant to Section 2 of this ordinance.
Adopted by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this eighteenth day of July 2005.
