AN ORDINANCE VACATING THAT PORTION OF E STREET STREET
LYING EAST OF ASH STREET AND WEST OF REDWOOD STREET,
ADJACENT TO BLOCKS 6 AND 9 OF THE WEBSTER'S ADDITION TO
THE CITY OF PORT TOWNSEND; ESTABLISHING CONDITIONS TO
THE STREET VACATION; AND ESTABLISHING AN EFFECTIVE DATE
WHEREAS, the City Council for the City of Port Townsend has
considered Street Vacation Application 9403-03, and following due
notice has held a public hearing upon the application, and
WHEREAS, the City Council for the City of POrt Townsend adopted
Findings of Fact and Conclusions dated April 18, 1994, now,
therefore,
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS
FOLLOWS:
Section 1. That the E Street right-of-way lying between the Ash
and Redwood Street rights-of-way is hereby vacated.
Section 2. That the street vacation aforementioned is
conditioned, however, on the following:
The Street Vacation Agreement and the Real Estate Exchange
Agreement referenced in the Findings of Fact and Conclusions
of the City Council shall be signed and recorded at the
Jefferson County Auditor's office simultaneously with this
ordinance.
A 20-foot-wide utility easement shall be reserved within E
Street. The 20-foot easement shall be measured 10 feet on
center from the existing sewer main.
The applicant shall apply for a boundary line adjustment.
If the boundary line adjustment is approved the approval
shall be recorded at the Jefferson County Auditor's Office
simultaneously with this ordinance.
A certified copy of this ordinance shall be recorded by the
city clerk in the office of the Jefferson County Auditor.

Section 3. The standard fee for street vacations, of one-half
the appraised value of the land, shall be waived as the City owns
all properties lying to the south of the subject street, and the
property owners lying to the north of the subject street will
dedicate back to the City one-half of the property which would
ordinarily attach to their properties through the normal
operation of law.
Section 4. This ordinance shall take effect upon its passage,
approval and publication in the form and manner provided by law,
and after it has been recorded with the Jefferson County Auditor
pursuant to Section 2 of this ordinance.
