ORDINANCE 2901
AN ORDINANCE OF THE CITY OF PORT TOWNSEND, WASHINGTON,
EXTENDING A MORATORIUM ON THE FILING OF APPLICATIONS
FOR LICENSES, PERMITS AND APPROVALS FOR ADULT BUSINESSES
The Council makes the following Findings:
1. The City adopted Ordinance 2858 on May 3, 2004 providing for a moratorium on approvals
for adult businesses pending approval of rebrulations on the potential location and regulation
of adult businesses; and
2. The City Planning Commission has held public hearings on possible zoning regulations,
and needs additional time to hold additional hearings to consider properly and carefully the
potential location and regulation of adult businesses, and to forward a recommendation to
the City Council; and
3. The City needs additional time to consider the forthcoming recommendation of the
Planning Commission, and to properly and carefully the potential location and regulation of
adult businesses; and
4. The City Council finds that the City's land use integrity and planning process will suffer
significant harm unless applications for licenses, permits and approvals for adult businesses
are prohibited until the planning process is completed; and
5. The City Council finds that protection of the health, safety and welfare supports
establishment of a moratorium on applications for licenses, permits and approvals for adult
businesses; and
6. RCW 35A.63.220 relating to Code cities like Port Townsend and 36.70A.390, a section of
the Growth Management Act (Ch. 36.70), authorizes the City to adopt a moratorium on
development permits and approvals for adult businesses and thereafter to hold a public
hearing on the moratorium within 60 days of the commencement of the moratorium;
NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
SECTION I. Moratorium Established. For the reasons set forth in the above Findings, the
moratorium imposed by Ordinance 2858 upon the filing with the City or the courts of any
applications for licenses, permits and approvals for "adult entertainment facilities" is re-imposed,
re-enacted, and continued in effect for six months from the effective date of this Ordinance or until
adult business zoning regulations are adopted by the City Council, whichever is sooner. "Adult

entertainment facilities" are defined for purposes ofthis ordinance in Exhibit A to Ordinance 2858,
incorporated by reference, a copy of which is available for viewing and copying at the office of the
City Clerk, City Administration, 181 Quincy Street, # 201, Port Townsend, Washington.
SECTION 2. Severability. If any provision of this ordinance or its application to any
person or circumstance is held invalid, the remainder of the ordinance, or the application of
the provision to other persons or circumstances is not affected.
SECTION 3. Effective Date. This Ordinance shall take effect immediately after passage.
Publication of this ordinance shall be by summary thereof consisting of the title.
Adopted by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this 20th day of June 2005.
