TO THE CITY OF PORT TOWNSE~; ESTABLISHING CO~ITIONS
TO THE ST~ET VACATION; A~ ESTABLISHING AN EFFECTIVE
DATE
WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation
Application No. 8912-05, and following due notice has held a public hearing upon the
application, and
WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact
and Conclusions on April 3, 1990, now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS
FOLLOWS:

That the following street and alleys are hereby vacated:
The alleys lying within Block 90 and 98 AND that portion of
Oneonta Street lying between Blocks 90 and 98, All in Fowler's
Park Addition to the City of Port Townsend, as per Volume 2
of Plats, page 16, records of Jefferson County, Washington.
That the street vacation aforementioned is conditioned, however,
on the following:
All lot lines within Blocks 90 and 98 of the Fowler's Park
Addition to the city of Port Townsend shall be vacated by
ordinance of the City:
The applicants shall dedicate to the City of Port Townsend, by
Dedication Deed, the following described property:
Lots 1 thru 10, Block 98, Fowler's Park Addition to the City of
Port Townsend, as per Volume 2 of Plats, page 16, records of
Jefferson County, Washington.
EXCEPT those portions of Lots i thru 5 of said Block 98, being
more particularly described as follows: Beginning at the
southeast comer of said Lot 1: Thence north 88°32'15'' west
99.91 feet to the southwest corner of said Lot 1; Thence north
24038'09" east 147.48 feet; Thence north 32°07'01.. east 79.51
feet to the east line of said Lots 1 thru 5; Thence south 1°05'18"
west along said east line 203.99 feet to the POINT OF
BEGINNING.
C. A certified copy of the ordinance vacating the street and alleys shall be
recorded by the City in the office of the Jefferson County Auditor upon receipt
by the City Attorney of all dedications required. The street vacation shall be
cancelled and become automatically null and void one year after City Council
action if said dedications are not made.
D. Upon and after the vacation of the lot lines set forth in subsection 2 (A)
of this Ordinance and following recordation of the Dedication Deed required
by subsection 2 (B) of this Ordinance, a certified copy of this Ordinance shall
be recorded by the City Clerk in the Office of the Jefferson County Auditor,
following the publication hereof in the form and manner provided by law.
Section 3. The standard fee of one-half of the appraised value of the land shall be waived
as the property owner has dedicated right-of-way to the City which is equal in value to the
right-of-way being vacated; and said dedication (Dedication Deed recorded 8/11/94, File No.
374447) is hereby accepted by the City.
Section 4. This ordinance shall take effect upon its passage, approval and publication in
the form and manner provided by law, and after it has been recorded with the Jefferson
County Auditor pursuant to Section 2 of this ordinance.
