HomeMy WebLinkAbout2426 Establishing Separate Offices for the City Clerk and the City TreasurerOrdinance No. 2426 AN ORDINANCE REPEALING CHAPTER 2.06 OF THE PORT TOWNSEND MUNICIPAL CODE AND ADOPTING NEW CHAPTERS 2.06 AND 2.12, THEREBY TERMINATING THE COMBINED OFFICE OF THE CITY CLERK-TREASURER AND SEPARATING THAT OFFICE INTO THE OFFICE OF THE CITY CLERK AND THE OFFICE OF THE CITY TREASURER, ESTABLISHING AN EFFECTIVE DATE OF JANUARY 1, 1995 WHEREAS, as authorized by state law, by Ordinance No. 1669, effective January 1, 1974 the city council combined the office of the city clerk and city treasurer, abolished the office of treasurer, and created the office of clerk-treasurer, to be appointed by the mayor; WHEREAS, the city council finds that given the complexity of the duties handled by this combined position, the time demands of the many roles of a clerk-treasurer, and the changing face of local government requiting increasingly specialized skill and experience, it is in the best interests of the City that the duties of the clerk-treasurer be performed by separate officials; .NOW THEREFORE, the City Council of the City of Port Townsend does ordain as follows: Section 1. Qualifications. Power and duties. CompensatiOn. Separate office - Effective date. 2.06.010 Position.created - Effective date. The position of city clerk is established and created, effective as of January 1, 1995. The city clerk shall be appointed by the mayor, subject to confirmation of a majority vote of the city council, to serve at the pleasure of the mayor; provided however, that until such time as a city clerk is appointed and confirmed or in the absence or vacancy of the city clerk position, the mayor may appoint an acting city clerk to perform all duties of the city clerk as provided in this chapter. 2.06.020 Qualifications. The person so appointed shall have a minimum of three years experience in duties related to the position, and a bachelor's degree in business administration, public administration, or any equivalent combination of education and experience which equips the person with the knowledge and skills required to perform the job. 2.06.030 Powers and Duties..The duties of the city clerk shall be as set out in RCW Title 35, and as specifically set out in RCW 35.23.121, as now or later amended, and any other duties as required by statute or city ordinance. The powers, duties and responsibilities of the city clerk shall be subject to the direction and supervision of the city administrator. 2.06.040 Compensation. The compensation to be paid to the city clerk shall be fixed by the city council in the yearly budget. 2.06.040 Separate Office - Effective date. The combined office of clerk-treasurer in effect as of January 1, 1974, shall cease as of January 1, 1995, and separate offices of the city clerk and city treasurer be thereafter established. The position of city treasurer is established and created, effective as of January 1, 1995. The city treasurer shall be appointed by the mayor, subject to confirmation of a majority vote of the city council, to serve at the pleasure of the mayor; provided however, that until such time as a city treasurer is appointed and confirmed, or in the absence or vacancy of the city treasurer position, the mayor may appoint an acting city treasurer to perform all the duties of the city treasurer. 2.12.020 Qualifications. The person so appointed shall have a minimum of three years of management experience in duties related to the responsibilities of the position, and a Bachelor's degree in finance, accounting, public administration, or equivalent experience and specialized training. 2.12.030 Powers and duties. The powers, duties, and responsibilities of the city treasurer shall be subject to the direction and supervision of the city administrator, and shall include, without limitation, the following: A. Receive and safely keep all money and other negotiable instruments which come into the city treasury, and follow all laws of the State of Washington regarding the accountability therefor; B. Keep such books, accounts, and make such reports as may be required by the division of municipal corporations of the office of the state auditor; C. Exercise the duties of the city treasurer as provided in RCW Title 35, including without limitation, Section 35.23.131; D. Exercise the duties and authorities of auditing officer as provided in RCW 42.24.080, as applicable to the city; E. Perform such other duties as directed by the city administrator, mayor, or city council, or as provided by city ordinance or state law. CA§ {City Clerk & City Treasurer) 4 2.12.040 Compensation. The compensation to be paid the city treasurer shall be fixed by the city council in the yearly budget. 2.12.050 Separate office - Effective date. The combined office of clerk-treasurer in effect beginning January 1, 1974 shall cease as of January 1, 1995, and separate offices of the city clerk and city treasurer be thereafter established. (Ord. __, §1, 1994.) Section 3, Severability. If any provision, section, clause or phrase of this ordinance or its application to any person or circumstance is held invalid or unconstitutional, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. This ordinance shall become effective five days after its approval and publication in the form and manner required by law.
