HomeMy WebLinkAbout2438 Rezoning and Amending the Official Zoning MapAfter recording please return to~ City of Port Townsend Building and Commmnnity Development S40 Water Street Port Townsend, WA 98368 ORDINANCE NO. 2438 AN ORDINANCE REZONING LOTS 1-7 OF BLOCK 188 OF THE EISENBEIS ADDITION TO THE CITY OF PORT TOWNSEND, LOTS 1-4 FROM C-3 to C-2 AND LOTS 5-7 FROM R-1 to C-2; AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF PORT TOWNSEND; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, due hearings have been held and appropriate Findings and Conclusions made as provided for by Ordinance No. 1625, as amended, of the City of Port Townsend, and WHEREAS, the City Council for the City of Port Townsend has approved of the rezoning of the property described below pursuant to its Findings of Fact and Conclusions, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DOES ORDAIN AS FOLLOWS: Section 1. The official Zoning Map of the City of Port Townsend is here and hereby amended to change from C-3 to C-2 zoning those lands in Port Townsend described as follows: LOTS 1-4 of Block 188 of the Eisenbeis Addition the City of Port Townsend, situate in the City of Port Townsend, Jefferson County, Washington. and is hereby further amended to change from R-1 to C-2 zoning those lands in Port Townsend described as follows: LOTS 5-7 of Block 188 of the Eisenbeis Addition the City of Port Townsend, situate in the City of Port Townsend, Jefferson County, Washington. The following conditions shall apply to any development or grading on the above-referenced property and the same shall be recorded with the Jefferson County Auditor and run with the land as a condition~of approval of the zoning change made by this ordinance: The uses established on the subject rezoned C-2 property shall be limited to a 6,000 square-foot professional office and retail building. Any other future buildings, expansions, or uses shall be subject to a conditional use permit and reviewed by the Planning Commission and City Council. o Prior to issuance of a certificate of occupancy, the applicant shall abandon the existing 2-inch water line connecting to 8th Street and connect instead to the existing 6-inch line in 10th Street. No system development charges or tap fees will be applicable unless the applicant requests a larger tap size. The applicant will pay direct City labor and material costs for constructing a same-sized tap. o Prior to issuance of a certificate of occupancy, the applicant shall purchase and install a fire hydrant at the corner of 10th Street and Hill Avenue per the Uniform Fire Code. Prior to issuance of building permits, utilities shall be undergrounded per the Port Townsend Gateway Development Plan. o Prior to issuance of a certificate of occupancy, the applicant shall provide curbing along Sims Way from 10th Street to the platted alley within Block 188 per the Port Townsend Gateway Development Plan. o To mitigate impacts associated with land disturbing activities, prior to issuance of a building permit the Director of Public Works shall review and approve a Temporary Erosion and Sediment Control Plan developed consistent with the standards of the Washington State Department of Ecology Storm Water Management Manual. o To mitigate impacts on air quality from dust generated during site development, the proponent shall be required to water the site as necessary, remove mud from construction vehicles' tires before leaving the site and sweep impervious surfaces, including abutting city streets, where soil may be tracked. Chemical dust suppressants shall not be used. Page 2 of 4 (Port Townsend, 1-3-95) o o 10. 11. Impacts associated with emissions and odors from heating, ventilation and air conditionin~ units shall be mitigated by installin~ units that meet current air quality standards as required by the Uniform Buildin~ Code (UBC) and the Washington State Indoor Air Quality and Ventilation Code. To mitigate impacts associated with surface water runoff, the proponent shall submit an engineered Storm Drainage Plan includin~ existin~ and proposed run-off volumes for review and approval by the Public Works Director. The drainage plan shall incorporate the storm drainage criteria of the Washington State Department of Ecology Storm Water Management Manual. The plan shall also include an oil/water separator to reduce impacts on surface waters, to~ether with a perpetual maintenance a~reement for such facilities. The plan shall be of sufficient detail to clearly illustrate that the "Best Management PraCtices" utilized are adequate to treat and control the runoff. If the proposed discharges resUlt in a net increase in runoff, the applicant shall provide a proportionate fair- share contribution not to exceed $2,000 towards the improvement of regional drainage facilities. The amount and timin~ of the fair share contribution shall be proposed by the applicant and approved by the Director of Public Works prior to the issuance of any ~radin~ or building permits for the subject property. Standard construction practices and traffic control measures shall be employed to minimize the risk of an accident. All applicable state laws concernin~ workplace.safety shall be followed on the proposed project site during construction. To mitigate impacts associated with noise ~enerated from on- site development activities, the outdoor construction period shall be limited to Monday through Friday from 7am-6pm, excludin~ national holidays. Any exceptions needed for extraordinary circumstances must be approved in advance by the Director of Buildin~ and Community Development. To mitigate visual impacts, the proposed building shall be two stories high and shall not exceed 35-feet as measured from the existin~ elevation of approximately 40-feet ~above mean-sea-level. Datum for this height limit shall be a point on the centerline of 10th Street, 55-feet west of its intersection with the centerline of Hill Avenue prior to the street vacation. The principle buildin~ materials shall be wood, ~lass and possibly brick. Consistent with the Port Townsend Gateway Development Plan, the organization of the site shall be in a hierarchical arrangement from buildin~ to Pa~e 3 of 4 (Port Townsend, 1-3-95) 12. 13. 14. backdrop. ViewscaPes of the Port Townsend Bay and surrounding areas shall be retained by refraining from planting trees along Sims Way. Prior to issuance of a building permit, the applicant shall submit a final landscaping plan for review and approval by the Director of Building and Community Development. The Landscape Plan shall detail the enhancement of the City right-of-way abutting Triangle Park #1 and preserve existing vegetation on the northwesterly boundary shared with 10th Street. Per the Port Townsend Gateway Development Plan , plants shall be placed in a hierarchical arrangement from low-lying species along Sims Way to the existing trees at the rear of the lot. Selected species shall be native or drought-tolerant and shall be limited to species which do not exceed a height of 35-feet at maturity. To mitigate impacts associated with light and glare, the applicant shall provide hooded or shielded exterior fixtures for site lighting. To mitigate traffic safety impacts associated with access to and from Sims Way, ingress and egress from the site shall be exclusively from 10th Street. The current access from Hill Avenue shall be closed. Section 3. This Ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law.
