AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING
THE PORT TOWNSEND MUNICIPAL CODE CHAPTER 3.36, PERMIT
AND APPLICATION FEES, SECTION 020, PUBLIC WORKS SERVICE
FEE SCHEDULE, AUTHORIZING THE PUBLIC WORKS
DEPARTMENT TO CHARGE WATER SYSTEM EVALUATION AND
PROJECT REVIEW AND APPROVAL FEES FOR OUT OF CITY
WATER CUSTOMERS
WHEREAS, pursuant to WAC 246-290-120(2), the Washington State Department of
Health requires the City to submit construction documents to the Department for written
approval prior to installation of any new water system, Water system extensions, or
improvement to the city's system outside of the city's municipal boundaries; and
WHEREAS, the Department of Health has declined to review and process
construction documents for water system installations, extensions, and improvements located
outside of the city without payment of a system evalaution and project review and approval
fee, established by WAC 246-290-990; and
WHEREAS, the City deems it necessary to pass on to project applicants the cost of
the Department of Health's project evaluation, review and approval fees, in order to avoid
City water customers and City taxpayers being required to shoulder these expenses; and
WHEREAS, by imposing the Department of Health fee upon project applicants, the
City shall require that applicants pay no more than the actual amount charged by the
Department of Health, without additional fees payable to the City of Port Townsend; and
WHEREAS, in order to pass on the Department of Health fee to any applicants for
installation, water system extention, or improvement, the City hereby adopts a new section
(Z) to PTMC 3.36.020, authorizing the Department of Public Works to collect the
Department of Health fee prior to processing any such applications,
NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
Section 1. Chapter 3.36, Section 020 of the Port Townsend Municipal Code is
hereby amended to read as follows:

3.36.020 Public works service fee schedule.
The fees and charges listed in this section for services of the public works department are
established. The fees and charges shall be paid in advance unless an alternate method of
payment is specifically approved by the director of public works. The continuance or
establishment of water and/or sewer service by the city shall be contingent upon payment of
all fees and charges contained in this section. The following schedule of fees and charges
shall be used:

pursuant to WAC 246-290-990.

The city will make an effort to forward all applications for water system installation,
extension, or improvement to Department of Health in order to minimize charges to each
applicant. However, in the event it is not possible to forward r~ore than one application, the
applicant will be required to pay this amount in its entirety prior to the city processing any
such applications.

Section 2. Severability. If any clause, sentence, paragraph, section or part of this
Ordinance or its application to any person or circumstance is held to be invalid or
unconstitutional by a court of competent jurisdiction, such order or judgment shall not affect
the validity or constitutionality of the remainder of any part of this Ordinance. To this end,
the provisions of each clause, sentence, paragraph, section or part of this law are declared
severable.
This ordinance shall take effect and be in force fiVe days after the date of its
publication in the manner provided by law.
