AN ORDINANCE VACATING 1) THAT PORTION OF 18TH STREET LYING
BETWEEN THE WESTERLY LINE OF GRANT STREET AND THE WESTERLY
LINE OF LOT 1 OF BLOCK 144; AND 2) THAT PORTION OF HENDRICKS
STREET LYING BETWEEN THE SOUTHERLY LINE OF DISCOVERY ROAD
AND THE SOUTHERLY LINE OF 18TH STREET, ALL WITHIN THE
EISENBEIS ADDITION TO THE CITY OF PORT TOWNSEND; ESTABLISHING
CONDITIONS TO THE STREET VACATION; AND ESTABLISHING AN
EFFECTIVE DATE.
WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation
Application No. 9411-03 (Port Townsend School District #50), and following due notice has
held a public hearing upon the application, and
WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact and
Conclusions on March 20, 1995, now, therefore, .

That the street vacation is conditioned on and subject to the
following:

Prior to recording this Ordinance, the applicant has conveyed by quit claim to
the City that area of land abutting Discovery Road legally described as: Lots
1-8, inclusive; in Block 117, together with those portions of vacated Hendricks
Street that would attach thereto by operation of law; Lots 5-8, inclusive, in
Block 134, together with those portions of vacated Hendricks Street and
vacated Eighteenth Street that would attach thereto by operation of law; Lots 1-
8, inclusive, in Block 144, together with those portions of vacated Sherman
Street and vacated Hancock Street that would attach thereto by operation of
law; and Lots 3,4, and 5 in Block 157, together with those portions of vacated
Hancock Street and vacated Seventeenth Street that would attach thereto by
operation of law; ail in the Supplementary Plat to Eisenbeis Addition to the
City of Port townsend, as per plat recorded in Volume 2 of Plats, page 24,
records of Jefferson County, Washington; EXCEPTING THEREFROM those
portions of the above-described real property lying southeasterly of a line that
is parallel to and 40 feet southeasterly of the centerline of the existing paved

surface of Discovery Road, said line beginning at the west margin of the right
of way for Grant Street and ending at the east margin of the right of way for
McClellan Street, as dedicated in the Supplementary Plat to Eisenbeis Addition,
as aforesaid.
Upon a minimum of one year advance notice from the City Public Works
Department, the existing non-conforming residential structure located on Lot 1
of Block 117 of the Eisenbeis Addition will either be demolished or relocated.
If the structure is to be demolished, the City will demolish the structure at no
cost to the applicant. The estimated cost of demolition is $3,000. If the
School District wishes to relocate the structure for school use elsewhere on
District property, the City will contribute 50% of the cost of relocation or a
maximum of $3,000 whichever is less. The applicant shall submit relocation
plans for review and approval by the Director of Public Works to ensure that
upon removal of the structure, acceptable backfill is used and existing drainage
patterns are maintained.
This vacation is subject to an easement, benefitting and retained by the City,
which shall be for utility purposes, including but not limited to water, sewer,
electricity, telephone and cable TV. The easement area is 20 feet along the
center line of 18th Street.
Section 3.
The standard fee of one-half of the appraised value of the land shall be waived
as the property owner has dedicated right-of-way to the City, legally described
in Section 2.A herein, which is equal in value to the right-of-way being
vacated; and said Dedication Deed recorded , Jefferson
County Auditor's File No. is hereby accepted by the City.
Section 4.
This ordinance shall take effect upon its passage, approval and publiCation in
the form and manner provided by law, and after it has been recorded with the
Jefferson County Auditor.
