AN ORDINANCE REZONING TAX PARCEL NO. 38 AND NO. 39 IN THE
NORTHWEST QUARTER OF SECTION 3, TOWNSHIP 30 NORTH, RANGE I WEST,
W.M., JEFFERSON COUNTY FROM R-lA to P-I, AMENDING THE OFFICIAL
ZONING MAP OF THE CiTY OF PORT TOWNSEND; AND ESTABLISHING AN
EFFECTIVE DATE.
WHEREAS, due hearings have been held and appropriate findings and conclusions made as
provided for by Ordinance No. 1625, as amended, of the City of Port Townsend, and
WHEREAS the City CounCil for the City of Port Townsend has approved of the rezoning of
the property described below pursuant to its findings of fact and conclusions, now, therefore,
THE CiTY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION
ASSEMBLED, DOES ORDAIN AS FOLLOWS:
Section 1. The official zoning map of the City of Port Townsend is here and hereby amended to
change from R-IA to P-I zoning thOse lands in Port Townsend described as follows:
Parcel A: Commencing at a point 420 feet west from the NE comer of Government Lot 3 of
Section 3, Township 30 N., Range 1 West, and running thence West 420 feet; thence South
414.9 feet; thence East 420 feet; thence North 414.9 feet to the place of beginning,
containing 4 acres.
Parcel B: Commencing at a point 840 feet West from the NE comer of Government Lot 3
in Section 3, Township 30 N., Range 1 West, being the NW comer of land described in
Book 26, page 227 of Deeds, thence South along West line of said tract to the North line of
the W.H. Whittleseys Add. to Port Townsend; thence West along the North line of said Add.
to the West line of said Government Lot 3; thence North along the West line of said
Government Lot 3 to the NW comer thereof; thence East to the place of beginning,
containing 2 acres.
Section 2. The following conditions shall apply to any development or grading on the above
referenced property and the same shall be recorded with the Jefferson County Auditor and mn with
the land as a condition of approval of the zoning change made by this ordinance:
The uses allowed on the subject property shall be limited to those public recreational
activities, such as active recreational uses, and identified recreational or support facilities
such as a parking lot and public restrooms. Any other buildings, expansions, or uses shall
be subject to additional review by the City.

Prior to issuance of a building permit, the applicant shall submit a final landscaping plan for
review and approval by the Director of Building and Community Development.
All SEPA conditions from the proposal's Mitigated Determination of Non-Significance (file
t/9505-16(s)) are listed below and are incorporated into this rezone by reference.
(1)
To mitigate potential impacts of soil erosion, a variety of erosion and sedimentation
control measures shall be used during and after construction. An Erosion and
Sedimentation Control Plan shall be prepared and approved by the Director of
Building and Community Development, incorporating best management practices
(BMPs) from the Department of Ecology Puget Sound Water Quality Manual to
minimize erosion, sedimentation, turbidity and water quality impacts prior to issuance
of an Excavation and Grading Permit.
(2)
To mitigate air quality impacts during construction, dust shall be suppressed by
watering of the road and construction area as necessary during the construction. In
order to avoid potential surface water contamination, no dust suppressant chemicals
shall be used.
(3)
To mitigate impacts to air quality no burning of vegetation is allowed on site.
Vegetative debris shall be disposed of at the City's Biosolids compost Facility.
Stumps shall be disposed of off-site or chipped on site.
(4)
To mitigate impacts to water quality, no use of pesticides or herbicides is proposed on
the property. The proponent shall use fertilizers only to establish grass seeding of the
playfields.
(5)
To mitigate probable adverse water quality impacts from increased runoff, a Drainage
and Stormwater Management Plan prepared by a civil engineer and in accordance
with PTMC 16.12 for development with over 2000 ~uare feet of impervious surface
shall be prepared and approved by the Director of Building and Community
Development prior to issuance of Excavation and Clearing Permit.
(6)
To mitigate impacts to the vegetative buffers, during excavation and clearing for the
facilities the proponent shall avoid degradation of the vegetation by marking the
boundaries of the clearing and excavation in the field.
To minimize noise impact, construction shall be limited to daylight hours. The
volunteer nature of the construction during each phase shall be taken into
consideration to allow construction during weekends, evenings and holidays.
(8)
The existing vegetated buffer area around the designated activity development shall be
protected and retained as indicated.
(9)
The City's intent is that the park will be developed for day use only. Should lighting
be deemed necessary for safety and security, adverse impacts to the neighborhood

shall be mitigated by the use of low sodium lights, hooded and beamed to reduce
glare onto adjacent properties.
(10)
Street development shall be to City minimum street standards along Rosecrans Street
and 35 Street. A fire engine turn around shall be provided at Logan Street. A Street
Development Permit is required for this proposal.
(11)
Parking area for 20 cars should be designated on the site plan. The first phase should
include gravel surfacing that meets the City's off-street parking regulations (PTMC
17.30) with 16-20 spaces available when the facility opens pending the rezone
application approval.
(12)
Non-motorized trail access shall be developed through the unopened rights-of-way of
Thomas and Logan Streets to the property. The development of the trails does not
have to be provided by the opening of the park and is dependent upon volunteer labor
or resources.
(13)
To mitigate impacts to public services the proponent shall install a fire hydrant and
street opening and turn around area consistent with city street standards at 35th and
Logan Streets. These improvements shall be completed prior to opening of the
facility.
(14)
Water and sewer line extensions to the developed portion of the property shall be
completed prior to the opening of the facility. The City shall enter into a latecomers
agreement regarding these utility line extensions.
Section 3. This ordinance shall take effect upon its passage, approval and publication in the form
and manner provided by law.
Read for the first, second and third times, passed by the City Council for the City of Port
Townsend, and approved and signed by the Mayor of the City of Port Townsend this 5 day of
February, 1996.
