AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING
SECTION 020, PUBLIC WORKS SERVICE FEE SCI-1EDULE, CHAPTER 3.36,
PERMIT, APPLICATION AND APPEAL FEES OF THE PORT TOWNSEND
MUNICIPAL CODE
WHEREAS, the City has adopted an ordinance governing utility latecomer agreements; and
WI-W~REAS, the City Council desires to set the contraCt administration fee at a.level to offset
the City's administrative costs,
NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as follows:
Section 1. Subsection D, Latecomers administration fee, Section 020, Public works service
fee schedule, Chapter 3.36, Permit, Application and Appeal Fees of the Port Townsend Municipal
Code is hereby amended to read as follows:

3.36.020 Public works and utility billing service fee schedule.
The fees and charges listed in this section for services of the public works department and the finance
department for utility billing are established. The fees and charges shall be paid in advance unless an
alternate method of payment is specifically .approved by the director of public works. The continuance
or establishment of water and/or sewer service by the city shall be contingent upon payment of all fees
and charges contained in this section. The following schedule of fees and charges shall be used:

* The preapplication fee shall be credited against the charges for a development application for
water, sewer, storm drainage and street and utility permits when an application for the same proposal

forth in this chapter shall be made.

The city will make an effort to forward all applications for water system installation, extension, or
improvement to department of health in order to minimize charges to each applicant. However, in the
event it is not possible to forward more than one application, the applicant will be required to pay this
amount in its entirety prior to the city processing any such applications.

Section 2. Severability. If any clause, sentence, paragraph, section or part of this Ordinance or
its application to any person or circumstance is held to be invalid or unconstitutional by a court of
competent jurisdiction, such order or judgment shall not affect the validity or constitutionality of the
remainder of any part of this Ordinance. To this end, the provisions of each clause, sentence,
paragraph, section or part of this law are declared severable.

This ordinance shall take effect April 1, 1996.
Read for the first, second, and third times and passed by the City Council of the City of Port
Townsend, Washington, at a regular meeting thereof, held this 18th day of March, 1996.
