HomeMy WebLinkAbout2542 Fire Department Pump Test Pit FundOrdinance No. ~ ~ ~/~ AN ORDINANCE OF THE CITY OF PORT TOWNSEND CREATING A SPECIAL "FIRE DEPARTMENT PUMP TEST PIT FUND," AND ESTABLISHING A FEE FOR THE USE OF THE FIRE PUMP TEST PIT BY OTHER FIRE PROTECTION ENTITIES WHEREAS, the Port Townsend Fire Department has jointly participated with Jefferson County Fire Protection Districts 1 and 6 in the construction of a fire pump test pit located at 144 Elkins Road, Port Hadlock, Washington; and WHEREAS, the pump test pit consists of an in-ground water tank which enables fire departments to ensure that their fire equipment remains in proper working order in the event of a fire emergency; and WI~S, the City and Districts 1 and 6 jointly own and maintain the pump test pit and associated equipment and desire to make the test pit available to other fire departments and fire districts, upon payment of a reasonable fee for such purpose, said fee to defray the cost of construction and routine maintenance; and WHEREAS, the City and Districts 1 and 6 have agreed by Intergovernmental Agreement to establish a fund maintained by the City Treasurer for this purpose; and WHEREAS, the Port Townsend City Council believes that $150.00 is a reasonable fee to be charged for the use of the fire test pit by fire protection entities (other than Port Townsend and Districts 1 and 6), which fee should defray the acquisition, development and maintenance costs of the pump test pit, NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as follows: ~. Establishment of Fund. There is hereby established a special fund, Number 622, to be known as the "Fire Department Test Pit Fund," for the purpose of receiving the deposit of funds delivered to the City pursuant to agreement between the City of Port Townsend and Fire Protection Districts 1 and 6. The fund shall be dedicated for the purpose of collecting fees for the use of the fire apparatus pump test pit located at 144 Elkins Road, Port Hadlock, Washington, by other fire protection entities. The fund shall be maintained as an ongoing fund for the purpose of defraying the costs of test pit acquisition, construction and maintenance. Ali monies deposited in the fund and not expended in any given year shall remain in the fund from year to year and shall not be transferred to any other fund or expended for any purpose except as provided herein. The City Treasurer shall be authorized to collect fees and make appropriate expenditures from the fund upon request from the Port Townsend Fire Chief, subject to Council confirmation. S~ion 2. Fees. The Fire Department is authorized to charge any fire protection entity (other than the Port Townsend Fire Department and Jefferson County Fire Protection Districts 1 and 6) the sum of One Hundred Fifty and No/100 dollars ($150.00) for each truck pump test use of the pump test pit. The fees shall be payable to the City of Port Townsend and shall be tendered immediately to the City Treasurer for deposit in Fund No. 622. Section 3. ~. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law. Read for the first, second, and third times and passed by the City Council of the City of Port Townsend, Washington, at a regular meeting thereof, held this 5th day of August, 1996.
