AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING
CHAPTER 13.26, SYSTEM DEVELOPMENT CHARGES FOR WATER AND
SEWER CONNECTIONS, AMENDING SECTION 13.26.030 WATER
SYSTEM DEVELOPMENT CHARGE AND SECTION 13.26.040 SEWER
SYSTEM DEVELOPMENT CHARGE, OF THE PORT TOWNSEND
MUNICIPAL CODE
WHEREAS, utility rates, charges and connection fees are necessary in managing the City's
public utility services; and
WHEREAS, the City Council deems it necessary to adjust certain utility rates, charges and
fees in a manner consistent with the cost to the public of providing public utility services; and
WHEREAS, in accordance with RCW 35.92.025, Port Townsend's system development
charges are designed to recover a proportionate equitable share of the cost of the Utility systems
benefitting new customers,
NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
Section 1. Section 13.26.030 of the Port Townsend Municipal Code is hereby amended
and shall be codified by the Code Reviser to read as follows:
13.26.030 Water system development charge.
A. The city has evaluated the capital cost of the city's existing water system and the
projected cost to expand the general facilities to meet the projected needs associated with new and
expanded needs of the water system customers. The general facilities include source of supply,
treatment, storage, transmission and major regional pumping facilities.
B. A one-time SDC for each new customer shall be assessed based upon the customer' s fair
and equitable share of the general facilities. The SDC shall be determined by multiplying the total
number of ERU's for the service(s) to be installed by Fr2:350 $2,413 as of January 1, 1996 1997.

Section 2. Section 13.26.040 of the Port Townsend Municipal Code is hereby amended
and shall be codified by the Code Reviser to read as follows:
13.26.040 Sewer system development charge.
A. The city has evaluated the capital cost of the city's existing sewer system and the cost to
expand the general facilities to meet the projected needs associated with new and expanded needs
of sewer system customers. The general facilities include the interceptor system, major regional
pumping facilities and the wastewater treatment and associated facilities necessary to treat and
dispose of the wastewater.
B. A one-time SDC for each new customer shall be assessed based on the customer's fair
and equitable share of the general facilities. The SDC shall be determined by multiplying the total
number of ERU's for the service(s) to be installed by $-2;-1-70 $2.230 as of January 1, 1996 1997 for
domestic strength wastewater.

Section 3. Severability. If any clause, sentence, paragraph, section or part of this Ordinance
or its application to any person or circumstance is held to be invalid or unconstitutional by a court
of competent jurisdiction, such order or judgment shall not affect the validity or constitutionality of
the remainder of any part of this Ordinance. To this end, the provisions of each clause, sentence,
paragraph, section, or part of this law are declared severable.
This ordinance shall become effective January 1, 1997, upon its approval and publication in
the form and manner required by law.
Read for the first, second, and third times and passed by the City Council of the City of Port
Townsend, Washington, at a regular meeting thereof, held this __ day of . ., 1996.
