HomeMy WebLinkAbout2872 Amending Pope Marine Building Use Regulations and Charges Ordinance No. 2872 AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING THE PORT TOWNSEND MUNICIPAL CODE CHAPTER 3.37, POPE MARINE BUILDING USE REGULATIONS AND CHARGES, SECTION 3.37.010, GENERAL USE REGULATIONS WHEREAS, the proposed renovation of City Hall and construction of City Hall Annex will require relocation of City Hall uses, including use of meeting rooms in City Hall, to other locations, including Pope Marine Building WHEREAS, based on the need to use Pope Marine Building for meetings that previously were held in City Hall, the City Council determines it appropriate to modify Ch. 3.37 of the PTMC concerning use regulations of Pope Marine Building, to allow City government uses a priority, and to continue this regulation in effect until the further action by the Council. NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows: SECTION 1. AMENDMENT. Chapter 3.37, Pope Marine Building Use Regulations and Charges, Section 3.37.010, General use regulations, of the Port Townsend Municipal Code is hereby amended to read as follows (strike is deleted, underline is new): Chapter 3.37 POPE MARINE BUILDING USE REGULATIONS AND CHARGES Sections: 3.37.010 3.37.020 General use regulations. Fees. 3.37.010 General use regulations. It is the intention of this chapter to maximize the use of the Pope Marine Building (sometimes referred to as "the facility" for convenience) on a "first-come, first-served" basis, with priority being given to city of Port Townsend residents and official City .Q;overnment uses. This chapter is also intended to encourage use of the facility by the visual and performing arts, and to allow for certain recurring uses of the facility by local organizations. To ensure that the Pope Marine Building is used in a manner consistent with these intentions, the following general use regulations shall be applicable to users of the Pope Marine Building: A. City government, and organizations Organizations based in Port Townsend-,- and individuals with proof of residence in Port Townsend may reserve the facility up to one year in advance of the proposed date of use. This category includes official government Page J Ordinance 2872 uses and government-sponsored special public events, which in the event of a scheduling conflict shall take priority. B. Use of the facility for the visual and performing arts is encouraged. C. Organizations based outside Port Townsend and individuals not residing in Port Townsend may reserve the facility up to 90 days in advance of the proposed date of use. D. City goverrunent may reserve the facility up to 15 days in advance of the proposed date of use. DB. The facility may be reserved for no more than three consecutive days and for no more than six days per reservation; provided, however, that upon approval by the city manager or by the council as a whole, reservations beyond three consecutive days or for more than six days per reservation may be allowed under such terms and conditions as approved by the city manager or city council. ;EF. The facility is hereby reserved for the use of the Wooden Boat Foundation during the Wooden Boat Festival each September and during the Youth Sea Symposium each June; provided, however, that this right must be exercised no less than 90 days in advance of each such annual use; and, provided further, that the limitations on length of use imposed in subsection D E of this section do not apply to such uses by the Wooden Boat Foundation. EG. The following blocks of time are available each day: 1. 8:00 a.m. to 1:00 p.m. 2. 1:30 p.m. to 6:00 p.m. 3. 6:30 p.m. to midnight. GH. The facility may be occupied by no more than 78 people. The party reserving the facility shall be financially liable for any and all damages to the facility, any fines imposed for excess occupancy of the facility, and for any cleaning or other charge which may be levied for failure to leave the facility as clean or cleaner than when the use pursuant to the reservation commenced. HI. The public works director, in consultation with the park and recreation advisory board, is hereby authorized to develop additional rules and regulations regarding the facility. 3.37.020 Fees. Category 1 - city-supported activity Category 2 - nonprofit/community functions Day use (8:00 a.m. - 6:00 p.m.) - First hour - Additional hours Evening use (6:30 p.m. - midnight weekdays) Weekend use (Friday, Saturday or Sunday) - First hour - Additional hours - Flat rate per day Category 3 - profit-making enterprise, private parties Day use (8:00 a.m. - 6:00 p.m.) - First hour no fee $15.00 $10.00 $20.00 $15.00 $150.00 $30.00 2 Ordinance 2872 - Additional hours Evening use (6:30 p.m. - midnight weekdays) Weekend use (Friday, Saturday or Sunday) - First hour - Additional hours - Flat rate per day Deposits and refunds - Cancellation refund fee (90 days) - Deposit for 19 or less people, no food or alcohol - Deposit of 20 or more people, or with food or alcohol $15.00 $35.00 $20.00 $250.00 $20.00 $75.00 $200.00 SECTION 2. Severability. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law.
