Ordinance No. 2867
AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING AND
UPDATING CHAPTER 16.04, BUILDING CODE, OF THE PORT TOWNSEND
MUNICIPAL CODE, TO INCORPORATE THE
· 2003 INTERNATIONAL BUILDING CODE,
· 2003 INTERNATIONAL RESIDENTIAL CODE,
· 2003 INTERNATIONAL MECHANICAL CODE,
· 2003 INTERNATIONAL FIRE CODE,
· 2003 UNIFORM PLUMBING CODE AND UNIFORM
PLUMBING CODE STANDARDS,
AND RELATED WASHINGTON ADMINISTRATIVE CODE CHANGES, WITH
CHANGES AND EXCEPTIONS AS SET FORTH IN THIS ORDINANCE, AND RE-
ADOPTING BUILDING PERMIT FEE SCHEDULES
WHEREAS, PTMC Chapter 16.04, Building Code adopts and incorporates by reference
various Building Codes and sections of the Washington Administrative Code (WAC) in
conformance with the State Building Code Act (RCW Ch. 19.27), including any amendments
thereto (PTMC 16.04.010); and
WHEREAS, the State of Washington establishes the State Building Code in RCW
19.27.031, and amended the same in 2003 to require cities and counties to implement the
International Building Code; and
WHEREAS, the Washington State Building Code Council through rulemaking in the
year 2003 set a date of July 1, 2004 for the implementation of select International Codes
published by the International Code Council, Inc. in place of the previously used Uniform
Building Code or their construction codes; and
WHEREAS, some of the references in PTMC, Chapter 16.04 and elsewhere, are now
outdated due to 2003 changes in the various uniform codes; and
WHEREAS, although PTMC 16.04.010 automatically adopts any amendments to the
State Building Code Act, the City Council desires to revise and update Chapter 16.04, and other
sections of the PTMC, consistent with current law, to remove outdated references.
NOW, THEREFORE, the City Council ofthe City of Port Townsend does ordain as
follows:
SECTION 1. Amendment - Adoption of International Codes. Chapter 16.04,
Building Code, and Section 16.03.010, Uniform Codes Adopted, ofthe Port Townsend
Municipal Code, is hereby amended to read as follows (strike is deleted, underline is added):

SECTION 2. Amendment - References to Uniform Codes. The following sections of
the Port Townsend Municipal Code:
See attached Exhibit B.
are hereby amended to:
· replace all references to Uniform Building Code or UBC to the International Building
Code, and
· replace all references to the Uniform Fire Code or UFC to the International Fire Code,
and
· delete all references to specific sections of the Uniform Building Code or UBC or
Uniform Fire Code or UFC,
as shown on a list of such changes filed with the Clerk of the City and available at the office of
the City Clerk.
SECTION 3. Amendment -Building Permit Fees. That portion of Section 20.09.020
to the Port Townsend Municipal Code set forth below is hereby amended to read as follows
(strike is deleted, underline is added):
20.09.020 Building, land use and development fees.
The fees stated in this section are set in an amount to reimburse the public for staff time and
resources expended in reviewing and processing permit applications. These fees do not include
costs of publication, mailing and other costs incurred by the City. These costs are charged in
accordance with PTMC 20.09.040 and 20.09.060. Application and service fees for the various
building, land use and land development permit applications shall be as follows:
A. Type I Applications (see PTMC 20.01.040).
1. Building permits: the fees and charges set forth in the Uniform Building Code, 1997
Edition. as 0mTently adopted by the eity, plus an additional special examiner/special inspector
fee pursuant to the Nomesidential Energy Code as set forth in the suggested fee schedule set by
the utility code group; . . . ."
SECTION 4. Severability. If any clause, sentence, paragraph, section or part of this
Ordinance or its application to any person or circumstance is held to be invalid or
unconstitutional by a court of competent jurisdiction, such order or judgment shall not affect the
validity or constitutionality of the remainder of any part of this ordinance. To this end, the
provisions of each clause, sentence, paragraph, section or part of this law are declared severable.

This ordinance shall take effect and be in force five days after the date of its publication
in the manner provided by law.
Adopted by the City Council of the City of Port Townsend, Washington, at a regular
meeting thereof, held this sixth day of July, 2004.

A. There are adopted for the city, in conformance with the State Building Code Act (Chapter
19.27 RCW, the following codes, as now or later amended by the International Code Council.
Inc.. together with the additions. deletions. and exceptions set forth in the Washington
Administrative Code (WAC). as now or later amended. which are hereby incorporated by
reference, and which shall constitute the city's Building Code:

laws or ordinances of this jurisdiction.

4. Water tanks supported directly upon grade if the capacity does not exceed 5,000
gallons (18927 L) and the ratio of height to diameter or width does not exceed 2
to 1.
5. Sidewalks and driveways not more than 30 inches (762 mm) above adjacent grade
and not over anv basement or stOry below.
6. Painting. papering, tiling, carpeting, cabinets. counter tops and similar finish
work.
7. Prefabricated swimming pools that are less than 24 inches (610 mm) deep.
8. Swings and other playground equipment accessory to a one or two-family
dwelling.
9. Window awnings supported by an exterior wall which do not project more than
54 inches (1372 mm) from the exterior wall and do not require additional support.
Chapter 2, Definitions, Section R202, Height, Building. The definition for height of buildings
shall take preference over the zoning code definition.

(3) The 2003 International Mechanical Code, published by the International Code Council. Inc.,
as amended by Chapter 51-42 Washington Administrative Code (WAC); except that the
standards for liquified petroleum gas installations shall be NFP A 58 (Storage and Handling of
LiQuified Petroleum Gases) and ANSI Z223.1/NFPA 54 (National Fuel Gas Code);
2. The Uniform. Mechanical Code, 1997 Edition, published by the International Conference of
Building Officials, as amended by Chapter 51 12 'H.^..C.
