AN ORDINANCE VACATING ALL OF THE SOUTHERLY 100 FEET OF
REDWOOD STREET LYING BETWEEN LOT 5 IN BLOCK 38 AND LOT 8 IN
BLOCK 48, TOGETHER WITH THAT PORTION OF REDWOOD STREET FROM
THE CENTERLINE WESTERLY BETWEEN THE NORTHERLY LINE OF LOT 5
AND THE NORTHERLY LINE OF LOT 4 IN BLOCK 38, ALL WITHIN
PETTYGROVE'S SECOND ADDITION TO THE CITY OF PORT TOWNSEND;
ESTABLISHING CONDITIONS TO THE STREET VACATION; AND
ESTABLISHING AN EFFECTIVE DATE.
Assessor's Parcel Numbers: 985-203-802 and 985-203-803 and 985-204-808
WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation
Application No. LUP97-00006 (Ken Brink), and following due notice has held a public
hearing upon the application; and
WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact and
Conclusions on October 6, 1997; and
WHEREAS, the applicant has recorded a utility easement with Puget Sound Energy (Auditor's
file No. 403469), providing them with access to their utility lines, and
WHEREAS, the applicant has paid to the City one-half of the appraised value of the area to be
vacated; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS
FOLLOWS:
Section 1.
That the following street is hereby vacated to Ken Brink:
The southerly 100 feet of Redwood Street lying between Lot 5 in Block 38 and
Lot 8 in Block 48, together with that portion of Redwood Street from the
centerline westerly between the northerly line of Lot 5 and the northerly line of
19971
Lot 4 in Block 38, all within Pettygrove's Second Addition to the City of
Port Townsend.
Section 2.
That the street vacation aforementioned is conditioned, however, on the
following:
A certified copy of the ordinance vacating the street shall be recorded by the
City with the office of the Jefferson County Auditor.
This ordinance shall take effect upon its passage, approval and publication in the
form and manner provided by law, and after it has been recorded with the
Jefferson County Auditor pursuant to Section 2 of this ordinance.
Read for the first, second and third times, passed by the City Council for the City of Port
Townsend and signed by the mayor of the City this sixth day of October, 1997.

AMENDED FINDINGS OF FACT AND CONCLUSIONS OF THE CITY COUNCIL

The above-referenced Street Vacation was conditionally approved by City Council on
June 16, 1997.
Findings of Fact
The applicant proposes to vacate all of the southerly 100 feet of Redwood Street lyin~
between Lot 5 in Block 38 and Lot 8 in Block 48. together with that portion of Redwood
Street from the centefline westerly between the northerly line of Lot 5 and the n0rthefly
Line of Lot 4 in Block 38, all within Petty_ grove's Second Addition to the City of Port
Town~end .(Exhibit 1).
The applicant is in agreement with the amended street vacation proposal in order to
accommodate the city's needs for the Redwood/Cherry Street fight-of-way alignment.
Conditions
Prior to recordation of the ordinance vacating that portion of Redwood Street, the
applicant shall record a utility easement with Puget Sound Energy, providing them with
access to their utility lines.

All of the southerly 100 feet of Redwood Street lying between Lot 5 in Block 38 and Lot
8 in Block 48, together with that portion of Redwood Street from the centerline westerly
between the northerly line of Lot 5 and the northerly line of Lot 4 in Block 38, all within
Pettygrove's Second Addition to the City of Port Townsend shall be vacated by ordinance
after all required fees have been paid and the required easement has been executed and
recorded. That portion of the street shall be vacated to the applicant upon payment of a
fee in the amount of one-half the fair market value. A certified copy of the ordinance

vacating the street shall be recorded by the City with the office of the Jefferson County Auditor.
The street vacation shall be canceled and become automatically null and void one year after City
Council action if said payments and recordation are not made.
