HomeMy WebLinkAbout2635 Parking RequirementsOrdinance No. 2635 AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING SECTION 17.72.080, MINIMUM PARKING SPACE REQUIREMENTS, CHAPTER 17.72 OFF- STREET PARKING AND LOADING, OF THE PORT TOWNSEND MUNICIPAL CODE, TO REDUCE THE MANDATORY PARKING REQUIREMENTS FOR CERTAIN RETAIL LAND USES SECTION I. FINDINGS AND RECITALS 1. The Port Townsend zoning code, Chapter 17.72 PTMC, establishes minimum parking requirements for all land uses within the City of Port Townsend; and 2. As currently enacted, PTMC 17.72.080 establishes the minimum number of parking spaces required for "Retail not otherwise listed" land uses as one space per 300 square feet gross floor area, and one space per each 100 square feet in excess of 5,000 square feet; and 3. The parking code requirement for commercial space exceeding 5,000 square feet greatly exceeds requirements for comparable land uses in other jurisdictions and has the impact of unnecessarily increasing impermeable surfaces, exacerbating stormwater management problems, and discouraging the development of commercial establishments; and 4. The Council finds that the currently-enacted parking requirement for "Retail, not otherwise listed" is inconsistent with the following goals and policies of the Port Townsend Comprehensive Plan: Economic Development Goal 5: To enhance and attract small and medium sized retail businesses which serve the community's needs for goods and services. Economic Development Goal 5.1: Promote development of retail uses which serve local needs and diversify the selection of conveniently located goods and services. Economic Development Goal 5.3: Promote the redevelopment efforts of Gateway Corridor land owners by helping to assemble parcels and design buildings which meet the retail needs of the community. Economic Development Goal 5. 4: Work with the Economic Development Council (EDC) and local retail business owners to strengthen and expand Port Townsend's retail base, capitalizing on opportunities to decrease retail sales leakage to neighboring communities. Transportation Goal 7: To encourage City, Transit, and private interests to establish coordinated parking strategies to achieve overall transportation goals and to ensure that parking standards do not act as a deterrent to new development or redevelopment. 5. The City has conducted review of this ordinance under the State Environmental Policy Act, Chapter 43.21C RCW; and 6. On February 26, 1998, the Planning Commission held a public hearing to consider testimony regarding this ordinance. The Planning Commission recommends that the City Council approve the proposed amendment to PTMC 17.72.080; and 7. On April 6, 1998, the City Council held a public hearing to hear testimony regarding this proposed amendment to the Port Townsend Municipal Code. Based upon the record developed before the Planning Commission, based upon the Planning Commission's recommendation, and based upon public testimony, the City Council hereby finds that this amendment advances the goals and policies of the Comprehensive Plan and will encourage the efficient use of land without the environmental impacts associated with unnecessary parking requirements. NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as follows: SECTION II. Section 17.72.080, Table of Minimum Parking Space Requirements, Chapter 17.72 Off-Street Parking and Loading, of the Port Townsend Municipal Code is hereby amended to read as follows: 17.72.080 Table of mlnimnm parking space requirements. Unless otherwise provided in this rifle, the required number of off-street parking spaces shall be in conformance with Table 17.72.080. For purposes of this chapter, gross floor area shall not include elevator shafts, stairwells or mechanical equipment rooms. For multi-dwelling developments of more than 50 dwelling units, one visually screened space for each 10 dwelling units shall be provided for recreational vehicles. 2. Sufficient land area must be reserved to provide parking as a multifamily residential use in the event the development is later converted, scheduled public transit service must be available within 200 feet of the main entrance to each building, and sidewalks must be installed to and along each street frontage. If scheduled public transit service is not available within 200 feet, the parking requirement shall be one space per bedroom. (Ord. 2635 § 2, 1998; Ord. 2571 § 2, 1997). 5 Ord. 2635 SECTION I!I. Sevembility. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law. Read for the first, second, and third times and adopted by the City Council of the City of Port Townsend, Washington, at a regular meeting thereof, held this 6th day of April, 1998.
