AN OPDINANCE REPEALING SECTIONS ~ AND 9 OF ORDINANCE
NO. 1530, ADOPTING THE UNIFORM BUILDING CODE, WITH
CERTAIN AMENDMENTS, THE UNIFORM MECHANICAL CODE, THE
UNIFORM FIRE CODE, THE UNIFORM PLUMBING CODE, AND
STANDARDS FOR MAKING BUILDINGS ACCESIBLE TO THE
PHYSICALLY HANDICAPPED, AND SETTING CERTAIN FEES.
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION
ASSEMBLED, DO ORDAIN AS FOLLOWS:
Section 1. Section 1 and Section 9 of Ordinance No. 1530, passed
in 1968, be and they are hereby repealed, and any other ordinances,
or part of any ordinance, in conflict herewith is likewise hereby
repealed.
Section 2. There is hereby adopted for the City, in conformance
with the State Building Code Act, the following codes:
(A) Uniform Building Code and Related Standards, 1973 edition,
published by the International Conference of Building Officials, eRcept:
(i)
Compliance with the provisions of this code shall not be
required of Group J Occupancy.
(ii)
That a new category of occupance group designated "Group K
Occupancy" is hereby established. Grot%p K~Occupancy shall
~~all factory-built mobile and modular homes.
Group K Occupancy shall:
(a) Comply with all applicable state structural codes,
indluding but not being limited to'the provisions of
RCW 43.22;
(b) be attached to a fixed foundation; and
(c) be permitted only in conformity to the zoning and
other ordinances of the City.
(iii) That a new category of occupancy group designated "Group L
Occupancy" is hereby established. Group L Occupancy shall
include those bulkheads, docks and similar shore-related
structures which require a Substantial Development Permit
under the Shoreline Management Act of 1971 (RCW 90.58).
All structures within Group L Occupancy shall be designed
by a professional engineer licensed to practice in the State
of Washington and two sets of plans shall accompany each
application for a building permit.

(iv)
Chapter 3, 301 (c) is hereby amended to read as follows:
"Plans and Specifications. Except for Group I and K
Occupancies, with each application for a building permit,
and when required by the Building Official for enforcement
of any provisions of this Code, two sets of plans and
specifications shall be submitted. The Building Official
may require plans amd ~~ to be prepared and
designed by an engineer or architect licensed by the State
to practice as such.
(v) With each application for a building permit of Group I
Occupancy, the following are req~ed:
(a) A thorough written description of materials and
construction methods.
(b) A pl~t plan, drawn to scale, showing the location of
the proposed structures by dimensions from the property
lines to the walls of the structures; and
(c) A foundation plan, drawn to scale, showing
size of supporting walls and piers or ports.
(vi) Chapter 3, 303 (a) [Table No. 3-A - Building Permit Fees]
is hereby amended by adding to the established schedule
the following:
"For all Group K Occupancy applications, a fee of
Twenty Dollars ($20) is established."
(B) Uniform Mechanical Code, 1973 edition, published by the
International Conference of Building Officials and the International
Association of Plumbing and Mechanical Officials.
(C) The Uniform Fire Code with appendices thereto, 1973 edition,
published by the International Conference of Building Officials and the
Western Fire Chief's Association.
(D) The Uniform Plumbing Code, 1973 edition, published by the
International Association of Plumbing and Mechanical Officials: PROVIDED
that Chapter 11 of such code is not adopted, and FURTHER PROVIDED, that,
notwithstanding the wording of said Code, nothing therein shall apply to
the installation of any gas piping for water heaters or vents for Water
heaters; and
(E) The American National Standard Specifications for Making
Buildings and Facilities Accessible to, and Useable by, the Physically
Handicapped, published by the American National Standards Institute,

Incorporated, Document ANSI Al17.1-1961 (reaffirmed 1971).
In case of conflict among the codes enumerated in Section 2, (A),
(B), (C), (D), and (E) of this ordinance, the first named code shall
govern over those following, excepting where specific modificatiQn of
the same is herein provided, and three (3) copies of which said
codes have each been filed with the Clerk-Treasurer of the City of
Port Townsend, and ~re available in his office, and said codes are by
this reference hereby adopted and incorporated herein as fully as
though completely set forth.
Section 3. Fire zones are hereby established for the City, and
said zones shall be of three classes, designated in accord with the
u~iform codes hereinabove adopted, as Fire Zone 1, Fire Zone 2, and
Fire Zone 3. Said Fire Zones shall be bounded in accord with the
zoning boundaries fixed on the Official Zoning Map of the City,
provided that said fire zones in Waterfront areas shall extend to the
outer harbor line, in the manner following:
(a) Fire Zone 1 --- Ail areas zoned M-l, M-2 and C-3.
(b) Fire Zone 2 --- Ail areas zoned C-2.
(c) Fire Zone 3 --- All areas ~.oned C~i, P-l, R-l, R-2 and R-3.
Said fire zone boundaries will adjust automatically to conform to any
zoning changes made on the Official Zoning Map by ordinance.
Section 4. This ordinance shall take effect on January 21, 1975.
Read for the 1st, 2nd and 3rd times, passed by the Council and
approved by the Mayor on January 7, 1975.
