HomeMy WebLinkAbout2643 Adopting Non-Motorized Transportation PlanAN ORDINANCE OF THE CITY OF PORT TOWNSEND ADOPTING THE CITY OF PORT TOWNSEND NON-MOTORIZED TRANSPORTATION PLAN AND ESTABLISHING AN EFFECTIVE DATE SECTION 1. FINDINGS AND RECITALS. Based upon the public record before the Port Townsend Planning Commission and the Port Townsend City Council, the City Council of the City of Port Townsend finds as follows: The Washington State Legislature adopted the Washington State Management Act of 1990 and amendments thereto, Chapter 36.70A RCW, (the "Act"), requiring selected counties and cities to prepare comprehensive plans consistent with the provisions of the Act. After review and recommendation from the Port Townsend Planning Commission, the City's current comprehensive plan was adopted by the City Council in 1996 (Ordinance No. 2539) as the official public document intended to facilitate the orderly and coordinated growth and development of the City, and to guide the preparation of implementation or "functional" plans. Consistent with Comprehensive Plan Policy (Transportation Element, Policy 5.1), on June 16, 1996 the Planning Commission urged City Council to provide the staffing and resources needed to complete a Non-Motorized Transportation Plan, as an implementation or functional plan. o After timely public notice, the Mayor of Port Townsend, Julie McCulloch, appointed the Non-Motorized Transportation Advisory Committee on April 7, 1997. The Committee consisted of two City Council members, a Planning Commissioner, a Jefferson Transit representative, a Scheol Board representative, and nine Port Townsend citizens. The Committee's mandate was to develop a draft Non-Motorized Transportation Plan. As set forth in the findings below, the citizen involvement process employed in the planning process exceeds the public participation requirements set forth in the Act (Chapter 36.70A. 140 RCW). o Between April 1997 and November 1997, the Committee held 14 public workshops and 2 all-day work sessions as they gathered information, identified key issues, and prepared the Draft Plan for community review. o On November 4, 1997 a complete Draft Non-Motorized Transportation Plan was presented to the Port Townsend Department of Building and Community Development (BCD) for environmental review under the State Environmental Policy Act (SEPA). On December 24, 1997, and after timely public notice, the SEPA Responsible Official (Building and Community Development Director, Bruce Fr,,land) made a determination of nonsignificance. Prior to the Planning Commission meetings and hearings in December, 1997, posters were displayed at key locations throughout town, including: City Hall; the Engineering Office; the Port Townsend Library; Safeway; the Port Townsend Food Co-Op, and PT Cyclery. These posters invited the public to participate in the Planning Commission process. 10. On December 11, 1997, the Planning Commission received an overview presentation of the Draft Non-Motorized Transportation Plan. 11. In January and February of 1998, and after timely public notice, the Port Townsend Planning Commission held a series of four public hearings to accept public testimony on the specific recommendations contained in the Draft Plan. These hearings were held on January 8, 22, 29 and February 5, 1998. 12. On February 26, 1998, the Planning Commission transmitted the Draft Non-Motorized Transportation Plan and a list of final recommended amendments to the City Council, together with a recommendation for adoption. The transmittal stated the Planning Commission's guiding principles in reviewing the plan and provided a summary of key recommended revisions and areas of concern. 13. In April and May, 1998, after timely public notice City Council held three public hearings and workshops to accept testimony, and to review and direct further revisions to specific recommendations contained in the Draft Plan. These hearings were held on April 6, 27 and May 11. In addition, a public workshop and tour of non-motorized issues was held on April 27, 1998. 14. Over the course of the planning process, articles published in the Port Townsend - Jefferson County Leader, and Peninsula Daily News included: "City Aims to Help You Bike, Walk Nearly Everywhere," The Leader, July 16 1997; "City Ready to Push 'Non-Motorized' Plan,~ The Leader, January 21, 1998; "Keep Your Cars at Home in PT,~ Peninsula Daily News, April 13, 1998; and 2 Ord. 15. 16. 17. 'City's Bike/Pedestrian Plan has $9 Million Price Tag,' The Leader, April 22, 1998. Throughout the planning process, the City Council, Planning Commission, Non-Motorized Advisory Committee and staff have referred to the Community Direction Statement, the Goals and the extensive list of non-motorized related Policies found in the 1996 Comprehensive Plan. The Community Direction Statement was adopted by the City Council on May 2, 1994, as a vision statement for the comprehensive planning process (Resolution No. 94-65). Portions of this vision were subsequently adopted as the vision statement for the Non- Motorized Transportation Plan. The Port Townsend Non-Motorized Transportation Plan contains goals, policies, system maps and design standards intended to guide the development of pedestrian and bicycle facilities. Important components of the Plan include: (a) A vision statement and objectives taken directly from the 1996 Comprehensive Plan; (b) An inventory and assessment of existing conditions; (c) Walkway System Plan, consisting of a Multi-use trail, primary and secondary neighborhood connectors and shortcuts, that forms a coherent pedestrian network connecting destinations throughout the city; (d) A Bikeway System Plan, consisting of a Multi-use trail and major streets, intended to guide where future road improvements will include bicycle facilities; (e) A funding program and a discussion of where additional funding may be acquired; (f) A priority projects list that directs what projects should be undertaken and illustrates what components of the system may be in place in 10 years; (g) Education and encouragement initiatives; (h) Maintenance considerations and initiatives; (i) Implementation policies that guide City actions and private development; and (J) Proposed engineering design standards that provide for safe and Iow-maintenance facilities. 3 Ord. 18. 19. 20. The Port Townsend Non-Motorized Transportation Plan provides dear policy direction for the preparation of new development regulations and Engineering Design Standards. The Port Townsend Non-Motorized Transportation Plan has been prepared in conformance with the goals and requirements of the Act, and is externally consistent with and compatible with the 13 state-wide planning goals contained in the Act (Chapter 36.70A.020 RCW). Based upon the foregoing findings, the City Council finds that adoption of the 1998 Port Townsend Non-Motorized Transportation Plan is consistent with and implements portions of the 1996 Comprehensive Plan and serves and advances the public health, safety and welfare of Port Townsend citizens. NOW, TltEREFORE, based upon the record and the foregoing Findings and Recitals, the City Council of the City of Port Townsend does ordain as follows: SECTION 2. ADOPTION. The 1998 Port Townsend Non-Motorized Plan, as recommended by the Planning Commission and thereat~er revised by the City Council as shown on the "Addendum," (both the Plan and Addendum included as Exhibit A attached hereto), is approved in its entirety as a "functional" land use and development planning document for the City of Port Townsend, supplementing and implementing the 1996 Comprehensive Plan, adopted by Ordinance 2539. The 1996 Comprehensive Plan, Ordinance 2539, and the public record in support thereof are incorporated herein by this reference. SECTION 3. FILING. The Non-Motorized Plan as approved shall be filed with the City Clerk and shall be available for public inspection upon the effective date of this ordinance. SECTION 4. TRANSMITTAL TO DCTED. The City Clerk shall transmit a copy of the Port Townsend Non-Motorized Plan as approved to the State Department of Community Trade and Economic Development (DCTED) within 10 days of final adoption of this ordinance, and to other offices and agencies as may be required by law. SECTION 5. PREPARATION OF FINAL REVISED NON-MOTORIZED PLAN COPIES. Copies of a Final Port Townsend Comprehensive Plan, incorporating the changes to the goals, policies, implementing strategies and maps approved by the City Council (i.e., integrating all revisions and the addendum into one coherent document for public use), shall be prepared by Port Townsend Department of Public Works staffand shall be made available for public inspection within 30 days offinai adoption of this ordinance. SECTION 6. REVISIONS TO DEVELOPMENT REGULATIONS AND ENGINEERING DESIGN STANDARDS. The Director of the Port Townsend Department of Public Works, together with the City Council's Transportation Committee, are directed to review and 4 prepare proposed revisions to development regulations and provisions of the City's Engineering Design Standards Manual in order to implement the Port Townsend Non-Motorized Plan. SECTION 7. SEVERABILrFY. If any clause, sentence, paragraph, section or part of this Ordinance or its application to any person or circumstance is held to be invalid or unconstitutional by a court of competent jurisdiction, such order or judgment shall not affect the validity or constitutionality of the remainder of any part of this ordinance. To this end, the provisions of each clause, sentence, paragraph, section or part of this law are declared severable. SECTION 8. EFFECTIVE DATE. This ordinance shall be in full force and effect five days following publication of the attached summary, which is hereby approved. Read for the first, second, and third times and adopted by the City Council of the City of Port Townsend, Washington, at a regular meeting thereof, held this 18th day of May, 1998.
