HomeMy WebLinkAbout1735 Lease a Portion of Adams Street to Western Propane, Inc.ORDINANCE NO. / 7~"- AN ORDINANCE AUTHORIZING THE LEASE OF A PORTION OF ADAMS STREET BETWEEN WATER STREET AND FRONT STREET, AND SPECIFYING TERMS AND CONDI~TIONS THE~FOR. THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, INRREGULAR SESSION ASSEMBLED, DO ORDAIN AS FOLLOWS: Section 1. The Mayor and City Clerk are here and hereby authorized and directed to enter into a written lease of a portion of Adams Street, lying between Water Street and Front Street, to Western Propane, Inc., a corporation, which portiDn of street shall be strictly limited to the area shown in certain drawings filed with the City Engineer for the installation of a liquefied petroleum storage tank, and said installation shall in all respects conform to the said drawings and to all State and City building, fire and safety codes; said lease to be for a term of ten (10) years, with rent to be renegotiated after five (5) years, and to be for a consideration of Fifty Dollars ($50.00) per year payable annually in advance. Lessee shall further be permitted to extend gas lines from the said storage tank to abutting properties. Section 2. Western Propane, Inc. shall assume the full reponsibility for complying with all laws for the construction of facilities on the leased premises, including, but not being limited to, shorelines management laws and regulations, RCW 35.24.300, and the Uniform Building Code, and shall hold the City harmless for any liability from spills, fire or explosion resulting from the use of the leased premises by said Western Propane or its agents, successors or assigns. Section 3. This ordinance shall take effect upon payment of publication costs by applicant, and after its passage, approval and publication in the form and manner provided by law.
