ABUTTING LOTS 6-10, BLOCK 26 OF THE FOWLER'S PARK ADDITION TO
THE CITY OF PORT TOWNSEND,

WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation
Application No. LUP96-00067 (Arthur Karno), and following due notice has held a public
hearing upon the application; and
WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact and
Conclusions on January 21, 1997; and
WHEREAS, the applicant has provided a warranty deed conveying a 40 foot wide strip of land
lying parallel to the vacated alley of Block 26, Fowler's Park Addition, in fee simple, to the
City of Port Townsend for purposes of providing access and utilities to platted lots. To
memorialize the exchange of rights-of-way, the applicant has:

made application for a boundary line adjustment shifting lots 6-10 of Block 26,
thirty feet to the west;
provided a record of survey including monuments of the boundary line
adjustment and street vacation;
submitted a title insurance policy in a form acceptable to the City Attorney
ensuring that the 40 foot wide strip of land to be dedicated is owned in fee
simple and free of all defects, liens, encumbrances, adverse claims or other
matters; and
all parties in chain of title have executed the boundary line adjustment, warranty
deed dedicating the interior alley and street vacation; now, therefore,

THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS
FOLLOWS:

That the following street is hereby vacated to Arthur Kamo:
The easterly 30 feet of Arizona Place abutting Lots 6-10, Block 26 of the
Fowler's Park Addition to the City of Port Townsend. This portion of Arizona
Place has a total platted right-of-way width of 60 feet.
That the street vacation aforementioned is conditioned, however, on the
following:
A certified copy of the ordinance vacating the street shall be recorded by the
City with the office of the Jefferson County Auditor.
This ordinance shall take effect upon its passage, approval and publication in the
form and manner provided by law, and after it has been recorded with the
Jefferson County Auditor pursuant to Section 2 of this ordinance.
Read for the first, second and third times, passed by the City Council for the City of Port
