HomeMy WebLinkAbout2660 Vacating Portions of Rosecrans, Logan and 30th Streets in Monogram AdditionREC.~lVED 1 1 1999 Sheila Spears City of Port~o~ Building & Waterman & Katz Building 181 Quincy Street, Suite 301 Port Townsend, WA 98368 JEFFERSON T)TLE CO PANY ORDINANCE NO. ~::, ~C~ AN ORDINANCE VACATING ROSECRANS STREET FROM THE NORTHERLY EDGE OF 31ST STREET TO THE SOUTHERLY EDGE OF 32ND STREET; THE WESTERLY 33 FEET OF ROSECRANS STREET ABUTTING LOTS 5 AND 6 OF BLOCK 6; LOGAN STREET FROM THE NORTHERLY EDGE OF 31ST STREET TO THE SOUTHERLY EDGE OF 32ND STREET; LOGAN STREET FROM THE NORTHERLY EDGE OF 30TH STREET TO A POINT 25 FEET SOUTH OF THE SOUTHERLY EDGE OF 31ST STREET; AND 30TH STREET FROM THE WESTERLY EDGE OF LOT 5 OF BLOCK 5 TO THE CENTERLINE OF ROSECRANS STREET, ALL WITHIN THE MONOGRAM ADDITION TO THE CITY OF PORT TOWNSEND Tax Parcel No's: 972-600-401 & 972-600-301 & 972-600-210 & 972-600-211 & 972-600-505 & 972-600-601 Grantor/Grantee: City of Port Townsend Reference: Puget Power Underground Electric System Easement, AFN 371424 Private Access & Utilities Easement, AFN Lot Line Adjustment, AFN WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation Application No. LUP98-13 (David Deering, O'Meara Construction, and Clifford Braden), and following due notice has held a public hearing upon the application; and WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact, Conclusions and Decision on June 1, 1998; and I AY 2 6 1999 WHEREAS, ownership of Lot 3 of the O'Meara plat was transferred to Clifford Braden on March 27, 1998, and Clifford Braden has stated in writing that he is in agreement with the vacation of the easterly % of Rosecrans Street; and WHEREAS, in accordance with Street Vacation (LUP98-13), the property owners have retained Jefferson Title Company to prepare the required warranty deeds conveying the following real properties and vacated rights-of-way to the City in fee simple: Rosecrans lying between the northerly edge of 31st Street and the southerly edge of 32nd Street all within the Monogram Addition; and ii. Logan Street from the southerly edge of 30th Street to a point 25 feet south of the southerly edge of 31st Street (remaining twenty-five feet provides for sewer lift station); and 111. Thirtieth (30th) Street from the westerly edge of Logan Street to a point 216 feet east (i.e. westerly edge of Parcel H); and iv. Lots 1-8 inclusive of Block 3; Lots 1-4 inclusive of Block 6 and portions of Lots 5 and 6 of Block 6 all within the Monogram Addition; and WHEREAS, upon adoption of this ordinance, the city Building & Community Development Director stands ready to approve a LOt Line Adjustment and Statement of Intent reflecting the proposed street vacations and conveyances and binding the following lots and vacated streets into no more than four building sites, each with adequate access provided via public streets or private easements: Lots 5-8 of Block 4; Lots 5-8 of Block 5, all of or part of Lots 5 and 6 of Block 6 and portions of vacated Rosecrans Street and Logan Street; WHEREAS, the City Attorney has provided the applicants and Jefferson Title with a draft escrow agreement. Said agreement will ensure that the required warranty deeds and LOt Line Adjustment Statement of Intent shall be recorded upon recordation of the street vacation; and WHEREAS, the applicants have provided current policies of title insurance in a form acceptable to the City Attorney ensuring that fee title to the aforementioned street rights-of-way to be conveyed to the City are owned in fee simple and free of all defects, liens, encumbrances, adverse claims and other matters; now, therefore THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS FOLLOWS: Section 1. That the following street rights-of-way are hereby vacated to David Deering: The westerly thirty-three feet of Rosecrans Street from the northerly edge of 31 st Street to the southerly edge of 32nd Street and preserving the existing Puget Sound Energy easement for underground electric system, Auditor's File No. 371424; and ii. The westerly thirty-three feet of Rosecrans Street abutting lots 5 and 6 of Block 6 of the Monogram Addition; and 111. Logan Street from the northerly edge of 31 st Street to the southerly edge of 32nd Street and preserving the existing Puget Sound Energy easement for underground electric system, Auditor's File No. 371424; and iv. Logan Street from the northerly edge of 30th Street to a point 25 feet south of the southerly edge of 31 st Street (remaining twenty-five feet provides for sewer lift station); and Thirtieth (30th) Street from the westerly edge of Lot 5 of Block 5 of the Monogram Addition to the centerline of Rosecrans Street. Section 2. That the following street right-of-way is hereby vacated to O'Meara Construction: the easterly thirty-three feet of Rosecrans Street abutting Lot 2 of the O'Meara Short Plat, as per plat recorded in Volume 3 of Short Plats, page 156, records of Jefferson County, Washington. Section 3. That the following street right-of-way is hereby vacated to Clifford Braden: the easterly thirty-three feet of Rosecrans Street abutting Lot 3 of the O'Meara Short Plat, as per plat recorded in Volume 3 of Short Plats, page 156, records of Jefferson County, Washington. Section 4. This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferson County Auditor. Read for the first, second and third times, and passed by the City Council for the City of Port Townsend and signed by the Mayor of the City this ~ day of ~/-- , 1998.
